As you mentioned, the only area of 404 jurisdiction on the site is a small depression wetland that butts up against the NC 55 fill slope. I also determined that the following features are not jurisdictional under Section 404: 1) A storm water conveyance between the wetland and the railroad track. 2) A storm water pond that crosses the north property line of the property. I also determined that the pond on the east side of the railroad track is NOT connected to any downstream features by any surface water feature. You can use this determination to plan development of the site, to avoid and minimize 404 impacts, and to apply for a 404 permit, if necessary.
