MSD updated the Long -Term Monitoring Plan (LTMP) in August of 2019 and received state approval October 21, 2019. MSD pretreatment staff completed the Industrial Waste Survey (IWS) and submitted it to DWR on October 31, 2019. The IWS has not been approved by the state at this time. REPEAT SNCs are serious matters that MUST be explained in the Narrative. 2 019 Pretreatment Annual R Metropolitan Sewerage District of Buncombe County (MSD) NPDES Permit # NC0O24911 Arcadia (5-078) Arcadia was issued a SIU permit #5-07849 on February 1, 2019. DWR approved the permit on January 28, 2019. A Consent Agreement was issued at the time of permit issuance. On Apri18, 2019, two NOVs were issued. The first NOV was issued for failing to meet four milestone dates from the Consent Agreement, as well as failure to notify. A civil penalty of $1500 was assessed. The second NOV issued on April 8, 2019, was for failure to report self -monitoring data on time, as well as a BOD limit violation on February 19, 2019, and a TSS violation on February 27, 2019. A civil penalty of $300 was assessed. On April 10, 2019, the Consent Agreement was terminated by MSD, and Arcadia was put under an Administrative Order. On June 14, 2019, a NOV was issued Co failure to obtain flow data, pH data, and required BOD/TSS samples in the month of April. The NOV also addressed a BOD violation on March 27, and TSS violations on March 27th and April 3rd. A civil penalty of $5,250 was assessed. On August 28, 2019, a NOV was issued for failing to meet milestone four of the Administrative Order. A civil penalty of $2000 was assessed. Arcadia hired Black &Veatch which helped them make multiple process changes to obtain compliance with the permit. There were no limit violations in the second half of the year and the previously mentioned Administrative Order ended on December 31, 2019. Balcrank now Samoa (S-071) Balcrank's permit was modified on August 1, 2019, to reflect change of ownership and change the company name to Samoa Corporation. The new permit included all QP state approved changes to our SIU permit template in 2018. DWR approved the permit on August 1, 2019. Samoa is a batch discharger. Samoa only discharges wastewater from the metal finishing process four to five times per year. In October 2019, sampling analysis showed a Zinc violation of 1.3 mg/l. The Zinc limit for Samoa is 1.0 mg/l. This is above the TRC limit. Samoa only discharged twice during the second half of 2019, which places them in SNC for Zinc limit violation. Samoa Corporation has not changed the process for metal finishing and has not had a violation for Zinc since they began sampling for that parameter in 2010. MSD conducted sampling in January 2020, and the Zinc was below the limit. MSD waited to issue a NOV for the Zinc until the laboratory could verify the results. The SNC Report is included with the PAR as well as the Public Notice. MSD does not yet have a copy of the Affidavit of Publication. MSD will submit it to the sate as soon as we receive it. Blue Ridge Metals (S-060) On March 7, 2019, a NOV was issued for a zinc violation on January 23, 2019. No civil penalty was assessed. Day International Inc. (5-057) Day international Inc. had three consecutive flow violations at monitoring point 04 on June 8, 9, and 10, 2019. This was due to a line blockage, therefore, the now readings were not accurate. No NOV was issued, and no civil penalty was assessed. On OctoberDay International Inc. had a TSS violation at monitoring point A The cause of the high TSS was not determined and there have been no subsequent violations. GF Linamar, LLC (5-076) On February 26, 2019, MSD sent GF Linamar a NOV for an 0&G violation on January 11, 2019. No civil penalty was assessed. On January 6, 2020, a NOV was issued for flow violations on November 5, 9, and 27; for a pH violation on November 10, 2019; for an 0&G violation on November 27. No civil penalty was assessed. On February 20, 2019 a NOV was sent for flow violations on December 9, 18, 25, and 27; for 0&G violation on December 5, 2019; for Phenols on December 5, 13, 17, and 23. No civil penalty was assessed. GF Linamar continues increase production; therefore, they have submitted a new permit application. MSD is working with GF Linamar to update the permit to reflect the increase in production. Flow and phenol limits will be increased in the upcoming permit modification. GF Linamar is working to pinpoint the 0&G issue. 14 Jacob Holm Industries, America (S-067) At the start of 2019, Jacob Holm Industries (America) was under a Consent Agreement with MSD. On January 5, 2019, there was a flow violation due to line flushing. MSD sent a NOV on March 4, 2017) and a verbal response was deemed sufficient. On September 4, 2019, MSD sent a NOV for three TSS violations in July of 2019, as well as three spills that occurred in June -July of 2019E A civil penalty of $6,350 was assessed. On September 26, 2019, a NOV was sent for two TSS violations that occurred in July -August, as well as 3 spills that occurred from August - September. A civil penalty of $16,500 was assessed. On October 7, 2019, a NOV was sent for a spill that occurred on September 23, 2019E A civil penalty of $20,000 was assessed. On October 18, 2019, Jacob Holm Industries (America) was placed under an Administrative Order. Mission Hospital LLLP (5-068) Mission Hospital LLLP's permit was modified on September 6, 2019) to reflect change of ownership. MSD also added a COD monitoring requirement to determine if chlorine is affecting the BOD results, and to develop a COD:BOD ratio if needed. This modification also includes all state approved changes to our SIU permit template in 2018E DWR approved the permit on September 9, 2019E New Belgium Brewing Company (S-075) New Belgium Brewing Company's SIU permit was modified on April 8, 2019, to reflect the completion of Phase Two of their pretreatment system. This modification also includes all state approved changes to our SIU permit template in 2018E DWR approved the permit on April 10, 2019E Prince Manufacturing (5-065) On April 4, 2019, MSD issued a NOV for flow violations that occurred on February 20, 21, 26, and 27. No civil penalty was assessed. On April 29, 2019, MSD issued a NOV for flow violations that occurred on March 11, 13, and 19. No civil penalty was assessed. On July 5, 2019, a NOV was issued for flow violations that occurred on May 5, 9, 19, 20, 21, and 26. No civil penalty was assessed. These flow violations caused no problems at MSD. Prince Manufacturing ramped up production to catch up producing products for customers. Flows are now back to normal. In the future their flow limit will be increased if needed. On February 2, 2020, a NOV was issued for failure to report and failure to respond. Self -Monitoring data was not received on time in October 2019, or December 2019. When the reports were received each contained errors. Prince also failed to respond in a timely manner to the request for missing data and yearly inspection. A civil penalty of $100 was assessed. Payment has not yet been received (overdue). For example, with zero process water flow we are showing 150 gal. per minute. I spoke with Angel and just now spoke with a gentleman from MSD who is coming out to take a look. I'm asking that MSD use their high pressure unit to clean out the line between the street and our meter. MSD has done this in the past although some time ago. If MSD is not able I will be contacting someone like Mr. Rooter to do the same as quickly as possible. Just wanted to give you a heads up on the issue. It will be noted in the July report. We experienced flow volumes that exceeded our S-076 permit's limit on: gin 251n, and the 271n %s of right now, the &076-18 permit only considers 4 of the 8 DCMs implemented and MSD is aware of this. Our permit is currently being revised to account for the additional DCMs we've installed on the production floor. Since the new machines have led to an increase in the amount of wastewater discharged, our updated permit has a new, proposed flow limit of 06019181167 MGD. Phenol levels on December 51n 13tn 17tn and the 231d exceeded our permit's limit of 0.024 mg/I. Much like the flow issue, though, this will be resolved once the updated permit is approved. Permit limits will increase to account for all waste streams containing Phenols. Oil & Grease levels on December 5tn reached 66 mg/l. This is outside our permit limit of 37mg/I. To prevent this issue from re -occurring, we will continue to work over the next few weeks to pinpoint what oil is evaporating with the water and ending up in the distillate tank. Once results are known, this will be communicated with MSD. pH values were all within permit limits and were taken from Vacudest' internal pH monitor inside the distillate tank. The pH neutralization system is proving to work effectively as we haven't seen pH underruns since implementation in November. Please let me know if you have any questions or concerns. Self -Monitoring Report Forms must be postmarked no later than the twentieth day of the month following the month in which the samples were taken. It is the industry's responsibility to maintain the records and report the Self -Monitoring Data in the proper format and in a timely manner. MSD staff did not receive the October 2019 Self -Monitoring Report on time and conducted a site visit in November. At the time it was noted that the EHS staff position was eliminated. Therefore, MSD staff conducted training and education on the permit and reporting requirements with Mr. Andy Smith. MSD did not issue an official NOV at the time, however issued a verbal notification along with the education. After the visit, the October 2019 and November 2019Self- Monitoring Data was received. The monitoring reports received did not have all data entered properly. MSD was made aware of the issues with entering the data for those months and made the corrections in the database without issuing an official NOV. MSD was told that the issues would not continue. The Self -Monitoring Report for December 2019, was due no later than January 20, 2020. The report has not been submitted as of February 3, 2020. MSD staff attempted to contact Prince Manufacturing by phone and by email. A voicemail was left and an email sent regarding the failure to report on January 28, 2020. In the January 28, 2020 email MSD staff also requested to complete the annual inspection. No response has been received regarding the Self -Monitoring Report or the request for an inspection. MSD is issuing this Notice of Violation for failure to report the December Data as well as failure to respond to notifications of the missing data and failure to respond to the request for an inspection. December's failure to report is the second time in a six-month period and is a Tier 2 Violation. The civil penalty for a Tier 2 failure to report violation is one hundred dollars ($100.00).
