Box 408 Kill Devil Hills, NC, 27948 APPROVAL of 401 Water Quality Certification Dear Mr. McPhee: You have our approval, in accordance with the attached conditions, to place fill in 0.02 acre of non-vegetated wetlands in order to construct a new bulkhead, enclose a boat basin and perform maintenance dredging adjacent to your pier in Colington Bay, Big Colington Island, Dare County, as described in your application received by the Division of Water Quality on October 22, 2001. After reviewing-your application, we have determined that this fill is covered by General Water Quality Certification Number 3274, which can be downloaded from our web site at httv://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation maybe required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant, Mr. McPhee proposes to: 1) construct a new bulkhead two feet waterward of the existing alignment, 2) enclose a 20'x 28' man-made boat basin; and, 3) maintenance dredge a 60'x 16' channel adjacent to his existing pier to a depth of -3'-0", in Colington Bay, Big Colington Island, Dare County. PROJECT SITE The property is located on a dirt lane on the north side of Colington Drive, approximately 100' east of King Court (a private street in Colington Harbour Subdivision) on Big Colington Island, Dare County. The physical address for the property is 2168A Colington Drive. Mr. McPhee's property is located at the first dwelling on east side (right side) of the lane. The property consists of approximately .53 acres, is located in an AE Flood Zone, and has an average elevation of five to six feet above normal water level (NWL). Vegetation on the applicant's property is sparse with the exception of a few live oaks (Quercus virginiana), a Bradford pear (Pyrus calleryiana), sandspurs (Cenchrus spp) and domestic yard grasses. There is a narrow fringe of big cordgrass (Spartina cynosuroides) along the southern boundary of the property that is contiguous with a large marsh located to the south on the adjacent property. No Section 404 Wetlands have been identified on the applicant's property. Structures on the property include a dwelling, garage, a two- story storage structure and shop, and a 4'x 52' long pier. Located immediately north of the applicant's property is his son's residence and to the west is the dirt lane accessing the site. Land uses in the area are a mix of residential and light commercial. The shoreline along the applicant's property consists of an old wooden bulkhead that is in poor condition. Sheathing along the structure has deteriorated causing small pockets of erosion behind the bulkhead. The deepest eroded pockets along the bulkhead measures approximately 3'-0" and is above (landward of NWL). Water depths along the existing bulkhead vary from 1.5' to 1.9' below NWL. The 20'x 28' basin is approximately 6" deep along the landward wall, with a maximum depth of 1.5'. The basin has silted in through the years and now acts a trap for debris. On three separate site visits the basin contained dead animals including fish, crabs, nutria and deer. The water bottom adjacent to the bulkhead is sandy and gently slopes away from the shoreline into Colington Bay. While submerged aquatic vegetation is present near the property, there is no evidence of vegetation within the project area itself. Colington Bay is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Currituck Sound is SC (fish propagation). Additional review indicates that there are no known geological formations associated with the applicant's property. There are six identified archeological sites within Colington Harbour Subdivision (DR13-16, DR43 and DR57), but no identified sites adjacent to the applicant's property. Colon McPhee, Sr. Field Report Page 3 The applicant received a CAMA Major Permit in 1977 to dredge the existing basin, a 16'x 60' channel adjacent to the boat basin, and construct the existing bulkhead (#69-77). PROJECT DESCRIPTION The applicant proposes the following activities: 1) According to the application, Mr. McPhee proposes to construct an 85 linear foot vinyl bulkhead, with a 15' return wall to the north and a 25' return wall to the south (adjacent to the coastal wetland fringe). The new bulkhead will be placed an average of two feet waterward of the existing bulkhead and close off the existing boat basin. Based on the size of the boat basin the proposed bulkhead will be located a maximum of 10' waterward of NWL. Approximately 730 sf of Estuarine and Public Trust Waters will be filled in conjunction with the proposed bulkhead and will require approximately 67 cubic yards of fill waterward of NWL. Land disturbance anticipated in conjunction with the placement of the bulkhead will be approximately 3,520 square feet. 2) The applicant also proposes to maintenance dredge the small channel immediately waterward of the man-made basin, adjacent to his pier. Depths range from 1.5' to three feet within the proposed 16'x 60' dredge area. It is estimated that approximately 40 cubic yards of material will be removed. The material will be placed on high ground, landward of a silt barrier, within thirty feet of NWL. The material will be drained mixed with commercially obtained fill dirt and used as fill for the proposed bulkhead. ANTICIPATED IMPACT • The loss of 730 square feet of Shallow Water Habitat, Estuarine and Public Trust Waters. • Temporary localized turbidity will occur during construction of the bulkhead and during dredging. • Approximately 560 square feet of shallow bottom will be disturbed by the dredging operation. • Approximately 3,520 square feet of high ground will be disturbed in association with the shoreline stabilization and the filling of the basin. • The new bulkhead will afford the applicant protection of his property.
