Box 1007 Plymouth, NC, 27962 APPROVAL of 401 Water Quality Certification Dear Mr. Davenport: You have our approval, in accordance with the attached conditions, to dredge and fill 58.2 acres of canal bottom and bank in order to conduct maintenance excavation on six miles of channelized stream to improve drainage on Eddie Smith Canal in Washington County, as described in your application received by the Division of Water Quality on October 26, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 1506 of the North Carolina General Statutes to the Office'of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. PROJECT SUMMARY: Applicants propose to conduct maintenance excavation on 6 miles of channelized stream to improve drainage. Washington County Eddie Smith Canal Project Setting The project area is located on the channelized head waters (Eddie Smith Canal) of the Scuppernong River upstream of the Phelps Bridge on SR 1155 near the community of Cherry in Washington County, North Carolina. The project area includes six miles of channalized stream that crosses mainly through wooded wetlands and agricultural fields between the upper Scuppernong River and Lake Phelps. The project area ends in ag fields located upsteam of SR 1126 (Newland Road). There is a continuous maintained spoil berm adjacent the south side of the canal the entire project length and is approxamately f50' wide. The spoil berm is flat, vegetated with upland grasses. The canal serves as drainage for approxamately 20,000 acres of woodlands and croplands. The canal is between 25' to 50' wide. There are numerous lateral ditches that drain to the canal. Silt accumilation in the canal is evident in areas where fallen trees and other debris have restricted water flow allowing settlement of sediments and the pionering of Alligator weed (Achyranthes philoxeroides). The Scuppernong River is designated as Inland Waters by the Wildlife Resources Commission at this location and is classified as C-sw by the Envirornnental Management. Commission. Project Description The project is maintenance excavation of 6 miles of channelized stream. The applicant proposes to remove between P to 4' of material. Final project depths will range from 4' at the upper end of the project area to 9' at the lower end of the project area near the Phelps Bridge on SR 1155. A ±4' high earthen containment berm will be constructed on both sides of the existing spoil berm using material excavated from the center of the existing spoil berm. A dragline and long reach backhoe will be used to complete the maintenance excavation in the canal. The excavated material will be placed between the containment berms, allowed to dry, then leveled and seeded. Anticipated Impacts Approxamately 1,584,680 ft2 of channelized stream will be excavated with 6 miles of canal bank graded, filled then leveled resulting in ±950,400 ft2 of upland disturbance. There will be some short term turbidity in the canal during the excavation. EDDIE SMITH CANAL PROJECT The Eddie Smith Canal Project starts one hundred yards upstream of Phelps Bridge. Phelps Bridge is approximately 1.5 miles south of Creswell and 0.5 miles north of Cherry. The canal runs in a north west direction before turning southwest to south direction for approximately six miles. A special assessment district was established in 1992.Using General Statue 153A-185; Special Assessments (Service District) the land area is assessed so much pre acre for cropland and so much for woodland for maintenance of the canal. By doing this no State or Federal dollars are used in this project. Since the establishment the canal has been cleared and snagged; the canal bank turned into a travel way; culverts have been installed to allow for water to enter the area behind the travel way. On the upper end a limited amount of spoil was removed with a minor permit. No major restoration has taken place on this canal since it's construction in the 60's other than the clearing and snagging and the bank work. The landowners want to do a major removal of silt from the wooden bridge behind the old First Colony elevator downstream. The width of the canal is from 25 to 75 feet wide. For this reason the work will need to be carried out with a dragline and a long reach backhoe. The water depth at present is from one (1) to five (5) feet and after the clean out the water depth will be from two (2) to six (6) feet. The spoil that will be removed from the canal will be placed on the existing travel way. Due to the nature of the spoil, a berm will be constructed along both edges of the travel way. The freshly excavated material will be deposited between the berms and after it has dried the material will be shaped and seeded.
