After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3280. In addition, you should obtain or otherwise comply with any other-required federal, state or local permits before you go ahead with your project including (but not limited to) Non-discharge and Water Supply Watershed regulations, and Sediment and Erosion Control Permit. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application with revisions except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland, compensatory wetland mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the DWQ General Certification No. 3280 and any additional conditions listed below. 1. When we purchased the property this year, the shoreline was unaltered and remains so to this day. We would like to stabilize the shoreline with rip-rap to avoid further erosion and loss of trees. The lake frontage is approximately 450 feet, all on a deepwater cove on the northern section of the lake. We would also like to add a boat dock with a ramp at approximately the center point of the lake frontage. Given the fact that the cove has deep water, it is unnecessary to extend the dock into the lake even as far as is legally allowed. For the shore stabilization, we plan to use a minimal amount of fill. This will leave the current shore contour unaltered to the greatest extent possible, allowing us to minimize both cost and tree loss. Page 7 of 12 VHL Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed.
