Re-channeling and installation of the culvert had occurred on property owned by you in Caldwell County, North Carolina prior to transference of the property to Mr. and Mrs. Kenneth Phillips. There is also a possibility that wetlands may have been impacted by the channel and culvert work. Both re-channeling and installation of a culvert require permits from the Army Corps of Engineers in addition to certification by this agency. Failure to obtain the Division of Water Quality's certification prior to construction of the described activities subjects the responsible party to the possibility of enforcement proceedings including assessment of civil penalties of up to $25,000 per day. The Army Corps of Engineers could also initiate separate enforcement proceedings for failure to obtain the necessary permits from their agency. Attached is a section from the North Carolina Administrative Code (15A NCAC 2H.0500) detailing the State of North Carolina's certification requirements. Also attached is a copy of the Pre-Construction Ms. Ivolee McCall May 25, 2001 Page Two Notification (PCN) Application Form which must be completed and submitted to both the Division of Water Quality and the Army Corps of Engineers for the stream and wetland activities conducted on your property. Certain portions of the instructions have been highlighted. Please provide a written response within ten (10) days following receipt of this letter. The response should clearly explain the reason for failure to secure a proper 401 Water Quality Certification for the channel modifications and culverting. Any other factors and relevant information should be included in the response. If application (on the enclosed PCN form) for a 401 Water Quality Certification is to be submitted, please specify the date on which this Division may expect the completed application. Avoidance, minimization and/or mitigation may be required for impacts to waters or wetlands. Your attention to this matter is appreciated. This office is considering forwarding recommendations for enforcement actions to the Division Director regarding the unauthorized channeling and culverting. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. The planting plan as described in the application shall be completed by December 31, 2001. 3. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 4011Wetlands Unit of the Division of Water Quality. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may 'be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 1.50 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Habitat Conservation Program DATE,: August 3, 2001 SU13 JECT: Review of an application by Ivolee Martin-McCall, Caldwell County The applicant is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit frorn the U.S. Army Corps of Engineers and a 401 Certification from the NC Division of Water Quality. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et, seq.) and. the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to culvert 20 linear feet of stream and relocate approximately 110 linear feet of stream. Mr. Jack Mason, District 8 Wildlife Biologist, visited the site on August 2, 2001. He determined that the project had been completed and stabilized. Based on his findings, we will not object to the project, as we do not believe that this project will cause significant impacts to waters supporting trout or other sport fisheries. We recommend that a disturbed area near the relocated channel be stabilized using native species or a mix of amiual rye and shade tolerant fescue. We concur with the addition of weeping willows (as proposed by the applicant) as they will provide beneficial stream shade and stabilization.
