D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant has designed the proposed project to avoid impacts to streams and wetlands to the extent practicable. The
applicant is constructing the majority of the greenway in existing easements that have already been timbered/cleared and
altered. Existing culverts have been used to the extent possible. Boardwalks are being used over two streams. The applicant
has further demonstrated avoidance and minimization of stream impacts by proposing to construct culvert head/end walls.
The applicant has designed the stream crossings in relatively straight portions of the stream.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and silt fence will be used. Temporary coffer dams will be installed upgradient of the
proposed culverts. During construction, water will be pumped around the construction footprints. Appropriate stream bank
protection will be; provided in the channel during construction and all excess excavated material will be immediately removed
from the stream bank crossing areas. The rip rap is being keyed in to further minimize the impacts to the streams. Upon
completion of the culvert installation, the temporary sand bag coffer dams will be removed and flow will be diverted through
the culvert. Following construction, disturbed banks will be restored to similar pre -construction conditions, matted and
seeded/live staked. Upon installation of the greenway, areas adjacent to the greenway will be restored to grade and seeded.

We consulted the USFWS Website to determine if federally protected endangered or threatened species inhabit
Alamance County, NC. The Cape Fear Shiner is listed as a federally protected endangered species. While this species is
identified in Alamance County, the FWS Environmental Conservation Online System shows that the the proposed project
is not located within the current range of the Cape Fear Shiner. Based on our observations, it is our opinion that the
proposed project will have no effect on federally listed species.

4. INSTALL FCM UP TO 54" RCP SUBGRADE AND INSTALL 54" RCP. INSTALL FCM UP TO SUBGRADE OF 42" RCP AND
INSTALL 42" RCP. INSTALL FCM ON EACH SIDE OF 42" RCP TO HOLD PIPE IN PLACE.
5. INSTALL UPSTREAM AND DOWNSTREAM HEADWALLS. COMPLETE BACKFILLING OF CULVERTS WITH FCM.
6. DURING ALL BACKFILLING OPERATIONS THE HEIGHT OF THE FCM ON EACH SIDE OF THE CULVERTS SHALL NOT EXCEED 12-INCHES IN
HEIGHT. FCM SHALL EXTEND UP TO THE SUBGRADE ELEVATION OF THE TRAIL.
7. UPON COMPLETION OF BACKFILLING FCM, PLACE FILTER FABRIC EXTENDED UP SIDE SLOPES OVER TOP OF CULVERT PIPES LAPPING A
MINIMUM OF 18-INCHES.
8. SEED AND MULCH ALL DISTURBED AREAS WITHIN BUFFER ZONE 2 (50-FT FROM TOP OF STREAM BANK, EACH SIDE) AND COVER WITH
EROSION CONTROL BLANKETS.

Subject Property: Mebane Greenway, Alamance County
Dear Mr. Brame:
On November 26, 2019, at your request, I conducted an on -site determination with yourself and Seren
Homer from Pilot Environmental to review features located on the subject project for stream
determinations with regards to the above noted state regulations. This letter is being issued to correct
errors in a letter previously issued on December 9, 2019 and incorrectly referenced Quarry Hills
Subdivision Project.
The Division acknowledges the areas and boundaries identified as jurisdictional wetlands by the LISACE.
The attached initialed and dated sketch accurately depicts the channels that were evaluated. Some
channels that were depicted on the Alamance County Published Soil Survey are shown as circled areas
on the attached map and were determined not to be present on the property.
At the time of this letter, all perennial stream channels and jurisdictional wetlands found on the
property are subject to the mitigation rules cited above. In addition, intermittent and perennial streams
SA, SB, SC, SD and SE are subject to the above referenced Jordan Lake Buffer Rules. Please note that
these regulations may be subject to change in the future.
The owner (or future owners) should notify the Division (and other relevant agencies) of this decision in
any future correspondences concerning this property. This on -site determination shall expire five (5)
years from the date of this letter.

Landowners or affected parties that dispute a determination made by the Division or Delegated Local
Authority that a surface water exists and that it is subject to the buffer rule may request a determination
by the Director. A request for a determination by the Director shall be referred to the Director in writing
c/o 401 & Buffer Permitting Branch, 1650 Mail Service Center, Raleigh, NC 27699-1650. Individuals that
dispute a determination by the Division or Delegated Local Authority that "exempts" surface water from
the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start
until the affected party (including downstream and adjacent landowners) is notified of this decision. The
Division recommends that the applicant conduct this notification in order to be certain that third party
appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to
Chapter 150E of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a
hearing within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity within
Waters of the United States or Waters of the State or their associated buffers. If you have any additional
