You have our approval, in accordance with the attached conditions, to shade 0.002 acre of wetlands in order to add
four boat slips to an existing marina adjacent to your property in Dare County, as described in your application received by
the Division of Water Quarity on October 16, 2001. After reviewing your application, we have determined that this fill is
covered by General Water Quality Certification Number 3274, which can be downloaded from our web site at
httD://1h2o.enr.state_nc.us/ncwetlancis . This Certification allows you to use your CAMA Permit when it is issued by the NC
Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead
with yc-ur project including (but not limned to) Sadiment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the
General Certification.

8. PROJECT SUMMARY: The Colington Harbour Association proposes to add four boat slips to an existing 21 slip
docking facility (Marina). The additional slips will include constructing two new 3'x 15' finger piers with mooring
pilings on the end of each and eight independent mooring pilings. The boat slips will be placed adjacent to the
existing slips in the man-made boat basin on the south side of the clubhouse.

PROJECT SETTING
The Colington Harbour Association docking facility is located adjacent to the Association
Clubhouse in Colington Harbour Subdivision, a residential community, on the western end of Big
Colington Island, on Colington Drive, in Dare County. The association property consists of
approximately 8.66 acres (According to the Dare County Tax Department) and is the main recreational
site for the subdivision. The marina area is located at the base of an old remnant dune system that forms a
ridge that runs along the Sound in a northerly direction from the boat basin. Adjacent to the marina is a
parking lot that covers over two acres and terminates approximately three feet from the water. The
parking lot provides short-term parking of boat trailers, access to the club facilities, and as an emergency
helicopter pad. Other structures on the property include a clubhouse, swimming pool, concession area,
playground and picnic area, bathroom facilities, a boat ramp, and docking facilities. Docking facilities at
the site includes 19 docks, piers and finger piers, for a total of 21 boat slips. While the application states
that there are currently 19 slips, staff determined that two smaller slips are delineated by an existing "T"
head pier located between the main docking area and the boat ramp along the eastern side of the basin,
and are sufficient for docking small vessels. Shading of Estuarine and Public Trust Water form existing
docking structures is approximately 1,584 square feet.
The property is located in an X and an AE Flood Zone according to FEMA. The average
elevation of the property is approximately six feet above normal water level (NWL), while the elevation
immediately adjacent to the bulkhead is approximately three feet above NWL. Water depths along the
bulkhead are 3.5', while depths are between 6.5' and T-0" at a distance of 70' waterward of the bulkhead.
No Submerged Aquatic Vegetation is evident in the basin adjacent to the property and high ground
vegetation is almost non-existent adjacent to the main docking area. Domestic yard grasses are found
immediately adjacent to the bulkhead, while live oaks are the dominant vegetation found along the south
end of the site adjacent to the Sound.
Roanoke Sound and its tributaries (in this area) are classified as joint waters by agreement
between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of
Environmental Management's water quality classification for Roanoke Sound is SB (swimming).
The applicant states that Archaeologist David Phelps preformed an Archaeological Survey of the
Colington area several years ago, and according to available maps in the District Office, a known site is
located in the vicinity of the parking lot adjacent to the marina and is listed as site Dr 16.
A number of CAMA Permits have been issued to the Colington Harbour Association over the
years to construct bulkheads, finger piers and perform maintenance excavation at the entrance to the
basin. The following is a list of permits:

PROJECT DESCRIPTION
The applicants, Colington Harbour Association, propose to expand existing docking facilities
from 21 slips to 25 slips. The location of the new boats slips would be adjacent to the south end of the
main docking area within the existing basin, and would include the creation of (2) 16'x 40' slips and (2)
12'x 24' slips. The request includes constructing two new 3'x 15' finger piers with mooring pilings on
the end of each, and eight independent mooring pilings. The proposed location will be in a configuration
that will be 9'-0" to 15'-0" south of the last line of pilings delineating the existing boat slips. Shading
from the finger piers will be approximately 90 square feet and will be three feet above NWL.
ANTICIPATED IMPACTS
Temporary turbidity can be expected during construction of the pier system.
Approximately 90 square feet of Estuarine and Public Trust Water will be will be affected by
shading.
Approximately1,856 square fee of Public Trust Water will be blocked from navigation.
A slight increase in public use of the adjacent waters can be anticipated with the expanded
facilities to moor additional boats.
A secondary impact of the increased use of Public Trust Waters will be an increase in turbidity of
the adjacent waters.
Another secondary impact that can be anticipated from this development is an increase in non-
point source pollution from watercraft.

The Colington Harbour Association, Inc. provides a small area of its bulkheaded
waterfront for mooring boats. Slips, which consist of small finger piers and pilings,
are available on a daily, weekly, monthly and seasonal basis to property owners. In
addition, Colington Harbour has allowed transient boaters in distress to use the
slips on a daily basis. None of the slips is equipped with electric power or water.
All of the slips are currently occupied and there is a waiting list for an empty slip.
The proposed project will add four more slips on the eastern end of the existing slips
through construction of two finger piers and placement of pilings. This area has
been used in the past by transient boaters or by boaters needing shelter during an
impending storm. Two slips will be 16' x 40' to accommodate larger boats and the
other two will be 12' x 241.
Finger piers will be wooden decking 3' x 15'. The mooring pilings will be 12 inches
by approximately 25' long and will be jetted into the bottom approximately 8'.
Water depths in this area range from two feet immediately adjacent to the bulkhead
to 3'+ at 30' out from the bulkhead.
Other bulkheaded waterfront areas are used for day mooring during community
events in the soundfront park, for strolling and for fishing. A gasoline fuel pump is
located to the west of the existing slips.

Engineers regarding that agency's use of larger

requirements and it must be sufficiently detailed to
