Dear Mr. Gerspacher,
You have our approval, in-accordance with the attached conditions and those listed below, to impact approximately
0.02 acres of waters and their associated protected buffers to place rip-rap along approximately 100 feet of shoreline as
you described within your application received by the Division of Water Quality (DWQ) on July 13, 2001 with revisions
identified within your 10/25/01 faxed letter and design plan. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 3280. This Certification allows you to use Regional General
Permit No. 198200030 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your
approved Authorization 'Certificate to impact the Catawba River Buffers as per 15A NCAC 2B.0243(8). In addition, you
should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your
project including (but not limited to) Non-discharge and Water Supply Watershed regulations, and Sediment and Erosion
Control Permit. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in
the General Certification.
This approval is only valid for the purpose and design that you described in your application with revisions except as
modified below. If you change your project, you must notify us and you may be required to send us a new application. If
the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby
responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland,
compensatory wetland mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid,
you must follow the conditions listed in the DWQ General Certification No. 3280 and any additional conditions listed
below.
1. We understand that you have chosen to have the project constructed from a barge and that no access corridor will be
required for construction.. Therefore, a condition of this approval is that no-trees (having greater than or equal to a 6
inch stump diameter) shall be cut or otherwise removed from Zone 1 (30 feet from the Full Pond Elevation) except
trees with exposed roots to the eroding shoreline.
2. Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands
Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, M,' 27699-1650.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.' You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
