This approval allows you to: 1) Dredge approximately 20,000 sqft (0.45 ac) around the proposed docks. The excavation would measure approximately 495' in length X 42' in width and -2' in depth. This approval is only valid for the purpose and design that you described in your CAMA application dated October 2, 2001 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3274 covers this activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your CAMA application dated October 2, 2001. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below. 1). Turbidity needs to be controlled when putting in the pilings so that turbidity does not exceed 25 NTUs outside the project area (i.e., Turbidity curtains). 2). FIELD INVESTIGATION REPORT: MONEY ISLAND/CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The applicants own the 5-acre island known as Money Island off Money Island Slough just north of East Fort Macon Road, adjacent to Bogue Sound, in the Town of Atlantic Beach, Carteret County. The island is divided into four individual lots ranging in size from 1.08 acres to 1.51 acres. The island was built up many years ago after spoil material from a nearby dredging project was deposited on the island. It is currently a typical mature spoil island with maritime vegetation dominating the island. A 30' to 50' fringe of marsh surrounds much of the island with more than 150' of marsh along the western end of the island. The lower marsh is dominated by lush SSpartina altemiflora while the higher marsh is a mixture of coastal and 404 wetland species. Oyster bars are abundant along much of the shoreline. Numerous private and commercial docks and two marinas (Fort Macon Marina w/ dry stack storage and Anchorage Marina w/ wet slips) dominate the southern and southeastern shoreline of the mainland. According to the applicant, Money Island Slough is a deep water system that at the project site, ranges in width from 110' to 132' as measured from normal high water to normal high water. However, the navigation restriction is substantially less with the distance from the existing docks on the south shore to the marsh on the island being some 85' in width along much of the slough's length. The USACOE Money Island Channel project leads into the adjacent Anchorage Marina and Money Island Slough from the east. The Slough runs to the north and west of the island and ties into the Atlantic Beach channels. There is tremendous boat traffic along this channel especially during the warmer months. Water depths along the "channel" of Money Island Slough are typically greater than 6' below NLW and average -3 to -4' below NLW some 25 to 40' from the marsh edge. There are several archaeological sites that have been identified by the N.C. Division of Cultural Resources on the island. The waters of Money Island Slough and the adjacent Bogue Sound are SA and closed to shell fishing. Project Description The applicants have previously proposed under an earlier application to construct four private 4-bedroom residences with individual LPP wastewater systems on the four tracts. Each tract would have a private dock extending into Money Island Slough with timber plank Hatteras- style walkways 6' in width providing access to the home sites. Subaqueous utilities (including water, electrical, and telephone) would be installed. Access would be provided by private boat with dockage and parking spaces being provided by both adjacent marinas. Due to earlier comments regarding the potential impacts to the boating public, the applicant has shifted the docks back to the edge of the waterward edge of the Spartina alterniflora marsh. Now the dock on lot #1 would measure 6' wide by 40' in length and extends 30' from MHW and would have a floating "T"-shaped platform measuring 6'X 80'. Thd dock on lot #2 would measure 6' wide by 80' in length and would extend 30' from MHW and would have a floating "T"-shaped platform measuring 6' X 66'. The dock on lot #3 would be 6' wide by 66' in length and would extend 35' from MHW and would have a floating 6'X 66' "T"-shaped platform. Lot #4 would have a 6' wide by 66' pier and would extend 40' from MHW and would a floating 5' X 80' FIELD INVESTIGATION REPORT: MONEY ISLAND/CARTERET COUNTY PAGE #2 "T"-shaped platform. The landward shift in the docks (brought about as a result of the potential impact to the boating public) has resulted in the docks being shifted for a second time. However, the docks are now located in water too shallow to navigate immediately adjacent to the marsh. Therefore, excavation is being proposed and is the reason for this re-circulation of the project proposal. Total area to be excavated would measure approximately 495' in length X 42' in width X -2' in depth. Excavation would stop 6' from the waterward edge of the marsh and would have a final project depth of -4' below NLW. Anticipated Impacts Permanent impacts associated with the high ground development and the utility line installation previously stated would remain the same. Fortunately, the docks would now usurp some 1,672 ft2 of Public Trust Areas instead of the previous 2,936 ft2. Access to the docks would still shade some 748 ft2 of coastal wetlands. Although the degree of impact from the location of the docks and with boats being moored at the docks has been reduced, the heavy use of the area by the boating public and the impact that these docks would have on that traditional navigation is still a concern. The latest proposal shows a minimum navigation width from the proposed structures to the existing structures on the opposite shore (floating dock, permanent boatlift, etc.) to be 110' along dock #1, 82' along dock #2, 105' from dock #3, and 93' along dock #4. Excavation around the waterward side of the docks would result in the loss of some 20,786 ft2 of shallow estuarine habitat. And although the proposed dredging would stop at the waterward side of the floating docks, there would be some sloughing off of the non-vegetated area adjacent the marsh or even impacting it slightly. The docks have been shifted closer toward the coastal marsh to obtain the maximum navigation between the proposed and existing docks. This shift of the docks creates a water depth that is unacceptable for docking, so dredging will be required (supplement attached). The drawings also depict the location of the dredging in relation to the coastal marsh line. We have maintained approximately six feet between dredging and coastal marsh to minimize any impact. This proposed excavation is approximately 1600 cubic yards and is to be disposed to an approved site by the contractor, which will be determined at a later date. The chart below shows the footage gain of navigable waters in comparison to the docks submitted on June 5, 2001 and that were later staked. I have backed the dock (additional eight feet) to the edge of the coastal marsh, but our owners have decided not to decrease the length of the dock.
