You have our approval, in accordance with the attached conditions (WQC # 3301) to conduct the following.
activity at the Salty Shores Subdivision, Carteret County. This approval allows you to:
1) Dredge 20,025 square feet (0.45 ac) of non vegetated wetlands (canal bottom)
This approval is only valid for the purpose and design that you described in your CAMA application dated
August 14, 2001 received by the Division of Water Quality (DWQ). After reviewing your application, we have
determined that this activity is covered by General Water Quality Certification Number 3301. This Certification
allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. Please keep in
mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not
limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal
Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your CAMA application date
August 14, 2001. If you change or modify your project, you may need to notify the Division (DWQ) in writing and
youu may be required to send us an application for a 401 certification. If the property is sold, the new owner must be
given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If
?total-wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). for this approval to be valid, you must follow the conditions listed in the
attached certification and the additional condition listed below.
1). Turbidity controls must be maintained throughout construction, so that turbidity does not exceed 25 NTUs outside
the project area.
2). Impacts to SAV's must be avoided
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a. hearing, send a written petition
conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N. C. 27699-6714. This certification and its conditions are final and binding unless you
ask for a hearing.

GENERAL 401 WATER QUALITY CERTIFICATION FOR PROJECTS ELIGIBLE FOR
CORPS OF ENGINEERS GENERAL PERMIT NUMBER 198000291 (ISSUED TO THE
NORTH CAROLINA DIVISION OF COASTAL MANAGEMENT)
AND NEUSE/TAR-PAMLICO BUFFER RULES
This General Certification and written concurrence is issued in conformity with
requirement of Section 401, Public Laws 92-500 and 95-217 of the United States and subject to
the North Carolina Division of Water Quality Regulations in 15 NCAC 2H, Section .0500 and 15
NCAC 2B .0200 for the discharge of fill material as described in General Permit 198000291 and
for the Neuse and Tar-Pamlico Buffer Rules (15A NCAC 2B .0233 and .0259). This Water
Quality Certification (WQC) is rescinded when the Corps of Engineers re-authorizes Regional
General Permit 0291 or when deemed appropriate by the Director of the Division of Water
Quality (DWQ.
The State of North, Carolina certifies that the specified category of activity will not
violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and
95-217 if conducted in accordance with conditions hereinafter set forth.
Conditions of Certification:
Activities covered by this General Certification do not require written concurrence
from the Division of Water Quality as long as they comply with all conditions of
this General Certification, the CAMA Permit and General Permit 198000291. If any
condition in this Certification cannot be met, then the applicant is required to
submit an application and receive written concurrence from DWQ prior to beginning
work;
2. The following activities do not require written concurrence and do not require
payment of the 401 Water Quality Certification fee -
• Boat Ramps and associated access (i.e., roads and parking lots) that involve the
excavation or.fillino of less than 500 square feet of wetland and open water area,
with the,exception that the excavation or filling of coastal wetlands.may not
exceed 100 square feet and except when associated with new marinas,
subdivisions and commercial development);
• Shoreline protection measures that tie into existing bulkheads, land or other
.shoreline protection measures or do not extend waterward of the water line more
- than-10-feet, provided that the activity will not involve the excavation or filling
of any SAV or shellfish resources and impacts less than 500, square feet of
vegetated wetlands or less than 100 square feet of coastal wetlands;
-• Piers and docks designed to accommodate fewer than 10 vessels and the water
depth is greater than three feet;
Maintenance dredging of less than 0.5 acres of water or non-vegetated wetlands
provided that the applicant can-provide written documentation showing the
historic dimensions of the dredged channel, and no Submerged Aquatic
Vegetation or shellfish beds are excavated or filled;

Projects that only involve shading of waters or wetlands;
Utility lines, except wastewater lines and potable water discharge lines which are
subject to an NPDES Permit, as long as wetland or water impacts are temporary;
Upland development which involves no more than 1/10 of an acre of excavation
or filling of non-coastal wetlands, with the exception that no more than 2,000
square feet of the non-coastal excavation or filling may take place within an Area
of Environmental Concern. For the purposes of this area calculation, the
excavation or filling impacts of boat ramps, bulkheads or other shoreline
stabilization measures must be considered. The applicant must comply with all
applicable coastal stormwater rules;
Single family home construction that results in fill of 404 wetlands as long as
written concurrence is not required from DWQ for the applicable Corps of
Enaineers Nationwide Permit.
3. Activities authorized by Coastal Area Management Act (CAMA) General
permits do not require written concurrence from the Division of Water
Quality as long as they comply with all other conditions of this General
Certification;
4. In accordance with North Carolina General Statute Section 143-215.31)(e),
any request for written concurrence for a 401 Water Quality Certification
must include the appropriate fee. If a project also requires a CAMA Permit, one
payment to both agencies shall be submitted and will be the higher"of the two fees.
The fee shall be collected and distributed between the two agencies by the:Division
of Coastal Management; -
5. This certification does not eliminate the need to obtain any additional permits,
approvals or authorizations that may be required. Specifically, the permitee shall
contact the North Carolina Division of Water Quality to determine consistency with
the Neuse or Tar-Pamlico Buffer Rules (15A NCAC 2B .0233 and 15A NCAC 2B
.0259). New development activities located in the protected 50-foot wide riparian
areas (whether jurisdictional wetlands or not) within the Neuse and Tar-Pamlico
River Basins shall be limited to ".uses" identified within and constructed in
accordance with 15A NCAC 2B .0233 and 15A NCAC.2B .0259. All new
development shall be located. designed, constructed, and maintained to have minimal
disturbance to protect water quality to the maximum extent practicable through the
use of best management practices. Activities listed as "exempt" from these rules do
not need to apply for written concurrence under this Certification;
6. Appropriate sediment and erosion control practices that equal or exceed those
outlined in the most recent edition of the "North Carolina Sediment and
- Erosion Control .Planning and Design Manual" or the "North Carolina Surface
Mining Manual" (available from the Division of Land Resources in the DENR
Regional or Central Offices) shall be utilized to prevent exceedances of the
appropriate turbidity water quality standard (50 NTU's in freshwater streams and
rivers, 25 NTU's in all saltwater classes, and all lakes and reservoirs);
7. All sediment and erosion control measures placed in wetlands or waters shall
be removed and the natural grade restored after the Division of Land
Resources has released the project;

8. If an environmental document is required, this Certification is not valid until a
Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by
the State Clearinghouse;
9. Measures shall be taken to prevent live or fresh concrete from coming into
contact with waters of the state until the concrete has hardened;
10. This General Certification is not applicable to a project where the Director of
the Division of Water Quality or the Director of the Division of Coastal Management
have determined, based on an initial review of the application, that written
concurrence is needed because of concerns related to water quality or aquatic life.
11. Additional site-specific conditions maybe added to projects which have
applied for CAMA major permits which are proposed under this Certification
in order to ensure compliance with all applicable water quality and effluent
standards;
12. If written concurrence is required for this activity, DWQ shall be sent a
written notification within 30 days of completion of the wetland or stream
impact or upon expiration of the 404 Permit or 401 Certification. Such
notification shall be sent to the Central Office of the Division of•Water
Quality on the form provided with the Certification, shall be accompanied by
a map depicting the work completed, and shall-be signed by the land owner or
other responsible party.
Non-compliance with or violation of the conditions herein set forth by a specific fill
project shall result in revocation of this Certification for the project and may result in criminal
and/or civil penalties.
The Director of the North Carolina Division of Water Quality may require submission of
a formal application for individual certification for any project in this category of activity, if it is
determined that the project is likely to have a significant adverse effect upon water quality or
degrade the waters so that existing uses of the wetland or downstream waters are precluded.
Public hearings may be held for specific applications- or group of applications prior to a
Certification decision if deemed in the public's best interest by the Director of the North Carolina
Division of Water Quality.

8. PROJECT SUMMARY: The applicant proposes to conduct maintenance dredging of
the Salty Shores Canal from the boat ramp just inside the mouth of the canal to 641 feet
offshore. The dredging will involve the removal of 1971 yd3 of material along a marked
navigation channel originating from the single-family residential development just west of
Broad Creek, Carteret County.
9. NARRATIVE DESCRIPTION:
Project Setting
Salty Shores Subdivision is located off Highway 24 just '/a mile west of Broad Creek
down SR 1249 in Carteret County. Salty Shores is separated into two sections, one being the
single-residential component made up of 1/2 acre lots and the other being a mobile home park
at the head of the +/- 1,500 foot long canal system connecting to, Bogue Sound. The manmade
canal runs south to north from the sound and then turns 90° and runs east to west to the head
of the canal. The entire tract is approximately 100 acres in size, which includes the portions of
the subdivision that do not have water access., The typical elevation throughout the tract is 8'-
10' above Normal Water Level (NWL). There are two boat ramps at the mouth of the canal
one associated with mobile home park on the west side of the entrance canal and the other on
the east side associated with a separate subdivision know as Radford Estates. Along the canal,
there are steep banks up to single-family residences with maintained yards and a dock with
boat slips.
Salty Shores Canal was originally opened to Bogue Sound in 1976 without state or
federal authorization. As a result of an enforcement action from the Corp of Engineers, an
earthen plug was placed at the mouth of the canal until 1984 when it was re-opened through
Major Permit No. 157-84. In 1986, an authorization was issued for canal maintenance and the
construction of bulkhead along the canal sides. It does not appear from a file search that there
has been a formal authorization for the section of the canal from the mouth south toward the
Intracoastal Waterway (ICW). This marked channel has been historically used to access the
ICW and there is pictoral evidence of the channel back to 1984.
The channel runs through Bogue Sound, which is classified as SA-ORW waters by the
Division of Water Quality. The area in question is not a primary nursery area and is only
closed to shell fishing 200' from the mouth of the canal. The existing depths within the mouth
of the canal vary from around 4 feet below Normal Water Level (NWL) at the boat ramp on
the west side to 2.5 feet below NWL at the mouth of the canal where the bulkhead stops.
Outside the mouth heading south toward the ICW the existing depth stays fairly consistent at
2.5 feet below NWL until the end of the marked channel where it slowly drops from 2.5 feet
below NWL to the outside connecting depth of 5 feet below NWL. The channel is bordered by
SAV beds on the east side 10' from the marked channel and 20' from the marked channel on
the west side. The beds presence and their proximity to the marked navigation channel were
confirmed in the field with the applicant's agent on 7/20/01. During the field visit, there were
some clams noted along the outside of the marked navigation channel. The current bottom is
made up of a muddy sand bottom with coarser sand along the center of the channel and
primarily mud along the banks of the channel.
Project Description
The project involves the maintenance excavation of the channel running from the mouth
of the canal toward the ICW. For purposes of this field report the project is called maintenance
based on the historical use as an access channel. The project has been broken into four sections
labeled sections A-D on the application. The entire reach of the channel is being proposed for
25 feet wide for a total distance from inside the mouth toward the ICW of 801 feet. Section A
is proposed at 240'X25'X-2' for 444 yd3, section B is proposed at 93'X25'X-3' for 258 yd3,
section C is proposed at 356'X25'X3' for 989 yd3, and finally section D is proposed at
112'X25'X-2.7' for 280 yd3. The total yardage for the project comes to 1,971 yd3.
A mud bucket style dredge will perform the dredging. This type of dredge uses a
hydraulic clamshell bucket to excavate the bottom and then spoils are placed on the barge until
unloading along the shore. The spoils will be loaded into a dump truck and hauled to an
upland site within the community just south of Highway 24. According to the agent the
dredging could be complete within 10 working days.
Anticipated Impacts
The proposal will excavate 20,025 ft2 of open bottom within a marked navigation
channel. There would be short-term turbidity expected from the dredging. Impacts to the SAV
beds are not expected because the project's design includes sloping of the channel to reduce
the impact from sloughing. Improved boating access would occur as a result of the channel
maintenance.

5. ADDITIONAL INFORMATION
In addition to the completed application form, the
following items must be submitted:
• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to` be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the proje.^t.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed proj= to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has be--n provided.

oceanfront and inlet areas.
• A statement of compliance with the N.C.
Environmental Policy Act (N.C.G.S. 113A - 1 to
10) If the project involves the expenditure of public
funds or use of public lands, attach a statement
documenting compliance with the North Carolina
Environmental Policy Act.
