Chaney, Sr. 125 Midwood Lane Belmont, NC 28012 APPROVAL of 401 Water Quality Certification and Authorization Certificate per the Catawba River Buffer Protection Rules (15A NCAC 2B.0243) Dear Mr. Chaney: You have our approval, in accordance with the attached conditions, to impact 144 square feet of Lake Wylie and 350 square feet of riparian buffer for the purpose of stabilizing a shoreline on Lot 11, Misty Water subdivision in Gaston County as described in your application received November 5, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3280, which can be downloaded from our web site at htto://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Regional Permit Number 198200030 when the US Army Corps of Engineers (USACE) issues it. This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers as required under 15A NCAC 2B .0243(8). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be.required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and those listed below. 1. The access path must be no greater than 7 feet wide and must run perpendicular through the buffer. 2. No trees greater than 6 inches diameter at the stump can be removed within zone I except for exempt trees, as specified in the Catawba River Buffer Protection Rules (15A NCAC 26.243). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/newetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. The State of North Qarolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with the conditions hereinafter set forth. Conditions of Certifiication: Activities which reequire approval under either of these General Permits but do not result in fill, dredging or excavation of waters or wetlands (such as docks, piers or boathouses) do not require written concurrence from the Division of Waters Quality as long as they comply with all other conditions of this General Certification. However, Condition No. 5 is applicable to all streams in basins with riparian area protection rules. 2. In accordance with North Carolina General Statute Section 143-215.31)(e'), any request for written concurrence for a 401 Water Quality Certification must include thq appropriate fec. Tf a project also requires a CAMA Peiznit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the'Division of Coastal Management; 3. All new development shall be located, designed, constructed, and. maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices; 6. That appropriate sediment and erosion control practices which equal or exceed those outlined ill the most recent version of the "North Carolina Sediment and Erosion Control (Planning and Design 'Manual" or the "North Carolina Surface Vning Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the propel- design, installation and iiperadon and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 7. Rip-rap shall be (installed adjacent to bulkheads in freshwater lakes to ensure protection of aquatic habitat. Construction over wetlands shall be elevated at least three feet above any wetlands, and floating structures shall not rest periodically on the bottom; 8. All sediment an? erosion control measures placed in wetlands oi• waters shall be removed and (the natural grade restored after the Division of Land Resources has released the project; 9. If an environmental document is required, this Certification is not valid until a Findine of No Signficant Impact (FONST) or Record of Decision (ROD) is issued by the State Clearinghouse. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding Regional PelTnit 198200030 or 198200079, whichever is sooner, 13. When written concurrence is required, the applicant is required to use the enclosed Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed. Non-compliance ,,vith or violation of the conditions herein set forth by a specific fill project shall result in revocation of this Certification for the project and may result in criminal and/or civil penalties. The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the Nvetland or downstream waters are precluded. Fees for "Major Water Quality Certification" (defined as those with greater than or equal to one acre of wetland or water fill or equal to 150 feet of stream impact) will have a fee of $475.00. "Minor Water Quality Certifications" (defined as less than one acre of wetland or less than 150 feet of stream impact) will have a fee of $200.00. Any applications received by DWQ after January 1, 1999 must be accompanied by a check for the required amount. If payment is not included with a request for a Nationwide Permit, the application will be returned to the applicant as incomplete. If the correct payment is not included with an Individual 404/401 or a CAMA Permit Application. a project file will be created, but the applicant will receive a letter informing them that the project will not be processed until the full payment is provided. Checks should be made out to the N.C. Division of Water Quality. You should be aware of these additional provisions of this new requirement. REQUIREMENTS • Changes to an existing 401 Water Quality Certification require a full new Certification by DWQ. Additionally, any 401 Certification that is requested to be renewed, as a result of the work not being completed prior to the expiration date, also results in a full issuance of a new Certification. A fee is required with each issuance. • Due to the requirement for fee payment for each request, applicants are advised to include as many project details and phases as possible in the initial application. • If a project requires a CAIMA permit and its associated fee, a payment for the 401 Certification request is still required. • No refunds will be issued for denied, modified or withdrawn certification requests. If DWQ or the Corps of Engineers retires a project due to insufficient or inaccurate information, no refunds will be issued. • Payment must be made in full. • Nationwide Permits for minor wetland impacts or those without wetland or stream fill that do not require written approval of the 401 Water Quality Certification do not require payment of the fee. If an applicant still chooses to submit an application in order to have written approval to file with their project records, then the fee payment is required if wetland or stream fill is involved. • Receipts for fees will only be sent upon written request. Also please be aware that the Division considers stream impact to be length rather than area in all cases regardless of Individual versus Nationwide permit status or significant versus insignificant channel. This has been DWQ`s policy since February 1997 but recently some confusion has developed with some applicants.
