APPROVAL of 401 Water Quality Certification
Dear Mr. Bramble and Ms. Beck:
You have our approval, in accordance with the attached conditions, to place fill in 0.02 acre of non-vegetated wetlands in order
to construct a replacement bulkhead in a man-made canal, adjacent to Lots 141 and 142, Section Y, Huron Court, Colington Harbor
Subdivision, in Dare County, as described in your application received by the Division of Water Quality on June 19, 2001. After reviewing
your application, we have determined that this fill is covered by General Water Quality Certification Number 3274 which can be
downloaded from our web site at http://h2o.cnr.state. nc. us/ncwetlands . This Certification allows you to use your CAMA Permit when it is
issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

PROJECT SITE
The applicant's property is located in Colington Harbour Subdivision, a gated residential
community in Dare County. The project site involves two adjacent residential building lots, more
specifically referenced as Lot 141 and 142, Section Y, Huron Court, adjacent to a man-made
canal (Brigand's Inlet) off Roanoke Sound. Lot 141 is approximately 10,700 square feet in area
and lot 142 is approximately 9,700 square feet in area. Vegetation on the property primarily
consists of domestic grasses. However, there is thick fringe of saplings and underbrush along the
shoreline that includes, but is not limited to, live oak (Quercus virginiana), loblolly pine (Pinus
taeda), salt meadow hay (Spartina patens), catbrier (Smilax bona-nox), and dandelions
(Taraxacum officinale). The average elevation of the lots is approximately four feet above
normal water level according to the application. No Coastal or Section 404 Wetlands are located
on the property. According to the Flood Insurance Rate Map the property is in a designated
Flood Zone.
Located north of the property is Huron Court, an unnumbered subdivision street. To the
south is Estuarine and Public Trust Waters. Located on the adjacent lot, to the west is a
residential dwelling and to the east is a vacant lot. The shoreline along the applicant's property
has an old concrete capped bulkhead that is in poor condition. Several large sections of sheathing
have deteriorated causing severe erosion behind the bulkhead. The deepest eroded pocket along
the bulkhead measures 14' from NWL waterward to the existing bulkhead alignment. Water
depths along the existing bulkhead vary from 2'-0" to 3'-0" below NWL. The water bottom
adjacent to the bulkhead is sandy and gently slopes away from the shoreline into the canal. While
submerged aquatic vegetation is present near the property, there is no evidence of vegetation
within the project area itself.
Roanoke Sound is classified as joint waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental Management's
water quality classification for Currituck Sound is SB (swimming). Additional review indicates
that there are no known geological formations associated with the applicant's property. There are
several identified archeological sites within the Colington Harbour Subdivision, not in the
immediate vicinity of the applicant's property.
PROJECT DESCRIPTION
The applicant's are proposing to construct 105.8 linear feet of replacement bulkhead adjacent to
two contiguous residential building lots in Colington Harbour Subdivision.
1) Lot 141 is approximately 10,700 square feet in area and has 45.88 linear feet of shoreline
with an existing, but failing concrete caped bulkhead. The applicants propose to
construct a wooden replacement bulkhead two feet waterward of the existing bulkhead
alignment. Breaches in the bulkhead have created a foot wide shallow water pocket
across the landward side of the old bulkhead, which will result in the proposed bulkhead
being placed three feet waterward of normal water level (NWL). Placement of the
replacement bulkhead would result in the filling of approximately 137.6 square feet of
Estuarine and Public Trust Water and the disturbance of approximately 1,058 square feet
of high ground. Approximately 4.5 cubic yards of fill would be needed to back fill the
proposed bulkhead.

2) Lot 142 is approximately 9,700 square feet in area and has 59.9 linear feet of shoreline
with an existing concrete capped bulkhead that has complete failed along 49' of the
applicant's shoreline. The applicants propose to construct the wooden replacement
bulkhead two feet waterward of the old bulkhead alignment. Erosion has created a
shallow water pocket across the entire length of the property. Normal water level is a
maximum of 16,' and an average of 10.5', water ward of the proposed bulkhead
alignment. Construction of the replacement bulkhead would result in the filling of
approximately 635.2 square feet of Estuarine and Public Trust Water, and the disturbance
of approximately 531 square feet of high ground. Approximately 26 cubic yards of fill
would be needed to backfill the proposed bulkhead.
Wooden "deadmen" anchors would be placed approximately 15' landward of the
proposed bulkhead to stabilize the structure. Land disturbance would be limited to a distance of
20' landward of the proposed bulkhead and would be graded and seeded immediately to prevent
erosion.
ANTICIPATED IMPACT
• If permitted, approximately 1,391 square feet of high ground land disturbing
activity will be undertaken in conjunction with the proposed bulkhead.
• Approximately 767 square feet of Estuarine and Public Trust Waters will be
filled if the bulkhead alignment is approved.
• Temporary localized turbidity will occur during construction of the bulkhead.
• Stabilization of the breach in the owner's bulkhead will reduce the amount of
sediment runoff into the adjacent man-made canal.

The proposed project will consist of two portions. The following is an outline of the project and a brief
narrative of the work to be performed
The proposed bulkhead is 1.05' in length and will have tiebacks installed landward ' as shown in the
application. Installation of the tie backs will require landward disturbance as noted on the submitted
site plan. Once all tie backs are installed, backfil.ling of the bulkhead can start. The compatible
backfill material will be sand brought from an upland source. Approximately 120 cubic feet of fill will
be required for the project. Approximately 24 inches of fill will be placed below the normal water line
on the landward side of the proposed bulkhead approximately 36 inches placed above the proposed the
normal water line. At the completion of this phase of the project, the total area of land disturbance will
be approximately 2100 square feet (105' x 20'). At the time of application no submerged vegetation
was noted and no coastal wetland vegetation is on noted on site.
After construction is complete, lots will be stabilized by seeding with either fescue or bermuda.
