DEA Properties Field Report Page 2 PROJECT SETTING The project site, known as Jennette's Pier, is located on the east side of Virginia Dare Trail, immediately south of the intersection of Virginia Dare Trail and Old Oregon, in Nags Head, Dare County. The physical address of the site is 7223 S. Virginia Dare Trail. Jennette's is bounded on the north side by a small grocery called R. V. Cahoon's, to the south by a public beach access owned by the Town of Nags Head, and to the west (across Virginia Dare Trail) by Sam & Omie's Restaurant. The property consists of approximately five acres of land and is commercially developed with, two drainfield systems, 11 rental cottages, Jennette's Fishing Pier and pier house, a wooden access ramp, associated parking and utilities. Existing impervious coverage on the site is 65,413 square feet, of which 52,559 square feet is covered by a concrete parking lot. A relatively stable protective frontal dune system is situated along the east side of the property, but has experience periodic over wash during strong storm events. Vegetation on the property is primarily composed of mix dune grasses. Previous permits issued to the applicant for development within the project area include the following: 1) CAMA Minor Permit #00-104, issued to move and demolish cottages on the site. No work has been undertaken to date in conjunction with this permit. 2.) CAMA Major Permit #97-98, issued to construct a 133' addition to the fishing pier. The Division of Environmental Management's water quality classification for the waters of the Atlantic Ocean, contiguous to that portion of the Pasquotank River Basin that extend from the North Carolina-Virginia State Line to the northeast tip of Ocracoke Island, is SC (fish propagation). Review of available information suggests that there are no known archeological sites or unique geological formations associated with the applicant's property. PROJECT DESCRIPTION The applicant proposes to remove all structures, above and below ground on the property, including the removal of the 674' fishing pier and the pier house. While removal of the pier is being proposed, the owners are investigating alternatives that could save the pier from demolition. The total area of land disturbance anticipated with the clearing of the property is approximately 104,507 square feet (2.4 acres), while disturbance associated with the removal of the pier pilings will be approximately 25,090 square feet (.58 acres). According to the project narrative, removal of the pilings will be undertaken from a barge launched from the beach in the vicinity of the existing access ramp where the dune is low and gently slopes. Mats will be placed over the dune, down onto the beach, to reduce damage to the exiting frontal dune system. East Coast Abatement, the contractor removing the structures, has proposed two methods for removing the pier's piling system. The first method involves breaking the DEA Properties Field Report Page 3 pilings at the surface of the water bottom (substrate). This method would require the least amount of disturbance to the adjacent substrate, and is also considered the most desirable method for its time efficiency factor. The second method would include vibrating the pilings out. This method would remove the whole structure, but would result in water bottom disturbance and would require more time to complete. Once the pier and pier house have been removed the dune will be reconstructed with clean fill from an outside source and graded. The site will be re-vegetated with American Beach Grass. ANTICIPATED IMPACTS • Approximately 104,507 square feet (2.4 acres) of high ground disturbance is anticipated within the Ocean Hazard AEC, from land clearing activities. • Approximately 25,090 square feet (.58 acres) of water bottom may be disturbed in conjunction with the proposed pier removal, depending on the method used. • Out of the anticipated 104,507 square feet of land disturbance, approximately 2,000 square feet of dune disturbance will occur, requiring restoration. • Excavation of existing infrastructure will result in the removal of two ground water absorption systems for a restaurant, pier and eleven cottages. • Removal of the pier will result in the removal of approximately 24,000 square feet of shading. • Temporary turbidity will occur during the removal of the pier's piling system. • The clearing for the property will result in the development of an ocean front residential subdivision. Mathis Date: August 20, 2001 PROTECT NARRATIVE (07-24-01) Subject Property: !R AUK i' The subject property consists of 4.97 acres of land spanning from NC 12 (South Virginia Dare Trail and Old Oregon Inlet Road) to the Atlantic Ocean. The property is bounded to the east by the Atlantic Ocean, to the north by a privately owned parcel containing a small grocery store and rental cabins, to the west by NC 12, and to the south by oceanfront lots by the same owner. The subject property is located in the Town of Nags Head and is zoned CR (commercial / residential). Existing Conditions: The subject property is currently developed, containing a commercial fishing pier, restaurant, bait shop, and 11 rental cottages. The existing fishing pier (known as "Jennette's Pier") partially extends over the open ocean water with a pier building at the shoreward end that acts as a restaurant and bait shop. There is a wood ramp beginning at the first vegetative line that leads to the pier and serves as the pier/restaurant entrance walkway. Access to the pier is provided by an entrance off of Virginia Dare Trail that opens into a concrete drive/parking area. Accessible through the same entrance is a driveway leading to a row of vacation cottages lining both sides of the drive. Immediately north of the concrete drive/parking area are two existing wastewater drainfields which serve the fishing pier and restaurant. Total existing impervious coverage on the site is 65,413 Square Feet (SF), with concrete drive/parking covering 52,559 SF and cottages covering 12,854 SF. This oceanfront property is lined with a sand dune ridge that acts as a protective wall against the powerful storm systems that frequent the Outer Banks. During exceptionally strong storms such as northeasters in the winter and spring months, dune ridges such as these are periodically overwashed or blown out by irregularly high ocean tides, waves and wind. During normal conditions these dunes are not inundated by ocean tides and some vegetative cover is allowed to grow. Root systems of dune grasses help stabilize the dune ridge, but winds promote slow shifting. Shoreward of the FLSV lie beach sands of the upper continental shelf that line most of the Atlantic coastline. Beach sands of the Outer Banks are generally a thin, variable accumulation of sand that lie unconformably on top of a pre-existing geologic framework. Modern sands of this area lie on top of older sequences of sands, peat and' limestone. While the blanket of beach sands seasonally and annually erode and accumulate, the underlying framework remains relatively stable. Proposed Conditions Work pertaining to issuance of this Major CAMA application includes removal of any ground infrastructure within the 145' Area of Environmental Concern (AEC). As depicted on the Site Plan, an approximate oceanward limit of disturbance has been set. Also shown is the First Line of Stable Vegetation (FLSV) and the 145' Area of Environmental Concern (.AEC). Though this Major CAMA Application proposes removal of the existing pier, owners of the property and project planners are investigating ways to keep the pier. Future plans are not finalized, so this application is taking a conservative approach by assuming the pier will be removed. In concordance with Major CAMA Permitting, a Sedimentation and Erosion Control Plan is in the process of being submitted to the Town of Nags Head and a Stormwater Management Plan is being prepared for submittal to NCDENR, Division of Water Quality. The proposed area of land disturbance excluding the removal of the pier/pier house is approximately 104,507 SF (2.40 AC). As shown on the site plan, portions of the concrete drive and cottages are oceanward of the AEC. Disturbance associated with the removal of the pier system is approximately 25,090 SF (.58 AC). No disturbance within the dunal system will include removal or permanent reconfiguration of the dune. Re-vegetation of disturbed areas will be done in accordance with the Sedimentation and Soil Erosion Plan for the site. Disturbed portions of the dune will be re-planted using American Beach Grass planted in the Spring of 2002. Removal of existing structures will be performed by East Coast Abatement and Demolition (East Coast). No subsurface structure removal will be performed before issuance of the Major CAMA Permit. Proposed pier removal will be done from a barge to be launched from the beach in the immediate vicinity of the pier. The proposed access aisle to the beach will be in the location of the current beginning of the pier ramp and walk-on beach access. In this area the dune is low-lying with relatively gently sloping topography (see site plan). This portion of the pier ramp will be the first to be removed to open up the access aisle. Minor grading will be performed by addition of clean sand material to the dune front to level off irregularities to the access aisle (no dune material will be removed). Wooden mats will then be' lain over the sand and will extend from the base of the existing concrete drive over the access aisle to the beach. The barge will contain abatement equipment for pier removal. Pier pilings will be removed singly and recycled or disposed of properly. This activity will be performed during calm weather periods when wave amplitude and frequency are low. East Coast has two possible ways in which to remove the pilings: 1. Breaking the pilings at the top of the existing substrate- This is the most desirable methodology for East Coast and will allow for the work to be completed in a time efficient manner. This method includes leaving the base of the pilings in the subsurface. Minimal disturbance to the substrate will occur with this method. 2. Removal of the entire piling by attachment to a vibratory device- This method is also effective but may require more time and some more disturbance to the substrate due to the current stable nature of the pilings in place.
