Dear Mr. Koscso,
You have our approval, in accordance with the conditions fim!d below. to impact =.300 ft2 of Zone 2 of the
protected buffers to construct the proposed home additacrn on the sa'vj= property as described within your variance
request dated October 25, 2001. This letter shall act as you Minor Vzriance approval as described within 15A NCAC 213
.0233(9)(b). In addition, you should get any other regaiod federal or local permits before you proceed with your
project including (but not limited to) Sediment and Erosion ConftoL
This approval is only valid for the purpose and design that Im described in your A Fmw Variance Request dated
10/25/01 and attached plat initialed by DWQ staff on 129MI. If yam change ymnr project, you must notify us and you
may be required to send us a new request for approvaL If the proper is sold, t2he new ownm- must be given a copy of this
approval and is thereby responsible for complying with all condidca& For this approval to be valid, you must follow the
conditions listed below.
1. No impacts (except for "exempt" uses as identified wiidrin 15A P4CAC 2B .0233) shall occur to Zone 1 of
the protected riparian buffers.
2. Stormwater shall be directed as diffuse R m at nom=osive vdociities through the protected stream buffers
as identified within 15A NCAC 213 .02313(5). RoofAminage fill lm the new a lMon shall be directed to
vegetated areas at non-erosive velocities prior to e?mng the patmeoxted r'I buffers.
3. You are required to plant approximak ly 25 woody Anibs within 30 feet of the stream within one year of
the date of this approval as described myour Passed letter to this office dated November 23, 2001.
You or any future owners of this propedy must et» that these woody 19 14 survive for a period of at
least 5 years. If any of the woody shtic diie within this period ter must be at`placed with new woody
shrubs. If this is unacceptable to you, dr DWQ irA accept paywamt into the Riparian Buffer Restoration
Fund to compensate for 450 square feet of required Umffer mitigpfian in place of planting these woody
shrubs. Please contact this office if yon choose to tAc this appmezh.
If you do not accept any of the conditions of thus approval, ym may ask fu and adladi=ory hearing. You must
