Certification for the Replacement of Bridge No. 82 over Marsh Swamp on NC
561; Halifax County; TIP Project B-3853; Federal Aid Project No. BRSTP-
561(1); State Project No.8.1301901; WBS 33000.1.1.
Reference: USACE Nationwide Permit 23 dated January 30, 2007, Action ID 2006-41559-
142. Corrected NCDWQ Water Quality Certification and Tar-Pamlico Buffer
Authorization dated February 12, 2007, WQC No. 20061693.
The purpose of this letter is to request modifications to the Clean Water Act (CWA) Section 404
Permit issued by the USACE and the Water Quality Certification issued by the NCDWQ. This
project is due to let on April 17, 2007. The North Carolina Department of Transportation
(NCDOT) is proposing the following modifications:
• A driveway is being added resulting in an additiona10.03 acre of wetland impacts.
• The wetland area to be restored is shown on the revised plan sheets. This onsite restoration
will provide mitigation for these additional impacts.
• The easement line to the south has been changed to right of way designation.
Regulatory Approvals
The NCDOT respectfully requests that the referenced 404 USACE Permit and 401 Water Quality
Certification be modified to reflect the revision to the project's plan sheets as outlined in this
letter. We are providing five copies of this application to the North Carolina Department of
Environment and Natural Resources, Division of Water Quality for their review and approval.
