This approval allows you to: 1) Construct a 68' X 30' boat ramp and extend 37' below normal high water; 2) Construct 2 boat ramp piers, a platform and two fishing/observation piers; This approval is only valid for the purpose and design that you described in your CAMA application dated August 9, 2001 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3301 covers this activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your CAMA application dated August 9, 2001. If you change or modify your project, you must notify the Division (DWQ) in writing and you maybe required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below. 1). Turbidity controls must be maintained throughout construction, so that turbidity does not exceed 25 NTUs outside the project area (i.e. Turbidity curtains). 2). This Water Quality Certification (WQC) is rescinded when the Corps of Engineers re-authorizes Regional General Permit 0291 or when deemed appropriate by the Director of the Division of Water Quality (DWQ). The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with conditions hereinafter set forth. Conditions of Certification: Activities covered by this General Certification do not require written concurrence from the Division of Water Quality as long as they comply with all conditions of this General Certification, the CAMA Permit and General Permit 198000291. If any condition in this Certification cannot be met, then the applicant is required to submit an application and receive written concurrence from DWQ prior to beginning work; 2. The following activities do not require written concurrence and do not require payment of the 401 Water Quality Certification fee - • Boat Ramps and associated access (i.e., roads and parking lots) that involve the excavation or filling of less than 500 square feet of wetland and open water area, with the exception that the excavation or filling of coastal wetlands may not exceed 100 square feet and except when associated with new marinas, subdivisions and commercial development); • Shoreline protection measures that tie into existing bulkheads, land or other shoreline protection measures or do not extend waterward of the water line more than 10 feet, provided that the activity will not involve the excavation or filling of any SAV or shellfish resources and impacts less than 500 square feet of vegetated wetlands or less than 100 square feet of coastal wetlands; • Piers and docks designed to accommodate fewer than 10 vessels and the water depth is greater than three feet; • Maintenance dredging of less than 0.5 acres of water or non-vegetated wetlands provided that the applicant can provide written documentation showing the historic dimensions of the dredged channel, and no Submerged Aquatic Vegetation or shellfish beds are excavated or filled; • Projects that only involve shading of waters or wetlands; • Utility lines, except wastewater lines and potable water discharge lines which are subject to an NPDES Permit, as long as wetland or water impacts are temporary; • Upland development which involves no more than 1/10 of an acre of excavation or filling of non-coastal wetlands, with the exception that no more than 2,000 square feet of the non-coastal excavation or filling may take place within an Area of Environmental Concern. For the purposes of this area calculation, the excavation or filling impacts of boat ramps, bulkheads or other shoreline stabilization measures must be considered. The applicant must comply with all applicable coastal stormwater rules; • Single family home construction that results in fill of 404 wetlands as long as written concurrence is not required from DWQ for the applicable Corps of Engineers Nationwide Permit. 3. Activities authorized by Coastal Area Management Act (CAMA) General permits do not require written concurrence from the Division of Water Quality as long as they comply with all other conditions of this General Certification; 4. In accordance with North Carolina General Statute Section 143-215.31)(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies by the Division of Coastal Management; This certification does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. Specifically, the permitee shall contact the North Carolina Division of Water Quality to determine consistency with the Neuse or Tar-Pamlico Buffer Rules (15A NCAC 213 .0233 and 15A NCAC 213 .0259). New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse and Tar-Pamlico River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0233 and 15A NCAC 2B .0259. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. Activities listed as "exempt" from these rules do not need to apply for written concurrence under this Certification; Appropriate sediment and erosion control practices that equal or exceed those outlined in the most recent edition of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DENR Regional or Central Offices) shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTU's in freshwater streams and rivers, 25 NTU's in all saltwater classes, and all lakes and reservoirs); 7. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural Grade restored after the Division of Land Resources has released the project; 8. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse; 9. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 10. This General Certification is not applicable to a project where the Director of the Division of Water Quality or the Director of the Division of Coastal Management have determined, based on an initial review of the application, that written concurrence is needed because of concerns related to water quality or aquatic life. 11. Additional site-specific conditions may be added to projects which have applied for CAMA major permits which are proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 12. If written concurrence is required for this activity, DWQ shall be sent a written notification within 30 days of completion of the wetland or stream impact or upon expiration of the 404 Permit or 401 Certification. Such notification shall be sent to the Central Office of the Division of Water Quality on the form provided with the Certification, shall be accompanied by a map depicting the work completed, and shall be signed by the land owner or other responsible party. Non-compliance with or violation of the conditions herein set forth by a specific fill project shall result in revocation of this Certification for the project and may result in criminal and/or civil penalties. The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications- or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. This facility would include: a boat ramp, piers, docks, parking areas and restroom facilities. Town of Surf City / Soundview Park Page Two 9. PROJECT DESCRIPTION The applicant's project site is located on Highway 50/210, southwest of and adjacent to the Miramar Mobile Home Park. The property is located just east of the NC DOT Swing Bridge, on the southwest side of the Highway 50/210 Causeway, within the Town of Surf City, in Pender County. The property is located adjacent to Topsail Sound and the Atlantic Intracoastal Waterway (AIWW). To find the property, cross the 50/210 swing bridge across the AIWW into Surf City. Past the bridge approach guardrail, take the first gravel road to the right. The property is the former site of the Arlene Yow Mobile Home Park, which consisted of seven mobile homes, an access drive and turn-around area. The property encompasses approximately 5.8 acres of land above normal high water, 2.75 acres of which is highground. The site is bordered on the north by the AIWW, on the east by a man-made basin and on the south and west by tributaries of Topsail Sound. On May 14, 2001, Arlene Yow deeded the property to the Town of Surf City. The seven mobile homes were moved off the property earlier this year. This mobile home park was never served by municipal sewer and the septic tanks which served the mobile homes are being filled with sand as they are located by the Town of Surf City. The Master Plan for the proposed "Soundview Park" also includes the acquisition and development of the adjacent Miramar Mobile Home Park, however, the current application is only for that portion of the proposed park located on the former Yow tract. Existing development on the property includes: an existing gravel drive with turn-around and five small individual piers. Also located at the southern side of the property is an area of pilings which are all that remains of a structure that appeared to be approximately 24' wide by 215' long. The former structure is not visible on aerial photography as far back as 1978. The pilings are probably remnants of development on Topsail Island by the U.S. Military during Operation Bumblebee. The property is very flat with average elevations of approximately 4' relative to NGVD 1927. The property forms a rough semi-circle around a man-made basin which is directly connected to the AIWW by a channel with an average depth of approximately -4' NGVD. The majority of the highground property is located along the southwest side of the basin and consists mainly of existing gravel roads and areas which were cleared for mobile home sites. Highground vegetation includes: Live Oaks (Quercus virginiana), Southern Wax Myrtle (Myrica cerifera), Yaupon Holly (Ilex vomitoria), Poison Ivey (Rhus radicans), Red Cedar (Juniperus virginiana) and various lawn grasses. Another isolated highground hummock measuring approximately 20' wide by approximately 120' long lies just south of the remnant stand of pilings at the southern most corner of the property. The remainder of the property contains coastal and mixed coastal/404 wetlands that have delineated by this Division and the U.S. Army Corps of Engineers. These areas vary greatly in species composition, but generally consist of Smooth Cordgrass Marsh (Spartina altemiflora) along the water edges,. transitioning into mixed Cordgrass, Glasswort (Salicomia spp.), and Sea Lavender (Limonium spp.) in the low, flat, higher intertidal areas primarily, along the northwestern side of the property, and into primarily Black Needlerush (Juncus roemerianus),' and Salt Meadow Grass (Spartina patens) along most of the remaining shoreline. Typical mixed coastal/404 wetland areas at the site are vegetated with Sea Ox-eye (Borrichia frutescens), Marsh Elder (Iva frutescens), Groundsel Bush (Baccharis halimifolia), Southern Wax Myrtle, Common Reed (Phragmites australis), and Salt Meadow Grass. One large stand of Common Reed is located at the remnant stand of pilings. The waters adjacent to the project are classified "SA" by the Division of Water Quality. The area is designated a Primary Nursery Area by the Division of Marine Fisheries. The waters of the man-made basin are closed to the taking of shellfish while the remaining waters of Topsail Sound and the AIWW bordering the property are open to shellfishing. Town of Surf City / Soundview Park Page Three The Town of Surf City is proposing the development of the property into a water access park to be known as "Soundview Park". The proposed park will be accessed via the existing gravel drive from NC Highway 50/210 through the Black property (Miramar Mobile Home Park). The Town of Surf City currently has a contract with Blacks to purchase this property as well. Development of the entire park facility will be conducted in two phases. Phase I will include the development of the Yow Property and is the subject of the current permit application request. Phase 11 will include the development of the Black Property, once acquisition of the property is complete. The Division of Coastal Management has provided CAMA Waterfront Access Grant money for park acquisition for Phase I of the project. In addition, Pender County has committed $150,000 in park acquisition funds from a HUD hazard mitigation grant. The Town has a cooperative agreement with the North Carolina Wildlife Resources Commission for the construction of a proposed boat ramp and associated parking facilities. Site development plans would include: the maintenance of the existing gravel drive and turn-around; the addition of both single vehicle and vehicle/boat trailer parking; restroom facilities; landscaping; the construction of a boat ramp and associated dock by the North Carolina Wildlife Resources Commission; the construction of a proposed covered deck and boat dock; and the construction of two fishing piers with associated boardwalks. The existing gravel drive and cul-de-sac turn-around area would be maintained by grading and placement of additional gravel where needed. This drive curves around the man-made basin, terminating along the northern side of the property. Approximately 0.99 acres of land adjacent to the existing access road would be cleared and graded for the construction of gravel parking areas, landscaping and restroom facilities. Water and sewer service for the facility would be provided by the Town of Surf City municipal systems. The proposed boat ramp would be constructed into the waters of the man-made basin from the existing gravel turn-around area. The ramp would measure 68' long by 30' wide and would extend to approximately 37' below normal high water. The proposed ramp would cross an approximately 5' wide border of Spartina alterniora marsh along the shoreline of the basin. As stated earlier, the ramp would be constructed by the North Carolina Wildlife Resources Commission through a cooperative agreement with the Town. The ramp would be constructed using standard design criteria for North Carolina Wildlife Resources Commission concrete launch ramps. This typically involves casting a 6" thick, reinforced concrete slab above high water, after curing, pushing the slab into place with heavy equipment, leaving approximately.2 to 3 feet of the slab extending above the high water line. The remainder of the ramp is then cast in place. The boat ramp would also have associated with it two piers measuring approximately 4' wide by 44' long. These piers would be located one on each side of the ramp to aide in the launching and temporary tie-up of boats. Water depths at the end of the ramp would average approximately -4' at mean low water. Along the southern side of the man-made basin, the applicant is proposing to construct a 70' wide by 60' long elevated wooden platform deck into the basin. This platform would include a covered area in the center of the structure measuring approximately 43' by 26'. This structure would be used for temporary dockage and as a staging area for canoes and kayaks. The three existing piers located in the area of the proposed platform would be removed. Two existing 6' wide by 30' long piers located near the proposed boat ramp would remain in place and would be used for fishing and temporary boat dockage. Town of Surf City / Soundview Park Page Four The applicant is also proposing the construction of two observation/fishing piers. One pier would extend from the north end of the gravel turn-around area into. the waters of Topsail Sound adjacent to the AIWW channel. This structure would consist of a 6' wide elevated wooden walkway extending approximately 123' through coastal marsh, then continuing an additional 71' into the open water area of Topsail Sound. At the waterward end of the walkway the applicant is proposing a 20' wide by 150' long platform. Water depths at the end of the structure would range between 0.0' and -2.0' at mean low water. Extending off the main walkway, just waterward of the outer edge of marsh, the applicant is proposing an additional 6' wide wooden walkway which would extend to the south and west of the main structure approximately 475', following the outer edge of marsh to the property line. The second observation/fishing pier would start from the proposed gravel parking area at the southern side of the property. This structure would also consist of a 6' wide elevated wooden walkway which would extend through mixed coastal/404 wetlands for approximately 90', passing through the old stand of remnant pilings to the highground hummock near the souther property boundary. The structure would extend across the highground area, then continue across another 120' of coastal marsh into a small tidal embayment off the AIWW. The walkway would extend approximately 95' past the outer edge of marsh into the open water of the embayment. At the waterward end of this structure, the applicant is proposing a 10' wide by 190' long platform. Water depths at the end of the platform would range from approximately -1.0' to -2.5' at mean low water. 10. ANTICIPATED EAPACTS The maintenance of the existing gravel drive and turn-around and the construction of the proposed parking areas would result in the grading and disturbing of approximately 0.99 acres of highground. All non water dependant development, with the exception a portion of the existing gravel entrance road and turn-around, would be located outside the Coastal Shoreline AEC 30' buffer area. The applicant states that the total impervious coverage of the property would be 1.08 acres, or 18 % of the property above normal high water. Within the 75' Estuarine Shoreline AEC, impervious coverage would be 4.4 %. The applicant has submitted an application for a State Stormwater Permit to the Division of Water Quality. The project is currently under review by that Division and has been assigned the project number SW8010647. The proposed boat ramp would result in the filling of approximately 150 sq. ft. of Spartina altemiflora marsh and approximately 1,110 sq. ft. of shallow bottom habitat within the man-made basin. The two piers associated with the boat ramp would incorporate approximately 352 sq. ft. of public trust area within the basin. The proposed 60' by 70' platform in the southern most part of the basin would incorporate an additional. 4,200 sq. ft. of public trust area within the basin. __ The .. .proposed _ walkways and observation/fishing pier at the northern part of the property would result in shading impacts to -'approximately 738 sq. ft. of coastal marsh, and would incorporate approximately 6,276 sq. ft. of public trust area adjacent to the AIWW. The structure would terminate approximately 267' from the near bottom edge of the federally maintained channel. The proposed walkway and observation/fishing pier at the southern side of the property would result in shading impacts to approximately 1,260 of mixed coastal/404 wetlands, and would incorporate approximately 2,470 sq. ft. of public trust area within the small tidal embayment. Inspection of aerial photography indicates that a structure in this location extending approximately 95' past the outer edge of marsh would exceed the use standard for pier length by extending more than 1/4 the width of the water body. Short term increases in turbidity can be expected during piling placement for all of the above mentioned structures. The portions of the walkway structures constructed over coastal wetlands would be required to be elevated at least 3' above marsh substrate, thus minimizing shading impacts. Submitted by: Jim Gregson Date: August 9, 2001 Office: Wilmington NARRATIVE FOR SOUNDVIEW PARK Soundview Park consists of 13.011 acres of land adjacent to the Atlantic Intracoastal Waterway, Topsail Sound and North Carolina highway 50/210 and located within the Town of Surf City, Topsail Township, Pender County, North Carolina. This property was originally a mobile home park consisting of seven mobile homes with existing gravel drives or roadways for access. Each of the mobile homes had additional concrete slabs or decking. The tract was accessed by an existing gravel road within a 30' ingress, egress, regress, drainage and utility easement. On May 14, 2001, Arlene R.Yow deeded this tract to the Town of Surf City as recorded in Deed Book 1708, Page 33 of the Pender County Registry. This conveyance was made under certain restrictions as indicated on the enclosed deed copy. The proposed uses of this CAMA application lie within those restrictions. The proposed plan for the park will utilize the existing gravel access and/or roadway and turnaround. Additional drives and individual parking and vehicle/boat parking has been designed. There will be a minimum amount of clearing required to construct the parking areas. Any root mat will be removed and gravel will be placed directly upon the cleared areas. Fill material for construction of the parking areas is not expected. It is the intent of the project, to maintain the slope of the existing topography. A boat ramp has been designed at the ideal location to reduce the impact of wetland damage, while utilizing the water's depth of the existing basin. The North Carolina Wildlife Resource Commission will construct the boat ramp as shown on the plan. The excavation for this boat ramp is minimum. Any excavation material will used on site at three designated landscape locations. Construction of the boat ramp, gravel drive and gravel parking areas will be by front end loader, back hoe and grader. A 60' x 70' deck, 43' x 26' portion covered and open, is proposed at the terminus of the basin. This covered deck is located over the most shallow portion of the basin. A 6' walkway to the north of the turnaround, with a 20' x 150' fishing pier and also a 6' walkway to the west is proposed. A 6' walkway to the south with a 10' x 90' observation and fishing pier is proposed. All walkways, piers and docks will be elevated 3 feet above the normal high water. 7L 2001 ! li 8 or Z© Construction of the walkways, piers and docks will be by the conventional methods, utilizing barge and small watercraft for access to the construction area. There will be no damage of wetlands during this construction. The normal high water line, the coastal wetlands and the 404 wetlands have been delineated by both CAMA and the United States Army Corps of Engineers. All construction of impervious surfaces will be within the uplands and outside of the 30' CAMA Buffer with the exception of the proposed boat ramp. This boat ramp has been located to minimize the impact on wetlands. The original impervious surface consisted of the seven mobile homes and existing drives. These mobile homes did rest within the 30' CAMA Buffer. The removal of these homes place the project in compliance with current CAMA regulations. The classification of the waters surrounding the project are SA. The project is restricted by the 30' CAMA Buffer and the 75'A.E.C.. This tract consists of 5.864 acres of land above the CAMA normal high water line. Total existing and proposed impervious surface coverage is 1.08 acres or 18 %.The additional drive and parking will increase the impervious surface on the tract, however, landscaped stormwater areas have been designed at the downslope of the proposed parking areas to insure collection of any stormwater. The natural vegetation surrounding all development will be undisturbed and will remain natural. The existing gravel roadways and gravel turnaround will be maintained. The additional drive and parking create a total land disturbance of 0.987 acres. This project will insure the control of erosion by installation of silt fence along and adjacent to the wetlands to the north and south of the proposed parking area. Proper seeding and maintenance will continue upon completion of construction of the parking area. The zoning of the tract is Government -1 and allows for municipal parks. The existing channel has depths ranging from 3 feet to 5.5 feet below the normal high water line,. extending to the channel of the Atlantic Intracoastal Waterway. This depth will be sufficient to handle all boating at this facility -and no dredging of the channel is requested. Restroom facilities are proposed, as shown. The water and sewer for this facility will be provided by the Town of Surf City. Introduction The Soundview Park project consists of the acquisition and development of two parcels of waterfront property in the heart of Surf City - the former Yow mobile home park property (12 acres, 2.75 acres of uplands) and the Miramar Mobile Home Park property (7.6 acres, 3.23 acres of uplands). The two properties form a peninsula along and into Topsail Sound, adjacent to NC 50/210 in a location immediately south of the Surf City swing bridge. B. Site Analysis Location and Access. The site is located on NC 50/210 (Roland Avenue) in the "front door" to Surf City and Topsail Island. 2. General Description. The Yow property contains seven mobile homes that are scheduled to be removed from the site before purchase of the property is closed. The Miramar (Black) property contains 25 mobile homes, primarily in seasonal use. The site has excellent shoreline access along a man-made cover and includes compacted gravel driveway areas and over a dozen small water-dependent structures (docks, decks, piers). 3. Zoning and Land Uses. The Yow property is scheduled to be rezoned from C-1 Commercial to G-1 Governmental use. The Black property remains zoned C-1 Commercial. The Town post office is located immediately adjacent to the Black property, and a number of businesses and restaurants are located within a three block radius of the park site. 4. Topography and Flooding. The site is relatively flat and has no major topographic features. The site is located in an AE-11 flood zone, indicating that it is susceptible to flooding from rising tidal waters in major storm events. - 5. Vegetation. Both portions of the site contain several attractive live oak trees, but most of the remaining vegetation (wax myrtle, cedar, bamboo, and other brushy species is located on the Yow tract - principally on the south side. Wetlands plants - marsh grass and other species - cover a substantial portion of the Yow tract that is not suitable for development, and marsh grass grows along most of the shoreline of both tracts. 7M 7m .iErE.U 6 Cf 'Zo 6. Wetlands. Both tracts contain Corps of Engineers and CAMA-identified wetlands, with the majority located on the Yow tract. The Town's interest in acquisition of these sites includes the protection of these environmentally sensitive lands. 7. Wildlife. The water portions of the two sites are inhabited by a variety of marine life, including crabs, clams, oysters, shrimp, drum, trout, croaker, flounder, and otter. An occasional alligator has been seen in these waters. Raccoons sometimes forage along the shorelines, and a variety of coastal wading and fishing birds - such as herons, egrets, and ospreys - are seen in and near the site. 8. Public Access. Public access to the site is excellent. The property is located on NC 50/210 at the swing bridge entrance to Topsail Island. The site is very visible and easy to locate. The site is also located on NC Bicycle Route #3 and will be linked to the rest of Surf City by a system of bicycle and pedestrian paths to be constructed with Transportation Enhancement Programs and Town funds. 9. Water, Sewer, Electricity. Municipal water and sewer facilities have been extended to the Black tract by the Town, but sewer services have not been extended to the Yow property. The properties are served by Jones-Onslow Electric Membership Corporation, which has overhead facilities on the Black tract and underground services on the Yow tract. 10. Stormwater. Like most of Topsail Island, stormwater management is a difficult issue due to the proximity of sensitive coastal waters. Conversion of this property to park use is likely to reduce the runoff from impervious services. The Town may find it necessary to install sock tile facilities along any roadways and parking areas in the the park. C. Recreational Needs The acquisition of the 7.6 acre (3.23 acres of uplands) Black property and the 12-acre (2.75 acres of uplands) Yow tract is urgently needed to fulfill the recreation needs of Surf City residents and visitors for the following reasons. 1. Absence of Park Facilities. Surf City currently has only one small mini-park facility to serve its citizens - and a seasonal population that exceeds 20,000 in peak tourism periods. The only other public park nearby is located about 10 miles away in Sneads Ferry (inland) and consists largely of athletic fields. .2. Strong Waterfront Facility Demand. There is no publicly-owned access to Topsail Sound - for boating, fishing, or other recreational activities - along the entire shoreline of Pender County. Demand is especially high for a public boat launching facility. Public expressions of the need for this facility - identified in public meetings, focus groups, and citizen surveys - are documented in the Pender County Waterfront Access Plan (1993), the Pender County Recreation and Open Space Plan (1998), and the Surf City Master Recreation Plan (1999). 3. Critical Resource Conservation. Acquisition of this property for the planned Soundview Park will (a) insure that the park has adequate acreage to meet the strong demand for these facilities, (b) convert a very insubstantial use of the land (mobile home park) to a high use public park site, and (c) insure that a unique natural site - located in the heart of Surf City with access to deep water - is preserved and converted to public use. The site's location at the entrance of Surf City and Topsail Island will greet residents and visitors with a beautiful park facility and will provide park users with the island's best views of Topsail Sound, Intracoastal Waterway boat traffic, the island's swing bridge, and stunning sunsets. D. Physical Needs L Property Acquisition A total of 5-6 acres of uplands are needed to provide adequate facilities for boating access and associated parking areas, as well as planned fishing, picnicking, performance, trail, and educational facilities. That area is available if the Town acquires both the Yow and Black properties. 2. Capital Improvements. In order to provide opportunities for multiple recreational uses on the site, the Town will need to construct at least one boat ramp, fishing piers, large and small picnic shelters, an outdoor performance area, a shoreline trail, a playground, and associated support facilities, such as parking and restrooms. Other facilities which should be considered for the site include historical and natural resource educational markers, additional osprey nesting sites, and an interior tidal pool for observation and education. The existing overhead utilities need to be placed underground, septic tanks on the Yow tract need to be filled or removed. 3. Acquisition and Improvement Estimates. The Town has already contracted to buy the Yow property for $400,000 and has set aside $135,000 more for development of that site (Phase I). Surf City estimates that the acquisition of the Black property will cost at least $750,000 and may cost as high as its tax _ assessment ($1.1 million). Park Management Requirements 1. Maintenance and Operation a. Maintenance Activities. The Town has identified the following maintenance activities as necessary in Soundview Park: mowing of grassed areas (approximately 1.5 acres) during growing season, daily litter pickup, daily waste removal, inspection and repair of structures (docks, piers, boat launching ramp, restrooms, play structures, boardwalks), cleaning of restrooms, periodic repair of driveways and parking areas, fertilization and trimming of landscaping. b. Hours of Operation. The Town intends to open the park from dawn to dusk, seven days a week, except for the boat launch and parking facilities, which will be open 24 hours a day. c. Operational Expenses. The Town estimates that personnel hours necessary to perform routine maintenance tasks for the Phase I portion of the park will be 15 hours per week. The Town estimates that the personnel hours necessary to perform routine maintenance tasks in both Phases I and II will be 25 hours per week. In addition, the Town anticipates contract maintenance costs for such purposes as pier maintenance, roadway maintenance, and structural maintenance (plumbing, electrical, and similar trades). The boat ramp will be maintained under an intergovernmental agreement with the North Carolina Wildlife Resources Commission. 2. Programming Programming expenses at Soundview Park are anticipated to be minimal, since most organized events at the park will be carried out by other community groups (e.g. Topsail Kiwanis Club for Spring Fling, Eastern Surfing Association, fishing tournament organizers, Top Dawg Productions drama group). The facilities are designed for passive use. 3. Administration and Personnel Overall supervision, of the facility will be carried out by the town manager's office. Routine maintenance of the facility will be carried out by the Town's Streets and Parks Department, a maintenance department. Additional personnel resources will be necessary in this department in order to adequately maintain Soundview Park. Z' -??3 2011 JI 18 o f? 0o G. Plan Implementation; Recommendations 1. Phase I (Yow Property). The Town has successfully negotiated a contract for purchase of this property at a cost of $400,000, with closing scheduled for January, 2001. The Town has also successfully sought partnership funding and assistance from three other agencies. The Division of Coastal Management has provided a $115,000 grant for park acquisition, Pender County has committed $150,000 in-park acquisition funds from a HUD hazard mitigation grant, and NC Wildlife Resources has agreed to construct the boat ramp and associated parking facilities. The Town has established a capital project budget of $535,000 for acquisition and development of the property. Survey documents for a major CAMA permit are being prepared in close consultation with the Division of Coastal Management. Once that permit is issued, the Town and Wildlife Resources plan to work toward opening the boat launching facility by the summer of 2001. The Town plans to complete the other facilities shown on the site plan during the 2001-2002 and 2002-2003 fiscal years. 2. Phase H (Black Property). The Town has opened preliminary negotiations with the owner of the Miramar Mobile Home Park and has commissioned appraisals of the property, as well as initiated public participation processes to obtain public input on the proposed acquisition and design of Phase H of Soundview Park. The Town anticipates that acquisition and development of the Black property in Phase II will cost $1.2 million. The Black family has indicated a willingness to owner- finance the purchase, which may make the purchase more feasible for the Town. Surf City plans to pursue a $250,000 PARTF grant to assist in acquisition of the property, as well as CAMA Waterfront Access and PARTF grants to assist in development of the property.
