You have our approval, in accordance with the attached conditions (WQC #3274) and the conditions listed below,
to conduct the following on the ocean beach within Village limits, to include East, South and West beaches of Bald Head
Village, Brunswick County:
1. To construct a post-storm protective berm by beach bulldozing, in the event of a major hurricane/storm;
2. To potentially disturb up to 3, 810,000 square feet of unvegetated beach.
This approval is only valid for the purpose and design that is listed above and that you described in your CAMA
application dated August 27, 2001 which was received by the Division of Water Quality. After reviewing your application,
we have determined that this activity is covered by General Water Quality Certification Number 3274. This Certification
allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. Please keep in mind
that there may be additional Federal, State and Local regulations applicable to your project, such as (but not limited to)
Sediment and Erosion Control, Non-Discharge, Water Supply Watershed regulations and Coastal Stormwater. In addition,
this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purposes and designs that you described in your CAMA application dated August
27, 2001. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to
send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the
Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fill for this
project (now or in the future) exceed one acre; compensatory mitigation may be required as described in 15A NCAC 2H
.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional
conditions listed below:
1. Turbidity controls must be maintained while bulldozing, so that turbidity does not exceed 25 NTU's
outside the project area.
2. The sand bulldozed into the post-storm dunes will need to be cleared of debris to avoid future Water Quality issues.
3. Contact this Office by phone or FAX to notify DWO that You are preparing to bulldoze

GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE FOR CORPS OF ENGINEERS GENERAL
PERMIT NUMBER 198000291 (ISSUED TO THE NORTH CAROLINA DIVISION OF COASTAL
MANAGEMENT) AND NEUSE/TAR-PAVII.,ICO BUFFER RULES
This General Certification is issued in conformity with requirement of Section 401, Public Laws
92-500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality
Regulations in 15 NCAC 2H, Section .0500 and 15 NCAC 2B .0200 for the discharge of fill material as
described in General Permit 198000291 and for the Neuse and Tar-Pamlico Buffer Rules (15A NCAC 2B
.0233 and .0259). This Certification replaces Water Quality Certification Number 3025 issued on
September 6, 1995 and Water Quality Certification Number 3112 issued on February 11, 1997. This WQC
is rescinded when the Corps of Engineers reauthorizes Regional General Permit 0291 or when deemed
appropriate by the Director of DWQ.
The State of North Carolina certifies that the specified category of activity will not violate
applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if
conducted in accordance with conditions hereinafter set forth.
Conditions of Certification:
1. Activities authorized by CANIA major permits require written concurrence from the
Division of Water Quality as well as compliance with all conditions of this General
Certification;
2. Activities authorized by Coastal Area Management Act (LAMA) Minor or General Permits
do not require written authorization from the Division of Water Quality as long as they
comply with all other conditions of this General Certification;
3. In accordance with North Carolina General Statute Section 143-215.3D(e),
any request for written concurrence for a 401 Water Quality Certification
must include the appropriate fee. If a project also requires a CAMA Permit, one payment to
both agencies shall be submitted and will be the higher of the two fees. The fee shall be
collected and distributed between the two agencies in accordance with agreements reached
between the Division of Water Quality and the Division of Coastal Management;
Impacts to any stream length in the Neuse and Tar-Pamlico River Basins
requires written concurrence from DWQ in accordance with 15A NCAC 2B.0233 and 15A
NCAC 2B .0259. New development activities located in the protected 50-foot wide riparian
areas (whether jurisdictional wetlands or not) within the Neuse and Tar-Pamlico River Basins
shall be limited to "uses" identified within and constructed in accordance with 15A NCAC
2B .0233 and 15A NCAC 2B .0259. All new development shall be located, designed,
constructed, and maintained to have minimal disturbance to protect water quality to the
maximum extent practicable through the use of best management practices;
5. All sediment and erosion control measures placed in wetlands or waters shall
be removed and the natural grade restored after the Division of Land
Resources has released the project;
6. If an environmental document is required, this Certification is not valid until a
Finding of No Signfcant Impact (FONSI) or Record of Decision (ROD) is issued by
the State Clearinghouse. All water quality-related conditions of the FONSI or ROD
shall become conditions of this Certification:
7. That appropriate sediment and erosion control practices which equal or exceed those outlined
in the most recent version of the "North Carolina Sediment and Erosion Control Planning and
Design Manual" or the "North Carolina Surface Mining Manual" whichever is more
appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or
Central Offices) shall be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in
order to assure compliance with the appropriate turbidity water quality standard;
8. Measures shall be taken to prevent live or fresh concrete from coming into
contact with waters of the state until the concrete has hardened;
9. Additional site-specific conditions may be added to projects which have
applied for CAMA major permits which are proposed under this Certification
in order to ensure compliance with all applicable water quality and effluent
standards;
10. When written concurrence is required, the applicant is required to use the enclosed
Certification of Completion form to notify DWQ when all work included in the 401
Certification has been completed;
11. Concurrence from DWQ that this Certification applies to an individual project
shall expire three years from the date of the cover letter from DWQ or on the same
day as the expiration date of the corresponding General Permit 198000291,
whichever is sooner.
Non-compliance with or violation of the conditions herein set forth by a specific fill project shall
result in revocation of this Certification for the project and may result in criminal and/or civil penalties.
The Director of the North Carolina Division of Water Quality may require submission of a formal
application for individual certification for any project in this category of activity, if it is determined that the
project is likely to have a significant adverse effect upon water quality or degrade the waters so that
existing uses of the wetland or downstream waters are precluded.
Public hearings may be held for specific applications or group of applications prior to a
Certification decision if deemed in the public's best interest by the Director of the North Carolina Division
of Water Quality.

protective berm, by beach bulldozing, in the event of a major hurricane/storm.

9. PROJECT DESCRIPTION
Bald Head Island is a part of a larger island group known as Smith Island Complex which is located at
the confluence of the Cape Fear River and the Atlantic Ocean, between Carolina Beach/Fort Fisher and
Oak Island, in the Brunswick County, North Carolina. It is accessed by private ferry service from
Southport, NC. Bald Head Island is the southern-most, and largest of the Smith Island chain. It's eastern
and south facing beaches are adjacent to the Atlantic Ocean. The intersection of east and south beaches
create Cape Point, from which Frying Pan Shoals extend some 22 miles into the Atlantic. The island's
west beach is adjacent to the Cape Fear River Inlet and its northern side is bordered by Bald Head Creek
and associated salt marshes. Bald Head Island is approximately three and one-half miles long and one-half
to one-mile wide.. The island contains the largest remaining stand of climax maritime forest in southeastern
North Carolina, and features old live oaks and Cabbage Palmetto Palm trees (Smith Island Complex is
the northern limit of its range). The State of North Carolina has purchased approximately 175 acres of
maritime forest, which will be preserved and managed through the NC Coastal Reserve Program.
Development of Bald Head Island is approximately 40-50% built-out, and includes a marina, restaurants,
bed and breakfast inns, golf course/club house, and associated commercial, multi-family and single-family
residential development. The project site is located on the ocean front within the Village limits of Bald
Head Island. It includes East Beach, South Beach and West Beach. South Beach and the majority of West
Beach are included in the U.S. Army Corps of Engineer's Wilmington Harbor Project as an approved site
to receive beach compatible sediments resulting from the maintenance of the shipping channel in the Cape
Fear River and Inlet. The most recent beach renourishment on Bald Head Island was completed in the
spring of this year (2001).
The NC Division of Water Quality classifies the waters of the Cape Fear River in the project area, as SA,
and they are OPEN to the harvest of shellfish. The waters of the Atlantic Ocean are classified SB. These
waters are not designated as Primary Nursery Areas by the NC Division of Marine Fisheries. The project
area is located in the Ocean Hazard Area of Environmental Concern, as designated by the Coastal
Resources Commission. The designated Long-term Average Annual Shoreline Change Rates for this area
of Bald Head Island range from 11.5 feet/year to 2 feet/year.
The Village of Bald Head.Island is not proposing to initiate any work at this time. The Village is applying
for this permit to supplement their hurricane recovery plan, and provide the framework for a post-storm
response to dune/beach escarpments and storm over-wash. The Village of Bald Head Island is requesting
authorization to construct a post-storm protective berm, by beach bulldozing, in the event of a major
hurricane/storm. The project area would include the 25,400 linear feet of shoreline along East, South, and
West Beaches, but the actual length of affected shoreline, per event, would be determined during post-
storm inspections in consultation with staff from the NC Division of Coastal Management and federal
regulatory agencies. The applicant states that the project width would average approximately 150 feet.
The applicant has submitted two cross-sectional drawings for berm construction, which are typical beach
profiles following a major storm. The first scenario would be the re-construction of the waterward face
of an eroded dune. Bulldozing would be completed on the oceanward side of the dune to the vertical
erosion escarpment. The second scenario illustrates the construction of a berm in a storm wash-over area
of shoreline. The applicant proposes to construct this type of emergency berm from both the beach and
from sand deposited by the storm over-wash. In either case, work on the beach would be limited to a

depth of 12 inches below grade, and the resulting berm would be limited to a maximum width of 30 feet
at the base and 15 feet in height. The Village maintains an active dune vegetation and sand fencing
program which would be implemented after each storm event to assist in the stabilization of the
constructed berm.

According to the applicant's calculations, the proposed project could potentially disturb up to 3,810,000
square feet of unvegetated beach The project would provide some degree of protection for Village
infrastructure and property owners located landward of the project area, following a major storm.

DCM-MP-2 - SUPPLEMENTAL INFORMATION
ITEM:
1. EXCAVATION - The proposed activity consists of beach scraping and berm (dune)
reconstruction subsequent to a major_storm event. Material eroded from the existing berm (dune)
is expected to be transported seaward to the lower beach face or upland as overwash. The proposed
plan of action calls for the remov? of such sand deposits and the reuse of the material for purposes
of protective storm berm reconstruction. The permit application requests authorization for post-
storm berm reconstruction along 25,400 ft of shoreline. The actual length of shoreline affected will
be determined after the storm event. Depth of excavation from the lower beach face will average
1 ft =E. Overwash excavation will be dependent upon the depth of the sand deposit.
2. DISPOSAL OF EXCAVATED MATERIAL - The material excavated will be placed in the form
of a reconstructed berm (dune) at the pre-storm location and alignment of the original dune feature.
The proposed berm dimensions of 3 0 ft width and 15 ft height are maximum. The final dimensions
will depend upon sand availability and the post-storm configuration of the affected shoreline.
5. GENERAL - All work will be performed utilizing conventional mechanical construction
equipment. The Village maintains an active dune vegetation and sand fencing program which will
be implemented to assist in dune/berm stabilization.
OTHER - The Village's existing Beach Management Program includes a beach monitoring program
based upon an established survey baseline which extends along both West Beach and South Beach.
That baseline will be utilized in the appropriate relocation of any future reconstructed berm or dune
at those locations.
