APPROVAL of 401 Water Quality Certification
Dear Mr. Classen:
You have our approval, in accordance with the attached conditions, to dredge, fill and cover 0.01 of estuarine/Public
Trust Water and shallow water habitat in order to install a concentrate discharge/diffuser structure with anchor 100 feet
offshore in the Pasquotank River, Camden County, as described in your application received by the Division of Water
Quality on June 27, 2001. After reviewing your application, we have determined that this fill is covered by General Water
Quality Certification Number 3274 which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This
Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition,
you should get any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying CAMA Permit expires unless otherwise specified" in the General Certification.
This approval is only valid for the purpose and design that you described in your application. if you change your
project,;you must notify us in _writing and you may be required to send us a new-application for :a new. certification. If the.,
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. if total wetland fills for this project (now or in the future) exceed one acre,rcompensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this. approval to be valid, you..must follow the
conditions listed in the attached certification.' .
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

with anchor 100 feet offshore in the Pasquotank River. The structure will be connected to an 8-inch
line on the north side of Chantilly Road.

Project Setting
Camden County owns 6.33 acres of highground located in the Courthouse township of the
county near the southern end and on the east side of Chantilly Road (SR 1138). The county
has also purchased 1/2 acre of low-lying land comprised almost entirely of wetlands located on
the opposite side of Chantilly Road adjacent to the Pasquotank River. Elizabeth City Shrine
Club, which owns property at the end of Chantilly Road, has granted Camden County a 15'
wide by 267' long utility easement extending from the Pasquotank River to the 6.33 acre
parcel. To access the site turn east off US 158 onto Country Club Road (SR 1132). After
traveling 8/10 mile turn south (right) onto Chantilly Road and stop at the Elizabeth City Shrine
Club sign where the pavement ends. The 15' wide easement runs perpendicular to the road
and is marked by a pair of stakes set on each side of the road. The highground site is located
on the north side of the road approximately 80' from the right-of-way.
Elevation of the county's 6.33 acres of high, open land, which was formerly a farm field,
ranges 8'-9' above mean sea level. Elevation of the 1/2 acre riverfront parcel and the 123 foot
long portion of the utility easement which abuts it ranges 1.5'-3.5' above mean sea level.
Located immediately landward of the NWL of the Pasquotank River there is a 60' wide area of
Coastal Wetlands vegetated with salt meadow grass (Spartina patens) and cattail (Typha spp.).
There is a 60'-65' wide section of non-coastal wetlands located between the coastal wetlands
and Chantilly Road. Vegetation noted growing within the non-coastal wetlands includes
cypress (Taxodium distichum), sweet gum (Liquidambar styraciflua), black willow (Salix
nigra), wax myrtle (Myrica cerifera), groundsel bush (Baccharis halimifolia), Virginia creeper
(Parthenocissus quiquefolia), arrow arum (Peltanora virginica) and pennywort (Hydrocotyle
umbellata).
Development is proposed in the Pasquotank River approximately 100'-110' waterward of
NWL. The waters of the Pasquotank River in the vicinity of the project are classified as SB
by the Division of Environmental Management and are closed to shellfishing according to.the
Division's Shellfish Sanitation Section. These waters are classified as Joint Fishing Waters by
the NC Marine Fisheries Commission and NC Wildlife Resources Commission. The presence
of submerged aquatic vegetation was not noted in the project area.
Project Description
The applicant proposes to construct a 6,000 square foot reverse osmosis water treatment
facility and 500,000 gallon ground storage tank and install two wells on its 6.33 acre
highground site approximately 500 feet from the Pasquotank River. The concentrate stream
will be discharged approximately 100 feet waterward of the NWL of the river. A 12-foot long
header/diffuser assembly will be located at the terminus of an 8-inch diameter, 282' long
subterranean high density polyethylene pipe. The 8-inch pipe will be placed by directional
bore eight feet below ground/bottom level. The 282 linear feet of subterranean pipe will begin

approximately 180 feet landward of NWL within the 15' wide utility easement, run under a
120' wide area of coastal and non-coastal wetlands also located within the easement, and
terminate 100' waterward of the NWL of the Pasquotank River. The header/diffuser assembly
will be equipped with 8 six-inch diffuser check valves, and will be anchored to the sandy
bottom with a contour of 2.5'-3.0' below NWL by a 3'x3'xll/2' deep concrete anchor sunk
into the river bottom. NPDES Permit No. NC008661 was issued to Camden County on 29
December 2000. Within the project area the Pasquotank River is 1.5 miles wide.
Anticipated Impacts
. The header/diffuser assembly and concrete anchor will cover 48 square feet of shallow
water bottom of the Pasquotank River.
Less than a cubic yard of bottom material will be displaced by the placement of the anchor
and the emergence of the directionally bored 8-inch water line.
. Turbidity will increase temporarily in the project area (100' beyond NWL) during
construction of the 8-inch pipe, diffuser assembly and concrete anchor.
. The structure could possibly present a hazard to navigation.
. The construction of the 6,000 square foot reverse osmosis treatment plant and 500,000
gallon ground storage tank is proposed on highground approximately 500' landward of the
Pasquotank River and outside all Areas of Environmental Concern.
. The directional bore is proposed 8 feet under the 120' area of coastal and non-coastal
wetlands.
. The discharge will impact the surrounding waters due to salinity and thermal differentials
and other constituents which may be different from the surrounding waters.

Project Setting
Camden County owns 6.33 acres of highground located in the Courthouse township of the
county near the southern end and on the east side of Chantilly Road (SR 1138). The county
has also purchased 1/2 acre of low-lying land comprised almost entirely of wetlands located on
the opposite side of Chantilly Road adjacent to the Pasquotank River. Elizabeth City Shrine
Club, which owns property at the end of Chantilly Road, has granted Camden County a 15'
wide by 267' long _utility easement extending from the Pasquotank River to the 6.33 acre
parcel. To access the site turn east off US 158 onto Country Club Road (SR 1132). After
traveling 8/10 mile turn south (right) onto Chantilly Road and stop at the Elizabeth City Shrine
Club sign where the pavement ends. The 15' wide easement runs perpendicular to the road
and is marked by a pair of stakes set on each side of the road. The highground site is located
on the north side of the road approximately 80' from the right-of-way.
Elevation of the county's 6.33 acres of high, open land, which was formerly a farm field,
ranges 8'-9' above mean sea level. Elevation of the 1/2 acre riverfront parcel and the 123 foot
long portion of the utility easement which abuts it ranges 1.5'-3.5' above mean sea level.
Located immediately landward of the NWL of the Pasquotank River there is a 60' wide area of
Coastal Wetlands vegetated with salt meadow grass (Spartina patens) and cattail (Typha spp.).
There is a 60'-65' wide section of non-coastal wetlands located between the coastal wetlands
and Chantilly Road. Vegetation noted growing within the non-coastal wetlands includes
cypress (Taxodium distichum), sweet gum (Liquidambar styraciflua), black willow (Salix
nigra), wax myrtle (Myrica cerifera), groundsel bush (Baccharis halimifolia), Virginia creeper
(Parthenocissus quiquefolia), arrow arum (Peltanora virginica) and pennywort (Hydrocotyle
umbellata).
Development is proposed in the Pasquotank River approximately 100'-11.0' waterward of
NWL. The waters of the Pasquotank River in the vicinity of the project are classified as SB
by the Division of Environmental Management and are closed to shellfishing according to the
Division's Shellfish Sanitation Section. These waters: are classified as Joint Fishing Waters by
the NC Marine Fisheries Commission and NC Wildlife Resources Commission. The presence
of submerged aquatic vegetation was not noted in the project area.
Project Description
The applicant proposes to construct a 6,000 square foot reverse osmosis water treatment
facility and 500,000 gallon ground storage tank and install two wells on its 6.33 acre
highground site approximately 500 feet from the Pasquotank River. The concentrate stream
will be discharged approximately 100 feet waterward of the NWL of the river. A 12-foot long
header/diffuser assembly will be located at the terminus of an 8-inch diameter, 282' long
subterranean high density polyethylene pipe. The 8-inch pipe will be placed by directional
bore eight feet below ground/bottom level. The 282 linear feet of subterranean pipe will begin

approximately 180 feet landward of NWL within the 15' wide utility easement, run under a
120' wide area of coastal and non-coastal wetlands also located within the easement, and
terminate 100' waterward of the NWL of the Pasquotank River. The header/diffuser assembly
will be equipped with 8 six-inch diffuser check valves, and will be anchored to the sandy
bottom with a contour of 2.5'-3.0' below NWL by a 3'x3'xll/2' deep concrete anchor sunk
into the river bottom. NPDES Permit No. NC008661 was issued to Camden County on 29
December 2000. Within the project area the Pasquotank River is 1.5 miles wide.
Anticipated Impacts
. The header/diffuser assembly and concrete anchor will cover 48 square feet of shallow
water bottom of the Pasquotank River.
. Less than a cubic yard of bottom material will be displaced by the placement of the anchor
and the emergence of the directionally bored 8-inch water line.
Turbidity will increase temporarily in the project area (100' beyond N)AIL) during
construction of the 8-inch pipe, diffuser assembly and concrete anchor.
. The structure could possibly present a hazard to navigation.
The construction of the 6,000 square foot reverse osmosis treatment plant and 500,000
gallon ground storage tank is proposed on highground approximately 500' landward of the
Pasquotank River and outside all Areas of Environmental Concern.

AND SPECIFICATIONS
LOCATION OF DIRECTIONAL BOREHOLE SHALL BE COORDINATED WITH
AND APPROVED BY THE ENGINEER PRIOR TO COMMENCING BORING
OPERATIONS.
2. NO VEHICULAR TRAFFIC OR CONSTRUCTION ACTIVITIES ARE ALLOWED
IN THE WETLANDS BETWEEN CHANTILLY ROAD AND THE EDGE OF WATER.
3. THE CONTRACTOR SHALL RESTORE ALL AREAS DISTURBED BY
CONSTRUCTION ACTIVITIES TO THEIR ORIGINAL CONDITIONS.
4. THE CONTRACTOR SHALL INSTALL A 10' X 10' CONTAINMENT FENCE
AROUND THE BOREHOLE TO HOLD EXCESS DRILLING FLUID AND
SPOILS. THE DRILLING FLUIDS AND SPOIL SHALL BE PUMPED FROM
THE CONTAINMEN-T STRUCTURE TO THE SHORE, WHERE THE MATERIAL
WILL BE REMOVED AND DISPOSED OF. NO DRILLING FLUIDS OR SPOILS
SHALL BE STORED ON SITE. EXCESS DRILLING FLUID AND SPOILS
SHALL NOT BE DISCHARGED INTO SANITARY OR STORM DRAIN
SYSTEMS, DITCHES OR WATERWAYS.
5. THE PIPE FOR THE DIRECTIONAL BORE SHALL BE HIGH DENSITY
POLYETHYLENE (PE 3408) DR11 IN ACCORDANCE WITH AWWA C906.
rIITINGS SHALL BE BUT[' TYPE FITTINGS AND SHALL CONFORM TO
AWWA 906 AND SHALL BE BUTT FUSION WELDED TO THE PIPE IN
ACCORDANCE WITH ASTM D3261.
6. DIFFUSER CHECK VALVES SHALL BE FLOW OPERATED ALLOWING FLOW
IN ONE DIRECTION. THE VALVE SHALL BE OF ALL ONE-PIECE RUBBER
CONSTRUCTION WITH NYLON REINFORCEMENT. THE DIFFUSER CHECK '
VALVE SHALL CONNECT TO THE DISCHARGE HEADE'R BY SLIPING OVER
THE DIFFUSER PORT ATTACHED WITH STAINLESS STEEL CLAMPS. THE
DIFFUSER CHECK VALVES SHALL BE AS MANUFACTURED BY THE RED
VALVE CO. OR APPROVED EQUAL.
7. CONCRETE ANCHORS SHALL BE CAST OFF-SITE AND SHALL HAVE A
MINIMUM COMPRESSIVE STRENGTH OF 3,000 PSI. THE ANCHORS JUN 1 9 2m
SHALL BE SHIPPED TO THE FINAL LOCATION AND PLACED IN HAND
EXCAVATED TRENCHES. NO MECHANICAL EXCAVATING EQUIPMENT
