APPROVAL of Neuse River Buffer Rules
Dear Ms: Hudson:
You have our approval to construct a road crossing within the Neuse River Buffer on your property in Johnston County,
as described in the application received by the Division of Water Quality on July 13, 2001. This approval is valid for the
Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water
Supply Watershed regulations.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new approval. If the
property is sold, the new owner must be given a copy of the approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions of the Neuse
River Buffer Rules.
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter .
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This approval and its conditions are final and binding unless you ask for a hearing.

RE: Neuse Buffer Rules Approval Request for the Becky Hudson Subdivision
Dear Mr. Dorney:
The purpose of this submittal is to request approval in writing for the crossing of a Neuse
River Buffer for the proposed road crossing in the proposed Becky Hudson Subdivision.
The widest point of the buffer crossing due to the road will be 32 feet and is located at the
proposed 24-inch pipes shown on the attached plans. In addition, we are proposing to
install a 15 feet long riprap pad and a sediment basin downstream of the pipe to meet soil
erosion control requirements.
We will also be submitting the soil erosion control plan to the Raleigh Regional office for
review as well as the stormwater management plan to Johnston County for review.
We have no practical alternatives to crossing this Neuse River Buffer for two basic
reasons:
1- The property north of the ditch cannot be accessed from this property without
crossing the Neuse River buffer and:
2- Johnston County requires that all lots front on a public or private street. Private
streets such as the one proposed for this development are required to be
constructed according to NCDOT standards with the exception of paving by the
County. The road proposed is to be private and gravel will be used for the driving
surface. The gravel-driving surface will be 18 feet wide with an additional seven
feet on each side of the road to be used as a shoulder and for slope areas to tie into
existing grade.

In order to protect water quality, we have proposed the following for this development:
1- Limit impervious areas over the 7.94-acre tract to 11.59%. This will keep
nitrogen loads at 3.44 lbs/ acre, which is below the 3.6 lbs/ acre limitations in the
Neuse Rules. See the nitrogen loading calculations attached to the permit
application.
2- We have beefed up the soil erosion control plan by installing four temporary
sediment traps to capture runoff from the road construction before it enters the
buffer area.
3- The 1.062 acre lot remaining where the upstream buffer is located will be
recorded as open space (A portion of this lot must be left undeveloped to meet
Johnston County open space requirements).
4- Since the only areas draining along the road will be the road itself (and the
drainage areas are small), road ditches will not be installed so the run-off from the
road will drain across the lots and sheet flow into the buffer areas.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetia,nds/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide

impervious surface for the site is 11.59%. The impervious area was designed to keep nitrogen
loads below 3.6 lbs/ acre. See attachment 1 - nitrogen loading calculations. Road ditches will
not be used so stormwater will sheet drain across the lots and into the buffer area. Soil erosion
control plans will be prepared and followed during the construction process to avoid off-site
siltation impacts.
