Subject: Proposed Improvements to Highway 21 in Mecklenburg County
State Project No. C-5621
The North Carolina Department of Transportation (NCDOT) is in receipt of your on -hold
letter dated February 12, 2010 and would like to address cited deficiencies by offering the
following responses:
Mitigation Amounts:
There will be 26 feet of perennial and 501 feet of intermittent stream channel impacts due to
the construction of C-5621. The U.S. Army Corps of Engineers (USACE) will be
determining the final mitigation ratio for these impacts.
Mitigation Payment /Acceptance:
An In -Lieu Fee Request Form for C-5621 was sent to the Division of Mitigation Services
(DMS) on February 13, 2020. NCDOT received a Mitigation Acceptance Letter from DMS
dated February 14, 2020. Ms. Donna Hood, NCDWR and Ms. Nicholle Braspennickx,
USACE received a copy of the Mitigation Acceptance Letter as well. DMS will be notified
for the final mitigation requirements once that determination has been made by the USACE.
Lack of Avoidance and Minimization:
C-5621 has been designed to provide continuous traffic flow in the area of US 21 and
Catawba Avenue in Cornelius. The proposed design consists of duel roundabouts, one north,
and one south, of the existing intersection of US 21 and Catawba Avenue. The project
construction limits have been reduced to reduce impacts to only those that are absolutely
necessary.
Appropriate design, sizing, and location of proposed storm drain, and pipe systems were
achieved utilizing NCDOT's Best Management Practices for Construction and Maintenance
Activities. All pipe carrying jurisdictional waters will be buried according to the conditions
of the Nationwide 14 permit and corresponding Water Quality General Certification and
limited to only that which is necessary to construct the project.

There are three sites within the project limits where permanent and temporary surface water
impacts will occur. Site 1 impacts are incurred with the installation of a proposed 42-inch
reinforced concrete pipe (RCP) and headwall. Site 2 impacts are incurred with the
installation of a proposed 36-inch RCP, while Site 3 impacts are incurred by a channel
relocation with rock stabilization versus piping. Rock energy dissipaters are being utilized to
reduce storm water velocities entering streams within the project limits.
A Level II Certified Sediment and Erosion Control /Stormwater Site Manager will be
performing all required inspections and completing NPDES records. These records will be
kept throughout the life of the project. Additional BMPs will be utilized on an as -needed
basis to reduce potential sediment losses to adjacent water resources.
Hazardous Spill Basins:
Hazardous Spill Basins have been deemed "Not Applicable" for this project based upon
requirements listed in the NCDOT Guidelines for Drainage Studies and Hydraulic Design
(2016) Appendix O.
The site does not contain a stream as defined by the guidelines listed in Appendix O,
however, a jurisdictional feature determination has been performed and there are
jurisdictional channels within the project study limits. Permit Site 1 impacts a stream
crossing within'/2 mile of the critical area of a water supply source classified as WS-II, WS-
III, and WS-IV.
Given that the roadway is not classified as an Arterial route, this site was evaluated based on
the criteria listed on the Hazardous Spill Basin Flowchart, found in Appendix O. The
roadway will be terminating at an apartment complex with a roundabout and, as such, will
mainly consist of residential traffic, with a very low probability of hazardous truck traffic and
accidents.
