' Dear Mr. Scheller,
' On behalf of Washington White Post Solar, LLC (a subsidiary of Duke Energy), we are submitting this Pre -
Construction Notification (PCN) for permanent impacts to waters of the US from two culvert
' installations at the proposed Washington White Post Solar Farm. The project will result in less than 150
linear feet of stream and less than 0.1 acre of permanent impacts to waters of the US. Per the
requirements of NC Division of Water Quality (DWQ) Certification 3886 and Nationwide Permit (NWP)
' 14, this PCN is being submitted to the NC DWQ for approval and a copy is being provided to the US Army
for the record only.
IProject Information
The project site is 85.3 acres located approximately 2.5 miles northwest of Bath, NC on the western side
' of White Post Road (Beaufort County PIN 07023216). The site is mostly cleared, farm land and has been
cultivated since at least 1938 with soybeans planted during the 2012 growing season. An approximate
1.5 acre forested area is located on the eastern portion of the site along White Post Road and an
' approximate 0.5 acre forested area is located on the northern portion of the site. The proposed project
consists of a 12.5MW solar energy facility which will deliver renewable energy to the local utility grid.
' Jurisdictional Waters
Based on a review of available maps and a site visit by Mr. Kyle Barnes of the US Army Corps of
' Engineers on August, 22, 2012, one jurisdictional stream (UT1 to Boyd Creek) runs from west to east
through the southern portion of the Site. The stream crosses the entire length of the site,
approximately 1,230 linear feet, and averages 32 feet wide. This perennial stream has a defined bed
and bank with clear evidence of an ordinary high water mark. The stream has been channelized and is
nearly straight through the property. No other jurisdictional waters of the US, including wetlands, were
noted on the site.
Summary of Proposed Impacts
In order to access both the northern and southern portion of the site, two roads, each with a 78"
diameter culvert, will be permanently installed in UT1 to Boyd Creek. Rip rap will be keyed in on either

side of the culverts for stabilization and will be installed per the Wilmington District Regional Condition
number 3.5. Coffer dams will be temporarily installed on either side of each of the western culvert to
allow for work in the dry. For the eastern culvert, one coffer dam will be utilized and an existing culvert
under White Post Road will be temporarily plugged to allow for work in the dry. One underground
utility line will be directionally drilled adjacent to Culvert 1 and will not result in stream impacts.

The number and width of the crossings have been limited to the bare minimum to safely construct and
operate the solar farm. Two crossings are required for safety purpose to ensure the solar panels can be
accessed in the event of an emergency or if one of the road crossings becomes impassable. Road
crossings were designed perperndicular to the stream to minimize impacts. The project construction,
including the installation of the culverts and underground utility line, will be completed in accordance
with state and federal regulations, including the NC DWQ Stormwater rules and Nationwide and
Regional Conditions (Nationwide and Regional).

The site is currently agricultural fields (NC land use land cover 2 01) and was planted with soybean crops in 2012.
Properties in the general vicinity of the site are a mix of cultivated farm land (NC LULC 2 01), tree farms (NC LULC 2.02),
and rural residences.
See Figures 1 and 2.

The project consists of a 12.5MW solar energy facility which will deliver renewable energy to the local utility grid

Approximately 100 rows of solar panels will be installed east -west. The panels will be mounted above ground and an
underground collection system of electric cables will connect the panels to 20 transformer /inverter pads and connect to
the existing power line along White Post Road. Standard construction equipment, including earthmoving equipment, will
be used during construction See attached Site Plan.

The road crossings are necessary to access and maintain the southern 20% of the project area Two crossings are required
for safety purpose to ensure the solar panels can be accessed in the event of an emergency or if one of the road crossings
becomes impassable. The number and width of the crossings have been limited to the bare minimum to safely construct and
operate the solar farm Road crossings were designed perperndicular to stream to minimize impacts.

Sediment and Erosion Control Plan developed for site. Silt fence, silt soxx, and seeding will be used during land disturbing
activities to control erosion and prevent sedimentation Work within the stream will be minimized at all times and work will be
conducted from high ground whenever possible. Culvert pipe is pre- fabricated and will be placed into the stream complete to
minimize work within the stream Coffer dams will be utilized to work in the dry during culvert installation Any water inside the
coffer dams will only be returned to waters of the US when it no longer poses a threat to aquatic life. Temporary impacts from
coffer dams will be returned to pre - construction condtions.

tDear Mr. Keller:
On October 18, 2012 at the request of Mr. Kenny Habul of SunEnergy 1, Roberto Scheller of this Office conducted an on-
' site re- determination to change the end point of stream determination to more clearly represent drainage feature located on
the subject property for applicability to the Tar - Pamlico Buffer Rules (15A NCAC 213.0259). The feature is labeled as
"12 -0789 A, 12 -0789' B, and 12 -0789 C" on the attached maps initialed by me on October 22, 2012.
' The Division of Water Quality (DWQ) has determined that the feature labeled as "12 -0789 A,12 -0789 B, and 12-
0789 C" on the attached maps, and highlighted in red is not subject to the Tar Pamlico Buffer Rules. The stream
' determination begins at a roadway culvert passing under White Post Road (SR 1343), point 12 -0789 A (N 35° 29.913" W
76° 51.062 "), and continues up gradient to a second point 12 -0789 B (N 35° 29.954" W 76° 51.237 "), and continues to
the western most limits of the property, to point 12 -0789 C (N 35° 29.964', W 76° 51.300'), as shown on enclosed maps
marked on the ground with yellow DWQ flagging.
The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future
correspondences concerning this property. This on -site determination shall expire five (5) years from the date of this
' letter. Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a
surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a
determination by the Director shall be referred to the Director in writing c/o Karen Higgins, 1650 Mail Service Center
t Raleigh, NC 27699 -1650. Individuals that dispute a determination by the DWQ or Delegated Local Authority that
"exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the
date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until
the affected party (including downstream and adjacent landowners) is notified of this decision. DWQ recommends that

construction, operation and maintenance of a low density project in compliance with the
provisions of Session Law 2008 -211 and 15A NCAC 2H .1000 (hereafter referred to as
the " stormwater rules') and the approved stormwater management plans and
'I specifications, and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit.
' The Permit shall be effective from the date of issuance until rescinded and shall be
subject to the following specific conditions and limitations:
' I. DESIGN STANDARDS
1. This permit covers the construction of 16,372 square feet of permanent build-
'' upon area on this 85.74 acres tract of land.
2. The overall tract built -upon area percentage for the project must be maintained at
' or below 24 %, as required by Session Law 2008 -211 and Section 2H .1005 of
the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are
' incorporated by reference and are, enforceable parts of the permit and shall be
kept on file by the permittee at all times
' 4. The only runoff conveyance systems allowed will be vegetated conveyances
such as swales with minimum side slopes of 3:1 (H:V) as defined in the
stormwater rules and approved by the Division.
t 5. No piping is allowed except that minimum amount necessary to direct runoff
beneath an impervious surface such as a road or to provide access.
6. The built -upon areas associated with this project shall be located at least 50 feet
landward of all perennial and intermittent streams or other surface waters.
7. All temporary built -upon area that is not shown on the approved stormwater plan
as a permanent built -upon area, and that is shown on the approved
' Sedimentation Erosion Control plan, shall be removed and the area restored to a

vegetated state when that area is no longer needed, or prior to final inspection
per the requirements of the approved Sedimentation Erosion Control plan, or
within 30 days of project completion, whichever occurs first
II. SCHEDULE OF COMPLIANCE
1. The permittee is responsible for verifying that the proposed built -upon area does
not exceed the allowable built -upon area.
2. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

5.
This project may not be sold or subdivided in whole or in part without first
receiving a permit modification from the Division.
Prior to the subdivision and/or sale of this project, in whole or in part, the
following deed restrictions must be recorded with the Office of the Register of
Deeds:
a The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW7121103, as issued by
the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit
C. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality.
f. This project is permitted for a maximum of 16,372 square feet of built -
upon area Construction of additional built -upon area in excess of this
amount will require a permit modification.
g. This project may not be sold or subdivided, in whole or in part, without first
receiving a permit modification from the Division.
h. Construction of additional impervious areas such that low- density
requirements are no longer met will require a permit modification prior to
construction. An engineered system will be required to collect and treat
the runoff from all built -upon area associated with the project, including
that area permitted under the low density option.
i. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with this development, except for average driveway crossings,
is strictly prohibited by any persons
j. The built -upon areas shall be located a minimum of 50 feet landward of all
perennial and intermittent surface waters.
A copy of the recorded restrictions must be received in this Office within 30 days
of the date of sale.

6. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the permitted development, except for average driveway
crossings, is strictly prohibited by any persons.
7 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size
b. Project name change.
c Transfer of ownership.
d Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition, or sale of the project area in whole or in
part. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the
' approved plan.
8 Swales and other vegetated conveyances shall be constructed in their entirety,
vegetated, and be operational for their intended use prior to the construction of
i any built -upon surface.

During construction, erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.

The permittee shall at all times provide the operation and maintenance
necessary to operate the permitted stormwater management systems at optimum
iefficiency
to include:
a. Inspections
b Sediment removal

C. Mowing, and re- vegetating of the side slopes.
d Immediate repair of eroded areas.
e Maintenance of side slopes in accordance with approved plans and
tspecifications.

Within 30 days of completion of the project, the permittee shall certify in writing
'
that the project has been constructed in accordance with the approved plans.

The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request
III.
GENERAL CONDITIONS
1.
This permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
re- issuance of the permit to change the name and incorporate such other
requirements as may be necessary. In the event of a name or ownership
form, by both
change, a completed Name /Ownership Change signed parties,
must be submitted to the Division of Water Quality accompanied by the
supporting documentation as listed on page 2 of the form. The approval of this
'
request will be considered on its merits, and may or may not be approved.

The permittee is responsible for compliance with all permit conditions until the
'
Director approves a transfer of ownership. Neither the sale of the project nor the

transfer of common areas to a third party, such as a homeowner's association,
constitutes an approved transfer of the stormwater permit.
3 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Quality,
in accordance with North Carolina General Statutes 143- 215.6A to 143 -215 6C
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Session Law 2008-
211 and Title 15A NCAC 2H 1000 of the North Carolina Administrative Code,
' Subchapter 2H 1000; and North Carolina General Statute 143 -215.1 et. al.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by the Division, such as the construction of
additional or replacement stormwater management systems.
6 The permittee grants permission to DENR Staff to enter the property during
normal business hours, for the purpose of inspecting all components of the
stormwater management facility
7. The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and re- issuance, or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the swales
must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state and federal), which have jurisdiction

' mailing address changes at least 30 days prior to making such changes.

STORMWATER AND EROSION AND SEDIMENTATION CONTROL PLANS
Washington White Post Solar. LLC — Solar Farm
10 PROJECT DESCRIPTION
This project is the construction of a Solar Farm on an existing 86 acre farm at 853
White Post Road, Bath NC, Beaufort County. More specifically, the site is on the
west side of White Post Road between H W Y 264 and Route 92 The site has been
farmed for an undetet mined number of years with the most recent (the 2012
growing season) crop being cotton.
Approximately; 100 rows of solar panels will be installed east -west (perpendicular
to White Post Road) The panels are mounted above ground and angled for
optimum power generation. Underground power cables will be run as shown on
the plans and connected to 20 transformer /inverter pads and connected to the
existing power line along White Post Road.
2.0 SITE DESCRIPTION
The site is in the Tar - Pamlico River drainage basin and drains to Boyd Creek: 29-
19 -5(1); NSW, C.
As is typical in this area, file site is very flat with multiple drainage ditches (that
mostly run north- south) to keep the site dry enough for agricultural activities. The
drainage ditches flow to the perimeter of the site to larger ditches along the
property boundary. An unbuffered water feature (sce NCDF.NR Determination
letter included in this package) canal flows west to east and crosses the site
approximately 1/3 of the property length north of the south property line. In
general, the flow patterns are to the west and to the north and south to the

ditch along White Post Road.
As part of this project, all but one of the existing ditches will filled with the
existing ditch labeled EX 7 that runs north/south remaining. Approximately, 11
news swales (labeled S 1 -S 11) running east/west will be constructed. The new
swales S1 -S8 will flew to the existing ditch FX 7 Swales S9 -S i 1 wr11 now west
to the perimeter ditch labeled EX 4
The solar panels are to be mounted above ground and are therefore counted as
' pervious area as grass will be planted and maintained around and under all panels.
Total new impervious area added will total 16.372 sf (0.44% of the site) and will
consist of 20 — 500 sf eoncrcte transformer /inverter pacts, a 20' x 20' maintenance
shed and approximately 5,972 sf of gravel to be included on 2 culverts /drives For

4.0 EROSION CONTROL MAINTENANCE PLAN
A. All erosion and sediment control practices will be checked for stability and
operation following every runoff - producing rainfall, but in no case less than once
every week Any needed repairs will be made immediately to maintain all
practices as designed
B. Sediment will be removed from the erosion control devices when storage capacity
has been approximately 50 percent filled.
C. All seeded areas will be fertilized, reseeded as necessary, and mulched according
to specifications to maintain a vigorous. dense vegetative cover

On August 22, 2012 at your request, I conducted an on -site determination to review a drainage feature located on the
subject property for applicability to the Tar - Pamlico Buffer Rules (15A NCAC 2B.0259) The feature is labeled as "12-
0789 A to 12 -0789 B" on the attached maps initialed by me on August 22, 2012.
The Division of Water Quality (DWQ) has determined that the feature labeled as "12 -0789 A to 12 -0789 B" on the
attached maps, and highlighted in red is not subject to the Tar Pamlico Buffer Rules. The stream determination
begins at a roadway culvert passing under White Post Road (SR 1343), point 12 -0789 A (N 35° 29.913" W 76° 51.062 "),
and continues up gradient to a second point 12 -0789 B (N 35° 29.954" W 76° 5123T') as shown on enclosed maps
marked on the ground with yellow DWQ flagging
The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future
correspondences concerning this property. This on -site determination shall expire five (5) years from the date of this
letter Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a
surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a
determination by the Director shall be referred to the Director in writing c% Karen Higgins, 1650 Mail Service Center
Raleigh, NC 27699 -1650. Individuals that dispute a determination by the DWQ or Delegated Local Authority that
"exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the

the affected party (including downstream and adjacent landowners) is notified of this decision. DWQ recommends that
the applicant conduct this notification in order to be certain that third party appeals are made in a timely manner. To ask

think it's always OK to bum leaves and branches in the fall But
that's not so in cities and counties that pick up yard waste

rules and many local governments have additional restrictions on
outdoor fires Violating these rules can be expensive -- with fines

' Smoke Can Hurt You and Others
Why does the state have such strict rules about open buming7 Because smoke and soot from
outdoor fires can cause serious health problems and pollute the air Fires also can burn out of
control destroying forests and burning down homes Smoke from a burning trash pile contains
many pollutants that can cause senous health problems and damage the environment
Although smoke from a fire may not bother you, it could be a nuisance and serious health threat
for your neighbors, particularly it they have respiratory conditions such as asthma or emphysema
Potential health elfetts include lung and eye irritation headaches, dizziness, asthma attacks,
coughing and even death For more information on the health effects of pollution from open

for wildlife, OT lust left to rot Newspapers can be recycled Old attic junk can be given away for

away material you create in the first place The possibilities are endless

Plan Ahead

On October 4, 2012, we received notification of the above project from the State Clearinghouse
There are no known archaeological sites within the proposed project area Based on our knowledge of the
area, it is unlikely that any archaeological resources that may be eligible for inclusion in the National Register of
Historic Places will be affected by the project We, therefore, recommend that no archaeological investigation
be conducted in connection with this project
The Cowell House, which was identified during the 1976 -77 and 2009 -2010 architectural surveys of Beaufort
County, is located in the proposed project area However, the house appears to be in severely deteriorated
condition and lacks the historic integrity necessary to be eligible for listing in the National Register of Histonc
Places Therefore, we are aware of no historic properties that would be affected by the project and have no
comments on the project as proposed
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR
