Roger, I spoke with Suzanne McCoy, Stormwater Program Administrative Specialist with the Division of
Energy, Mineral and Land Resources (DEMLR), at NCDEQ's downtown Raleigh Central office. She received the
Notice of Intent application, however by the time the NOI application package got to her location within
NCDEQ the $100 check was not with the package. The check may have been lost when they opened the FedEx
Pak at the Raleigh Regional office. She will not be able to complete and issue a certificate of coverage for the
general permit until she receives another$100 check.
Suzanne asked that PS Energy stop payment on the $100 check and send another check to her attention. If
using FedEx, please use the following address: 512 N. Salisbury Street, Office 640K, Raleigh, NC 27604.
Once she receives the check, she will begin the application review process.

On behalf of PS Energy Group, Inc. (PS Energy), ECS Southeast, LLP (ECS) is pleased to provide
this Notice of Intent (NOI) application for the Skyview Energy facility located at 416 Old Ranger
Road, Murphy, Cherokee County, North Carolina.
The NOI application is in response to a request by the North Carolina DEMLR for submittal of a
NOI as part of the Notice of Violation (NOV), NOV-2019-PC-0779, dated December 20, 2019,
referencing the lack of coverage under National Pollutant Discharge Elimination System (NPDES)
General Permit No. NCG080000 to allow stormwater discharges from the Skyview Energy facility.
The Skyview Energy facility currently discharges stormwater affected by site operations to
receiving waters designated as an unnamed tributary of the Hiwassee River, a Class C
waterbody in the Hiwassee River Basin.
To comply with the NOV request for a NOI submittal, PS Energy has prepared a NOI specifying the
Skyview Energy physical location, industrial activities, discharge points, and stormwater controls
that apply to the site. The information in the NOI was based on (1) background information on the
Skyview Energy facility's petroleum product storage and distribution operations, (2) ECS site visit
data, observations, and photos related to the petroleum spill assessment, and (3) other supporting
information.
Specifically, the following items were identified or utilized in preparing the NOI:
• Site layout of operations,
• Google aerials of the site,
• Bulk tank storage and secondary containment,
• Loading/off-loading pumping stations,
• Stormwater conveyance features,
• Outfall discharge location and receiving water information,
•
• Terrain and drainage flow,
• Best management practices and stormwater controls (absorbent booms), and
• USGS quad maps.
