On March 1, 2019, the Division of Water Resources (Division) received your application for an
After -The -Fact Buffer Authorization and restoration plan to satisfy NOV-2018-PC-0479 from
the Division for the subject project. On March 27, 2019, Mr. Wayne Koluch was notified via
telephone that the restoration plan submitted was insufficient. On May 28, 2019, Mr. Sean Fisher
submitted a restoration plan to the Division and was notified via e-mail that the plan was
insufficient. As of today, the Division has not received a complete response to this request.
Pursuant to Title 15A NCAC 02B .0233 (8)(b)), the Division has not received all of the
requested information necessary to make a decision and is unable to approve or deny your
application. For the reasons listed above, your application is hereby returned.
Once you have addressed the problems and. or inadequacies with your application as it was
submitted, you will need to reapply to the Division for approval including a complete application
package.
Please be aware that you have no authorization under Title 15A NCAC 02B .0233 for this
activity and any work done within the protected riparian buffer may be a violation of North
Carolina Administrative Code.
