Description of any best management practices to be used to control impacts associated with the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or enhancement of existing vegetation, etc.): There will be two methods of controlling impacts associated with this project. The first will consist of completely enclosing the underside of the deck with treated lumber from the deck surface down to the soil. Additionally, the backside of the underpinning will be covered with landscape fabric. This will help diffuse any runoff and help minimize any further soil erosion. The second method of controlling the impact will consist of planting woody vegetation between the project boundaries and the existing boat house/dock area and/or waters edge. Where the soil layer is too thin to allow planting of any woody vegetation, the plantings will require the use of low profile, bottomless wooden boxes to allow the addition of soil to assist in the planting effort. 3. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. There is a large outcropping of rock directly under the area of proposed construction. This outcropping posses a safety hazard to my young children. In the event that this variance is not allowed, the slope of the land and the outcropping of rock prevents any reasonable method of creating a safe area. (2) How these difficulties or hardships result from conditions that are unique to the property involved. Surrounding property do not have large outcroppings of rock. (3) If economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. Description of proposed activity [Also, please attach a map of sufficient detail (such as a plat map or site plan) to accurately delineate the boundaries of the land to be utilized in carrying out the activity, the location and dimension of any disturbance in the riparian buffers associated with the activity, and the extent of riparian buffers on the land. Include the area of buffer impact in W.: The proposed activity is construction of a deck that will partially extend into the 20 ft Riparian Buffer Zone. The area of impact is approximately 166 square feet. The deck construction will be completely enclosed on the underside of the deck down to the soil with landscape fabric on the backside. This construction method will minimize any further soil erosion from around a large rock outcropping and thin soil covering the surrounding area. For purposes of calculating the percentage of impact in relation to the overall property, the total property area is recorded on the survey (plat) as .37 Acre. State reasons why this plan for the proposed activity cannot be practically accomplished, reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers: The deck construction project was extending from outside of the buffer zone into the buffer zone to cover a large outcropping of exposed rock. The exposed rock poses a safety hazard for my small children. The decking will provide coverage of the rock and help minimize further erosion of soil in that area.
