The Division has determined that your application is incomplete and cannot be processed. The application is on hold until all of the following information is received: 1. Please provide a revised stream impact table that includes all proposed impact locations and associated impact lengths. [15A NCAC 02H .0502(e)] Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. The stream impact table lists two stream impacts. However, there appears to be three stream crossings associated with the project (Line "A" STA 19+00, 20+80, and 28+80.) Please clarify the discrepancy. You are correct, there are three stream impacts. I only noted the ones at STA 19+00 and 20+80, but there is an additional one at 28+80. 2. Please confirm Line "A" STA 29+00 to 30+50 will meet Condition 1.2. of GC4133. a. The proposed line will be within 10 feet of the bank, because of a utility pole in the existing pipe alignment. Silt fence will be installed at the top of bank until grass is re-established, the trench will be backfilled each day, and the spoil pile during construction will be placed on the side of the trench opposite from the creek bank. Please confirm the apparent stream crossing at Line "A" STA 28+80 will meet Condition 1.3. of GC4133. a. This stream crossing will be constructed in accordance with Condition 1.3. of GC4133. The stream banks will be returned to near their original contour, and be seeded and matted in accordance with our coir matting detail, so as you have stated, these stream impacts will be temporary. I have attached to this email 401 Water Quality Certification (WQC) 4133 (GC 4133), which corresponds to Nationwide Permit 12 (Utility Line Activities). The second page of the attached document lists a number of thresholds or circumstances under which written approval for a 401 WQC is required. Please clarify the following items: 1. The stream impact table lists two stream impacts. However, there appears to be three stream crossings associated with the project (Line "A" STA 19+00, 20+80, and 28+80.) Please clarify the discrepancy. 2. Please confirm Line "A" STA 29+00 to 30+50 will meet Condition 1.2. of GC 4133. 3. Please confirm the apparent stream crossing at Line "A" STA 28+80 will meet Condition 1.3. of GC4133. Note that the stream impact table lists the impacts as permanent. As noted in a previous email, if the streambanks are returned to near their original contour, seeded, and matted, as apparently depicted in the COIR MATTING STANDARD DETAIL on Sheet D-3, the impact would be considered temporary.
