This approval allows you to fill: 1) A 30' X 20' pocket of 404 wetlands (filling and incorporating 600 sq ft of 404 wetlands 0.06 ac). This approval is only valid for the purpose and design that you described in your CAMA application dated June 28, 2001 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that General Water Quality Certification Number 3106 covers this activity. This Certification allows you to use Nationwide Permit Number 18 when issued by the US Army Corps of Engineers. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your CAMA application dated June 28, 2001. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. PROJECT SUMMARY: The applicant proposes to fill a 30' by 20' pocket of 404 wetlands to create a consistent grade in conjunction with the development of a single- family residential lot. FIELD INVESTIGATION REPORT: DUNCAN / CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The Duncan's own 0.95 acres along SR 1121 or 393 Pearson Circle Road within Broad Creek Community adjacent to Bogue Sound, Carteret County. The elevation of the tract is approximately five feet above mean sea level. The lot currently has a new septic system to support the future residential development and also has a pier with boatlift permitted in March 2001. The lot runs north to south from the recently filled septic system for approximately 130 feet crossing lawn-grass and finally transitioning into marsh. At the water-ward edge of the lawn there is a small fringe of black needle rush auncus roemerianus) before it changes to cord grass (spartina alterniflora) for a marsh fringe approximately 40 feet wide along the entire width of the lot. The plat provided by the applicant shows an edge of marsh line landward of the mean high water mark, however, the marsh line actually approximates the normal high water mark. The lot currently has a CAMA minor permit exemption for the installation of fill, a single-family residence, and septic system. The site is located adjacent to Bogue Sound, which is classified as SA-ORW. This particular stretch of Bogue Sound is not a primary nursery area, however, it is open to shell-fishing. The offshore waters are shallow with no significant depth until the Intracoastal Waterway approximately 600 feet offshore. Project Description The Duncan's are seeking to fill a small pocket (30'X20') of 404 wetlands on the east side of their lot. This particular pocket was uncovered when the applicants cleared their lot for development. Prior to purchase this area was overgrown and collected trash as a border between two lots. The Corp of Engineers were on-site earlier this year and determined the small wetland to be wetlands and connected. The reason for this major permit is that the fill of wetlands is within an Area of Environmental Concern, in this case 575 feet from the normal high water level adjacent to ORW waters. The applicant would like to fill the wetland pocket to help drainage through the lot and for vector control. If permitted the applicant would fill the wetland with 2 feet of fill dirt to match the grade of the neighboring lot and the recent fill from the septic system. Once filled, the applicant is proposing to stabilize the fill with seeding. The plat is incorrect in one additional place when it discusses the distance from the proposed fill to the marsh. This distance measured on-site was actually +/- 130 feet from the proposed fill to the edge of marsh. Anticipated Impacts The project will involve the loss of 600 ft2 of 404 wetlands adjacent to Outstanding Resource Waters. The drainage of the lot will be altered through the filling of the wetlands as well as the previously filled area under the current exemption. 0 Brad E.
