Box 88 Bluemont, VA, 20135 APPROVAL of 401 Water Quality Certification Dear Mr. Turnbull: You have our approval, in accordance with the attached conditions, to place fill in 0.065 acre of freshwater wetlands for residential fill on your property in Currituck County, as described in your application received by the Division of Water Quality on September 27, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: This project involves the filling of freshwater wetlands within the Coastal Shoreline Area of Environmental Concern of the Currituck Sound. John Turnbull, Currituck County FIELD INVESTIGATION REPORT Page 2 PROJECT SETTING The project site, lot 100, is a vacant 0.2-acre lot located along the west side of Monteray Drive in the Monteray Shores Subdivision in Corolla, Currituck County. This property does not have riparian access to the Currituck Sound, but is near a small pond/inlet area that connects directly to the waters of the Currituck Sound located on the adjacent waterfront lot, Lot 62, which places the lot within the Coastal Shoreline AEC. Originally, this small inlet area consisted of a small pond that did not directly connect to the Currituck Sound; however, erosion events during the last several years have resulted in this pond's direct connection to the Sound. The shoreline of this pond area is approximately 30feet from the closest NWL measurement of the Currituck Sound. The plat for this property was recorded on May 19' and 20'h, 1988 and the application reports that this lot elevation is 7 ft above the NWL. The western-most portion of the lot is within the Coastal Shoreline Area of Environmental Concern, but does not extend to the NWL of the Currituck Sound. The shoreline area is predominately vegetated in freshwater wetland plant species. This shoreline is vegetated with some Juncus roemerianus but is mostly vegetated in Myrica cerifera, Acer rubrum and Salix spp. The western portion of Lot 100 is vegetated in predominately freshwater wetland plant species including the aforementioned plants, as well as Juncus effusus and Thelypteris thelypteroides. The eastern portion of the lot is upland and is vegetated in tree, shrub and grass plant species including Quercus virginiana, Ilex vomitoria, and Panicum amarum. The existing wetland area extends beyond the platted limits of lot 100 onto lots 62 and 99. The waters of the Currituck Sound are classified as Joint Waters by the North Carolina Marine Fisheries and Wildlife Resources Commissions. These waters also are designated by the Coastal Resources Commission as Public Trust Area and Estuarine Waters, designated Areas of Environmental Concern. The land and wetland areas within 75 ft of the NWL of the Currituck Sound are also designated as Coastal Shoreline Area of Environmental Concern. PROJECT DESCRIPTION The applicant proposes to fill 0.065 of an acre of lot 100. This fill will include the filling and grading of approximately 0.02 of an acre of existing upland area, as well as 0.045 of an acre of existing freshwater wetlands located on lot 100 within the Coastal Shoreline Area of Environmental Concern of the Currituck Sound. This activity is proposed to prepare the lot for residential construction and will be accomplished by using trucked-in, off-site fill and typical grading practices. Except for this filling and grading activity, this proposal does not include any Public Trust, other wetland or upland development. Nationwide Permit No 18 (Action ID No. 200110066, date 12/12/00) has been issued by the US Army Corps of Engineers to provide federal authorization to fill 2,002 sf of freshwater wetlands on this site. The application reports that site disturbance will be limited to the proposed fill described above and will not result in any land disturbing activity or development within the Coastal Shoreline 30 foot buffer area. John Turnbull, Cun ituck County FIELD INVESTIGATION REPORT Page 3 ANTICIPATED EM PACTS The proposed development will result in the loss of 0.045 of an acre of freshwater wetlands and the associated habitat and resource benefits directly associated with this type of wetland area. This proposal will not directly impact any coastal wetlands or Public Trust Area resources. However, the proposed fill will restrict drainage to this inlet area, as well as flows to and from the remaining wetlands on lots 62 and 99. In addition, as proposed, the fill may erode off into the remaining wetland areas, as well as into the adjacent Coastal Shoreline buffer area. Prior to this pond becoming directly connected to the Currituck Sound, this pond provided stormwater retention, either intentionally or naturally for the immediate vicinity. Although the existing pond no longer provides true retention of stormwater, in essence, it provides some mechanism for slowing stormwater flows before they enter the Currituck Sound. The proposed fill creates an isolated wetland, which at times of high volume of rainfall, may create a drainage problem for the immediate vicinity. This proposal also may not be consistent with the current Currituck County Land-Use Plan concerning responsible development related to its effect on the environment and the Currituck Sound. This application does not provide for any upland development within the Coastal Shoreline AEC, the placement of a SFR on this lot, or the construction of any water dependent structures. This proposal will not interfere with any adjacent public trust and will not result in any development within the 30-foot Coastal Shoreline Buffer. Submitted by: Dennis W.
