Project No. 00-5405 Unnamed tributary streams to Strouds Creek [03-04-01; 27-2-9; C NSW] Dear Mr. Clark, On May.25, 2000, I met with you to conduct an on-site determination to review several drainage features on the subject property for applicability to the Neuse River Buffer Rules [15A NCAC 2B .0233(3)(a)]. As a result of this on-site determination the Division of Water Quality (DWQ) has determined that the attached map initialed by me on 9/26/01 accurately approximates the surface waters subject to the Neuse Buffer Rules (North Carolina Administrative Code T15A:02B.0233) as determined by the undersigned on May 25, 2000. No other subject surface waters were determined to exist within the property boundary. These buffers begin at the most landward limit of the top of bank and extend landward a distance of 50 feet on all sides of the subject surface waters, measured horizontally on a line perpendicular to the subject surface waters. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. As per your question related to a possible septic line crossing of the buffers and stream, perpendicular crossings that disturb equal to or less than 40 linear feet of riparian buffer with a maintenance corridor equal to or less than 10 feet in width are "exempt" and do not require written authorization prior to construction.
