Lumberton, NC 28358 SUBJECT: Approval of 401 Water Quality and Additional Conditions 120 Marlin Street, Holden Beach DWQ Project # 011412 Brunswick County Dear Mr. and Mrs. Sessoms: You have our approval, in accordance with the attached conditions (WQC # 3274) to conduct the following activity at the property located at 120 Marlin Street, Holden Beach in Brunswick County. This approval allows you to: 1) Construct a 50' bulkhead and fill approximately 750 square feet of non-vegetated coastal wetlands. This approval is only valid for the purpose and design that you described in your CAMA application dated September 6, 2001 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3274 covers this activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your CAMA application dated September 6, 2001. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. This Certification replaces Water Quality Certification Number 3025 issued on September 6, 1995 and Water Quality Certification Number 3112 issued on February 11, 1997. This WQC is rescinded when the Corps of Engineers reauthorizes Regional General Permit 0291 or when deemed appropriate by the Director of DWQ. The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with conditions hereinafter set forth. Conditions of Certification: 1. Activities authorized by CAMA major permits require written concurrence from the Division of Water Quality as well as compliance with all conditions of this General Certification; 2. Activities authorized by Coastal Area Management Act (C'UMA) Minor or General Permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; 3. In accordance with North Carolina General Statute Section 143-215.3D(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the Division of Coastal Management; 4. Impacts to any stream length in the Neuse and Tar-Pamlico River Basins requires written concurrence from DWQ in accordance with 15A NCAC 2B.0233 and 15A NCAC 2B .0259. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse and Tar-Pamlico River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0233 and 15A NCAC 2B .0259. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices; 5. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 6. If an environmental document is required, this Certification is not valid until a Finding of No Signficant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse. (Once across the bridge, turn right onto ocean, Boulevard West. procced down Ocean Boulevard West past the oceanfront fishing pier to the third set of canal streets, locally known as the "fi$h streets". Turn right onto Marlin Street. The house is under constaucdon at 120 Marlin and is on the right. Thy lot borders a man-made canal. The lot is can-entry living developed. It has a house nearing completion, driveway, septic system, and a bulkhead wall. The house under const matim is situated between 6 and 121andward of the existing bulkhead. The applicants were given as exemption to the 30' setback ntle to show the house to encroach into the 30' buffer zone tram mean high wafer due to the lot being 0' Mler than 5,000 square feet. T'he bause is lined up with tho older, existing houses on each side. The oxisSag bulkhead seems to be in good repair except for the wing walls that connect the main run of tho wall to the adjacent bulkheads on neighboring properties. One wing wall is very dilapidated and in need of replacement. The bulkheads on the adjacent properties extend 141 and 16' waterward of the applicants' existing bulkhead. The applicants wish to extend their buMead waterward an average of approximately 15' to line up with the neighbor's bulkheads. A portion of the area waterward of the existing bulkhead wall that would be tilted if this pernut is granted is curtly non-vegetated marsh- The area has a prolific amdUat of crab holes in sandy, mud substrate, Several months ago a very few remnant Sm tina terniflora stabs remained. There axe no stubs and no vegetation now. A prominent marsh fringe is evident is the 1998 aerial photography but missing in the 2000 photography- The earlier marsh fringe probably dictated the location of the existing bulkhead (landward of the marsh). The changes in the marsh could be a result of accumulating sediments, natural die?off, ainfiuence of adjacent bulkhead walls, Hurricane Floyd related or combinations of the factors mentioned or those unknown. The arrerage high water line is the existing bulkhead. The waters of the canal have been classified as SA by the Division of Water Quality. The waters are dosed to shellfrshing and aTe not a designated Primary Nursery Area. 10. ANTICIPATED D2ACTS A, total of 750 SqUM feet of -non-vegetated coastal marsh and sWow bottom would be filled as a result of this work, All of the 750 square feet is public trust waters {belpw mean high water') that would be filled % as a result of this project. This would be consistent with the Coastal Resources Con=i0ion's efforts to maximize the buffer between homes and doastal shorelines, In addition this would allow us to oorreet a problem with the north wing of the existing bulkhead beg,awe it has failed and is in need of replacement- It is allawing sediment to Ater tbxough the wing and the woad has deteriorated beyond repair. See Exhibit A for a photo of the failed bulkhead wing on the North side of the lot and Exhibit B for a photo of-the South side of the lot showing the bulkheads we would like to align with, Alipiug our bullhead with adjoining lot owners would also sigoitcantly strengthea the shoreline in this area. As you can see from the photos in Exhibits A and B, there is Ao marsh grass or any other vegetation in the area to be filled nor is there any vegetation along the canal for several lots on either side. In the Policy Identification section of Section 10 of the Holden. Beach Land Use Plan, it is clear that Holden Beach supports the construction of bulkheads along shorelines void of wetland vegetation, In addition, Section. 7 of the Coastal Management Rules for Major Fetxnfts under-the NC AdvAnistrative Code supports alignment of buMcatds especially in Section 7(D)(ii). We propose laaving the existipg bulkhead in place to use as an additional anchor for the new bulkhead while providing additional support against passible erosion. We have also attached txhibits C and D that are letters f' m the adjoining landowners supporting this request and asking for your approval.
