Attn: Mr. Stephen Cahoon 524 New Hope Road Raleigh, NC 27610 RE: Site Determination for Applicability to the Neuse River Basin Riparian Area Protection Rules [15A NCAC 2B .0233(3)(a)] CP&L Raleigh Water Treatment Plant (WTP) UT to Honeycutt Creek [03-04-02; 27-20-(2); WS-IV NSW CA] Dear Mr. Cahoon, Thank you for your letter of June 22, 2001 (received by this office on June 25, 2001) which requested an opinion as to whether the WTP's "discharge canal" is jurisdictional and whether tree removal in the buffer zone could be allowed to protect the new distribution substation. Based on an on-site determination made by Mr. Bob Zarzecki on August 21, 2001, the Division of Water Quality (DWQ) has determined that the "discharge canal" is a modified natural stream indicated on the Wake County USDA Soil Survey (see attached soil survey initialed by Mr. Zarzecki on 8/28/01) and is therefore subject to the Neuse River riparian . buffer protection rules (15A NCAC 2B .0233). Also, the buffer rules allow tree removal for existin structures. Since the structure is not existing, then tree removal from Zone 1 (30 feet from the stream bank) is not allowed. Removal of trees within Zone 2 (30 to 50 feet from the stream bank) is and exempt activity that does not require approval from the DWQ as long as the area is left vegetated and the health of the vegetation within Zone 1 is not compromised. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Please be aware that this property is also within a Water Supply Watershed and should comply with the 15A NCAC 2B .0215 regulations. Additional power is needed at the site in order to provide increased water treatment service for Raleigh residents, thus increasing the efficiency of the public works department. The additional power will require construction of a new distribution substation onsite of approximately 40 X 50 feet. The city has identified the site CP&L is to use, which is immediately adjacent to the R'TP's discharge point; an unnamed tributary to Honeycutt Creek (jurisdictional under the Neuse Buffer Rule). According to the city this is the only space available on the. WTP site for construction of the new distribution substation. CP&L employees have surveyed the site for environmental concerns, and the substation itself can be built without impacts to waters or wetlands. However, the city has asked that any "danger trees" (trees capable of hitting any part of the substation and damaging it if they fall, thus causing a loss of power at the WTP) he rcrnoved. CP&L has identified 6 - 10 danger trees within the heavily vegetated Zone I of the Neuse River buffer around an unnamed tributary to Honeycutt Creek. The trees within Zone i of the buffer will be removed using forestry best management practices in order to minimize disturbance to the buffer. Tree stumps will be left in the ground and not disturbed. In an attempt to comply with the spirit of the buffer rules, CP&L proposes to replace the 6 - 10 trees proposed to be removed within Zone 1 of the buffer with a lower growing Leyland Cypress which would not have the potential to damage the substation if they were to fall. CP&L believes that removing the existing trees using BMPs and replucing the trees within the buffer will not adversely affect aquatic life or water quality in the vicinity of the WTP. I would ask that the Division of Water Quality review this letter and the attached mapping and grant CP&L a vunancc to remove the above r-cferenced danger trees from the buffer. CP&L personnel have surveyed the site for environmental concerns, and the substation itself can be built without impacting waters or wetlands. However, the city has asked that any "danger trees" (i.e., trees capable of hitting any part of the substation and damaging it if they fell) be removed as well. Based on information provided to us by the city, the Division of Water Quality has previously determined that the WTP's discharge canal was jurisdictional under the Neuse riparian buffer rules. If so, a number of the danger trees which the city is asking us to cut will be within the riparian buffer (Zone 1). While the buffer rules exempt the removal of individual trees which could endanger structures, our understanding is that the intent of this exemption was to provide protection for existing structures and not new ones. I would ask that you confirm the determination that the WTP discharge canal is jurisdictional under the buffer rules, and if so, whether the selective cutting of danger trees can be exempted.
