Box 9002 Wilmington, NC, 28402 APPROVAL of 401 Water Quality Certification Dear Mr. Parks: You have our approval, in accordance with the attached conditions, to dredge 14 acres of open waters, shade 0.06 acre of non- vegetated wetlands and place fill in 8.3 acres of a spoil disposal island in order to conduct maintenance dredging of the existing marina basin and to add three floating docks to the Southport Marina in Brunswick County, as described in your application received by the Division of Water Quality on June 22, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274 which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of t4 Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now" r in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1. Turbidity curtains shall be maintained throughout the work period to contain sediment within the immediate work area. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant is requesting maintenance dredging of the existing marina basin. In addition, they propose to add three floating docks to accommodate 7 new boat slips. FIELD INVESTIGATION REPORT: SOUTHPORT MARINA PAGE #2 9. NARRATIVE DESCRIPTION: Southport Marina is an existing facility located on West Street in Southport, Brunswick County. The marina property is owned by the North Carolina State Ports Authority and is leased to Southport Marina Inc., John F. Phillips, Secretary. The Marina Manager and agent for this application is Clay Parks. The marina is a full service facility offering boat ramps, fuel, electric and water connections, pumpout station, wet slips and dry-stack storage. There is an office, bait and tackle shop, boat repair shop and restaurant on site. The subject facility is served by public water and sewer. The marina is located within a basin off of the Atlantic Intracoastal Waterway. The existing basin is approximately 1400' by 450' in size. The tract of land is approximately 44 acres in size according to the application. The high ground portion of the property is developed with a marina office, restaurant, public restrooms, parking and dry stack storage. A portion of the shoreline around the basin is bulkheaded. The shoreline east of the boat ramps is natural and almost entirely coastal wetlands. The applicant is requesting to perform maintenance dredging down to -6' at low water within the marina basin and connecting channel as needed. The existing water depths within the basin are indicated on site plan. The existing depths overall range from -0.4 to -9.9. However, the immediate need is in the boat slips where the water depths are -1.5 to -3.0. The work would be performed by hydraulic dredge and pumped across the AIWW into an existing, 8-acre Corps spoil disposal island. Also, proposed are three new floating docks. Two of these proposed docks are 8' x 90' long and one is proposed at 8' by 150' long. These floats would be attached across the ends of "A", "B", and "C" docks. They are indicated by the dashed lines on the plans. These proposed docks would add 7 new boat slips to the basin, bringing the total boat slips to 179. The AIWW in this area has been classified as SC by the Division of Water Quality. The waters are closed to shellfishing by Shellfish Sanitation and have not been designated as primary nursery area as designated by the Division of Marina Fisheries. The Southport Land Use Plan classified the high ground portion of this property as "Developed Residential" and the waters as estuarine and public trust. The coastal wetlands have been classified as conservation. 10. ANTICIPATED EMPACTS: Impacts from this project include the potential disturbance of approximately 14 acres of shallow bottom in an existing boat basin through maintenance dredging. Temporary turbidity is likely to result from the dredging activity. The spoil material would be placed within an existing, upland, Corps of Engineers' spoil disposal island across the Intracoastal Waterway from the marina site. The spoil disposal site will require minor maintenance work prior to commencement of the dredging activity. No material is to be placed within waters or wetlands. No wetland impacts are associated with this project. Construction of the floating docks will result in the shading of an additional 2640 square feet of open waters and add 7 more boat slips within the marina basin.
