Dear Mr. Coleman:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0,03
acres of wetlands, for the purpose of shoreline stabilization at lot 166, as you described in your application dated July 19,
2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number
3280. This certification allows you to use Regional General Permit Number 030 when the Corps of Engineers issues it. This
approval is also valid for the Tar-Pamlico River buffer rules (15A NCAC 2B .0259). In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide
Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or
areas within 50 feet of all the shoreline of Lake James to notify the state in order to assure compliance for buffer and/or
water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permit (whichever is later).
2. An additional condition is that stormwater shall be directed to sheettlow at non-erosive velocities through the protected
stream buffers.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within
60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B
of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Crescent Resources is requesting 401 Water Quality Certifications from the North
Carolina Division of Water Quality to stabilize subdivision shorelines on Lake James
(Linville River). The NCWRC has reviewed information provided by the applicant, and
field biologists on our staff are familiar with habitat values of the project area. These
comments are provided in accordance with provisions of the Clean Water Act of 1977
(33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as
amended; 16 U.S.C. 661-667d).
It is our understanding that stabilization is proposed for areas above the full lake
pool. Therefore, the Impact Minimization Zones (IMZ) shorelines and beaches will not
be impacted. The areas to be stabilized with large stone are along high clay bluffs.
Erosion in these areas contributes turbidity and sediment impacts to Lake James. Little
vegetation and woody debris can be found in the proposed stabilization areas. Crescent
Resources proposes to use barges to install large boulders along these bluffs in an effort
to reduce soil erosion impacts to water quality and aquatic habitats.
Because the work will take place above the full pool elevation, we will not object
to the project provided that Crescent Resources preserve, to the extent practicable,
existing woody debris and living plants along the shoreline during rock installation. To
the extent possible, this activity must avoid impacts to the IMZ. We also recommend

Jim Reid and I bushwacked our way into this area on Lake James on
August 30, 2001 and found shorelines that were not impacted by
development and ranged from small sandy beach areas to 20 foot vertical
embankments that were being undercut resulting in large trees falling
into the water. I would say the average bank height from water to top
of bank would fall into the four to twelve foot category with highly
eroding red clay. Based on our observations and the amount of erosion
that is taking place, it is recommended that 401 Certifications be
issued for all of these sites.
Since this is in Burke County and on Lake James, Burke County has the
authority to enforce the Catawba Buffer Rules.

To Whom It May Concern,
This letter is to inform you of our intentions concerning shoreline stabilization for this lot. We will be
performing the work by barge and a lone reach excavator. We will not need to disturb the buffer zone to
perform the work. All work will be performed from the water. We will only provide clearing for the
stabilization up to the high water mark. There will be no need to replant the buffer zone, because we
will not disturb it.

On July 3, 2001, the Division of Water Quality (DWQ) was notified by receipt of your eighteen (18) applications
regarding your plans to impact various amounts of shoreline along Lake James in Burke County for the purpose of
stabilizing the shorelines of the following lots; Lot 143 (DWQ # 010998), Lot 142 (DWQ # 010999), Lot 144 (DWQ #
011000), Lot # 194 (DWQ # 011001), Lot # 168 (DWQ # 011002), Lot # 197 (DWQ # 011003), Lot # 195 (DWQ #
011004), Lot # 196 (DWQ # 011005), Lot # 192 (DWQ # 011006), Lot # 53 (DWQ # 01107), Lot # 199 (DWQ # 011008),
Lot # 198 (DWQ # 011009), Lot COS (DWQ # 011010), Lot # 200 (DWQ # 011011), Lot # 193 (DWQ # 011012), Lot #
191 (DWQ # 011013), Lot # 166 (DWQ # 011014), and Lot # 167 (DWQ # 011015). Approval from DWQ is required to
impact the shoreline of these lots. Please provide seven copies of the following information and refer to the DWQ number
listed above in your reply.
1. The location of the proposed shoreline stabilization measures must be shown on a map.
Also the Catawba River buffer rules became effective on June 30, 2001 and allow shoreline stabilization
measures within the protected buffers along Lake James. We are concerned that construction of these
shoreline stabilization measures will result in excessive impact to the protected buffers. Please provide
details on how you plan to install these shoreline stabilization measures, what measures you will take to
minimize impact to the buffers and then how and when you plan to replant the unavoidably impacted portions
of these buffers. One possible approach would be for Crescent Resources to develop a generic plan to install
shoreline stabilization measures that would address the above issues. This plan could then be approved in
writing by DWQ and used by Crescent Resources as a standard contract provision for future shoreline
stabilization work.

procedural materials. This project will remain on hold as incomplete in accordance with 15A NCAC 2H .0505(c). The
processing time for this application will begin when this information is received. If we do not hear from you within three (3)
weeks of the receipt of this letter, we will assume that you no longer want to pursue this project and will consider it
withdrawn.
