Box 96 Manns Harbor, NC 27953 Dear Mr. White: You have our approval, in accordance with the attached conditions, to fill 0.02 acres of coastal wetlands and 0.53 acres of waters to remove old docking and bulkhead, construct a new dock and bulkhead and perform maintenance excavation at Manns Harbor, as described within your application received August 22, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3274. In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control and Non-Discharge. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. PROJECT SUMMARY: The applicant proposes to remove old docking and bulkhead, to construct new dock and bulkhead, to perform maintenance excavation within the marina basin and to fill in a canal. Wade White/Manns Harbor Marina Field Investigation Report Page Two Site Description The subject property is located immediately west of the US 64/264 bridge over the Croatan Sound (William B. Umstead Bridge) on the south side of the right of way in Manns Harbor, Dare County. The property is bounded on the north by US 64/264, on the east by the Croatan Sound, on the south by a manmade basin and channel, to the Croatan Sound and on the west by marsh lands. The property area totals approximately 11.36 acres and has varying elevations that reach a maximum elevation of approximately 3 1/2 ft. above the normal water level (NWL). The property has been used for spoil disposal several times in the past and the soils on the property are sand and silt. The property has approximately 4,325 linear feet (LF) of shoreline on the Croatan Sound and on the manmade basin and channel. Nearly half of the property consists of coastal wetlands vegetated with Juncus roemerianus, Distichlis spicata., Scirpus, Spartina patens and Spartina alterniflora. Other vegetation found on the property includes upland grasses, phragmites and wax myrtles. Several canals have been dredged on the property most of which are bulkheaded as is a majority of the property's southern shoreline. A dock system for approximately 70 boats exists in the basin immediately waterward of the shoreline. Conditions of the existing bulkhead, docking and mooring pilings have deteriorated over time due to weather making some of the dock unsafe. Small repairs have been made over time and riprap has been added behind the old bulkhead in most areas to prevent erosion. In some areas, the bulkhead has collapsed or is no longer functioning and coastal wetlands vegetation has established a fringe in some to these areas. Other features on the property consist of a motel, restaurant, retail shop, boatramp, fuel dock, parking areas and several out buildings. Until recently, a portion of the site served as a trailer park occupied by camper trailers with permanent occupants. The site was not maintained and fell into a state of disrepair and unsightliness. Several of the trailers became unsanitary. The new owner immediately had the trailers removed and the site cleaned up. The owner has done minor repairs to some of the marina docks, bulkhead and parking and maintenance excavation has been done in the channel area (CAMA Minor Permit #2000-9, CAMA GP26866A). Other permits issued at the site include D&F 44-74, D&F 528-71, and D&F 166-70. The waters of Croatan Sound in this area are classified as SA by the Division of Environmental Management and the basin and channel waters are closed to shellfishing. The water depths in the basin and connecting canals and channel range from -1' to -20'. Development Proposal In order to prevent erosion and provide a safe mooring and safe docking, the applicant proposes to remove approximately 767 LF of old bulkhead and 827 LF of old dock along the existing basin and canal and to install 459 LF of new bulkhead 5 ft. waterward of the old bulkhead alignment along the basin shoreline. Approximately 452 LF of new 6 ft. wide dock is proposed to be constructed waterward of and adjacent to the proposed bulkhead. Twenty- Wade White/Manns Harbor Marina Field Investigation Report Page Three four 4' x 12' finger piers with 58 mooring pilings are proposed to be constructed along the basin shoreline to create 24 boatslips 10', 12' and 16' wide and up to 35' long. The proposed bulkhead alignment will cut off an adjacent canal from the basin. The applicant proposes to fill the canal (approximately 135 ft. long and 35 ft. wide and -2 ft. deep). The applicant proposes to excavate to a depth of -7 ft. below NWL in the area of construction of the docks and slips as well as the area of the fuel dock. Anticipated Impacts The construction of 459 LF of new bulkhead 5 ft. waterward of the existing bulkhead alignment will result in the filling of approximately 2,760 sq. ft. of Public Trust Area, Estuarine Waters Areas of Environmental Concern (AECs) and approximately 400 sq. ft. of fringe Coastal Wetlands AEC in the manmade basin. Approximately 170 cu yds of fill material will be placed below water level for bulkhead backfill. Approximately 7,000 sq. ft. of Estuarine Shoreline AEC will be disturbed by the bulkhead backfill. The construction of 452 LF of new 6 ft. wide dock and 24, 4 ft. x 12 ft. finger piers will cover approximately 3,288 sq. ft. of Public Trust Area, Estuarine Waters AECs in the manmade basin. The filling of the canal will result in the loss of approximately 4,800 sq. ft. of Public Trust Area, Estuarine Waters AECs and approximately 650 sq. ft. of fringe Coastal Wetlands AEC. The bottom of the canal proposed for filling consists of soft silt material and no submerged aquatic vegetation was observed in the canal or in the basin - location of the development proposal. Approximately 350 cu yds of fill material will be placed below water level for canal fill. The proposed maintenance excavation will result in approximately 5,200 sq. ft. of bottom disturbance in the Public Trust Area, Estuarine Shoreline AEC and the removal of approximately 757 cu yds of soft sand and silt material. The applicant indicates that the bottom material will be excavated by backhoe, deposited on the shore and used for backfill of the bulkhead and as fill material of the canal. Any extra fill needed will be brought to the site from an upland site. Temporary water turbidity will occur during the excavation and construction process. The removal of the old docks and bulkhead will result in the removal of a safety hazard and the construction of the new docks will not increase the number of available slips. Submitted by: Frank A. A M,gnn'e I-Iarhnr Marina - In.se2 h R Lassiter CF.P - Agent Applicant or Project Name Signature July 26, 2001 Date Revised 03/95 PROJECT NARRATIVE (MANN'S HARBOR MARINA) Subject Property: The subject property is located immediately west of the US 64/264 bridge over the Croatan Sound (Umstead Bridge) on the south side of the right of way in Mann's Harbor, Dare County, North Carolina that is owned by Mr. Wade White. The property is bounded to the north by Highway US 64/264 that is maintained by The North Carolina Department of Transportation (NCDOT). To the east the property is bounded by open waters of the Croatan Sound with the Umstead Bridge serving as an access to Roanoke Island. Immediately south of the property is a lagoonal water body that is hydrologically linked to the Croatan Sound by an entrance channel and partially serves as the current Mann's Harbor Marina boat basin. Across the channel is a private parcel currently undeveloped. Lying to the west is highway US 64/264. The subject property is active as a marina that serves vessels with boat slips and a boat ramp. Existing Conditions: The property area totals approximately 11.36 acres that lies on the western banks of the Croatan Sound just south of the confluence with the Albemarle Sound and north of the Pamlic Sound. The Croatan Sound is separated from the Roanoke Sound to the east by Roanoke Island. The parcel occupies approximately 4,325 Linear Feet (LF) of shoreline. Soils here are categorized as Psamments (PsB) according to the 1992 Soil Survey by the US Department of Agriculture. These surface soils are mostly comprised of sand and silt generated from locally dredged spoil material and used as fill. Several canals have been dredged on the property, most of which are bulkheaded along with the majority of the southern property shoreline. A dock system and boat basin exists immediately waterward of the bulkhead parallel to the shoreline. Conditions of the existing bulkhead, docking and mooring pilings have deteriorated over time due to natural weathering of the wood. A boat ramp, loading dock and fueling station serve vessels as well as several boat slips that line the dock. Enclosed structures existing on the property include a motel, restaurant, retail shop and storage units. Proposed Conditions As an effort by the property owner to renovate and beautify the facility, Quible & Associates, P.C. has been contracted to apply for a required Major CAMA Development Permit that is issued by the North Carolina Division of Coastal Management. Permitting will be necessary for maintenance excavation of the boat basin and removal of a portion of the existing bulkhead and dock. Also proposed is replacement of bulkhead and dock and backfilling of an existing "man made" dead end canal. The initial phase of work involves removal of approximately 767 LF of bulkhead and 827 LF of pier along the current boat basin. Replacement bulkhead will be installed five feet s`'e?wa d of Normal Water Level (NWL) along the southern corridor of the boat basin and is proposed cut off the "man-made" canal that is intended to be filled in (see accompanied plat). Approximately 459 LF of bulkhead and 452 LF of new dock is proposed. 24 finger pier and boat slips are proposed with 58 mooring pilings. Maintenance dredging is proposed within the boat basin along the new bulkhead using a back hoe. Spoil material will be used to backfill the bulkhead and to fill the canal, as shown on the site plat. The soil here consists of sand and silt and will offer good drainage and compaction. Excess fill material that is necessary to bring the project to proposed grade will come from an approved off- site, clean soil source.
