Cornelius, NC 28031 APPROVAL of 401 Water Quality Certification and Authorization Certificate per the Catawba River Buffer Protection Rules (15A NCAC 2B.0243) Dear Mr. Detchemendy: You have our approval, in accordance with the attached conditions, to place rip-rap along 100 feet of shore on Lake Norman, Wildwood Cove Lot 12, in Iredell County for the purpose of shoreline stabilization as described in your amended application received by the Division of Water Quality on August 10, 2001. After reviewing your amended application, we have decided that this fill is covered by General Water Quality Certification Number 3280, which can be downloaded from our web site at htto://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use Regional Permit Number 198200030 when the US Army Corps of Engineers (USACE) issues it. This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers as required under 15A NCAC 26 /0243(8). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and those listed below. 1. Any removed trees must be replaced. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Copy attached. ON July 17, 2001 I thought I fully answered all of your questions. Copy of this letter attached. On July 24, 2001 I received approval from the Corps of Engineers. Copy attached. I have todate not received any further communication from you. I again state that the normal way shoreline has been stabilized on Lake Norman over the past many years is for a contractor/grader to put rip rap stone on the bank. To do this they must have some room for their equipment. In my plan, I stated that we would use the smallest equipment that is practical thereby causing the least amount of disturbance to the buffer area. Also, we would only be disturbing less than 100 feet whereas the lot has over 340 feet of shoreline. Also, I stated that we would be leaving a larger than 50 foot buffer along the area being stabilized. I stated that the equipment we would use would be a Holland. The grader calls this a small skidder. It is less than 6 feet wide and can turn on a dime. Here again, I am doing my best to cause the least disturbance to the buffer. I do not know what more I can tell you to describe my plan that you requested. To restate: we will use a small skidder to go down to the shoreline and?but on some rip rap stone along an area less than 100 feet. There are no large trees involved here, either on the path down or on the shoreline. After we are done we will mulch the disturbed area. Please let me hear from you. I am confused as to what you want. I have in the past done shoreline stabilization to several waterfront lots that we have sold or built upon on Lake Norman. We have always used grading firms that do this type of work routinely. There routine is simple. They first cover the shoreline with a thick plastic and then put rip rap on top of that. To do this they need space for their equipment to work so they normally clear a path down to the shoreline and along the shoreline. When they finish they previously sowed grass on the paths. I understand that mulch is now preferred. On this particular lot, lot 12, I have taken the grader that I am going to use to the lot and we have decided on the following: Since there are no large trees along the shoreline wherein we will put the rip rap, we will use small equipment. He plans to use a small Holland with a front bucket. This equipment is not very wide and he will be able to work within a path of about 6 foot in width. Bigger equipment normally takes 8 to 10 feet. This smaller equipment will take a little longer but the per hour charge is considerable less so overall it will be less costly for me and a hell of a lot less disruptive to the shoreline. After putting down the rip rap over the plastic we will heavily mulch the paths along the shoreline and the path leading down to the shoreline. The path leading down to the shoreline will be the path the people in the new house will use to get down to there boat dock so we will not need to further disturb the buffer for this purpose. We plan to do the mulching immediately after putting down the riprap. We estimate this entire operation, including the mulching, will take 1 to 2 days. Further, I plan to build the house close to the street and do not want too much back yard to maintain so I have decided to leave a buffer larger than the required 50 feet. The buffer will be at least 60 feet. Also, we are only going to do a bit less than 100 feet along the shoreline. This lot has about 340 feet of shoreline so we will leave most of the shoreline completely undisturbed. This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (USACE) Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's (DWQ) associated General 401 Water Quality Certifications. Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at http://h2o.enr.state.nc.us/ncwetlands to read about current requirements for the 401 Water Quality Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The applicant is also advised to read the full text of the General Certification (GC) matching the specific 404 Permit requested. In some cases, written approval for some General Certifications is not required, provided that the applicant adheres to all conditions of the GC. Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC regional coordinator (listed by county on the last page of this application). PAYMENT Page 1 of 12 RECEIVED CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on the last page of this application) the applicant should also contact the North Carolina Division of Coastal Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such cases, DCM will require a Coastal Area Management Act (CAMA) Permit and will coordinate the 404/401 Permits. USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms, photos, etc. to the applicable USACE Regulatory Field Office (addresses are listed at the end of this application). Upon receipt of an application, the USACE will determine if the application is complete as soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant to address information needs for all USACE Nationwide, Regional or General permits, as well as information required for State authorizations, certifications, and coordination. Submit seven collated copies of all USACE Permit materials to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service Center, Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401 Certification, then a non-refundable application fee is required. In brief, if project impacts include less than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is required. A check made out to the North Carolina Division of Water Quality, with the specific name of the project or applicant identified, should be stapled to the front of the application package. The fee must be attached with the application unless the applicant is a federal agency in which case the check may be issued from a separate office. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice -of Issuance and Modification of Nationwide Permits, published in the Federal Register on Marc h.9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice -of Issuance and Modification of Nationwide Permits, published in the Federal Register on March. 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
