On behalf of Piedmont Natural Gas (PNG), S &ME, Inc. (S &ME) hereby submits this
application for impacts to waters of the U.S. in accordance with Nationwide Permit
(NWP) No. 12 and the corresponding North Carolina Water Quality Certification (WQC)
No. 3884. Our services were performed for PNG as a subconsultant to Regional Land
Surveyors (S &ME Proposal No. 1357- 25119 -12, dated March 13, 2012). PNG, the
project sponsor, will be considered the applicant. The project entails replacement of an
aging segment of natural gas pipeline in Kinston, North Carolina, and will involve no loss
of waters of the U.S. In support of this application, please find enclosed the following:

This PCN is being provided to the U.S. Army Corps of Engineers (USACE) for approval,
and complies with applicable conditions of NWP No. 12. This application is also being
submitted to the North Carolina Division of Water Quality (NCDWQ) for approval
because the proposed project is located in an area subject to the Neuse River Riparian
buffer regulations. A copy of the completed PCN and Agent Authorization Form is
included in Appendix I.
GENERAL PROJECT INFORMATION
PNG is planning to replace an aging section of 4 -inch diameter natural gas transmission
line near Kinston, North Carolina with a new 6 -inch line. The project corridor originates
east of Tilghman Mill Road /North Carolina State Road 1742 (35.3174420 N, 77.5252530
W), extends southeast for approximately 2.5 miles crossing Seaboard Road and Wallace
Family Road, and terminates at an existing PNG regulator station located north of
Cunningham Road /North Carolina State Road 1745 (35.2930140 N, 77.5563920 W).
The approximate location of the project corridor is depicted on the Site Vicinity Map
(Figure 1), as a portion of the Kinston, N.C. (1998) USGS Topographic Quad Sheet
(Figure 2), and Aerial Photographs dated 2010 (Figures 3A and 3B). A majority of the
project corridor extends through agricultural fields and vacant woodland.
The purpose of the proposed project is to replace an existing natural gas transmission line
with a new pipeline that is compatible with current safety and inspection requirements.
The existing pipeline was constructed within a 30 -foot wide right -of -way (ROW) during
the 1950s, and since that time, better construction materials and technology to facilitate
inspection and assessment of pipeline safety and integrity have become available. Safe,
reliable operation of their pipeline system, along with the safety of their customers and
employees, are PNG's primary goals, and served as impetus for the proposed replacement
project.
Replacement of existing gas line involves installation of a new 6 -inch line, followed by
abandonment of the old 4 -inch line. In upland areas, the new pipeline placed parallel to
the existing natural gas pipeline within a new 20 -foot wide ROW, for a total ROW width
of 50 feet. Based on conditions, an additional 10 -to -20 feet of temporary work space
(TWS) will be necessary through wetland area to install the pipe. The total disturbance
width is not proposed to not exceed 40 feet at wetland and stream crossings, and the TWS
is proposed to be sited within the existing ROW. To further minimize disturbance to
jurisdictional areas, PNG plans to leave the abandoned pipeline in place through those
areas. Following construction, 10 feet of the existing ROW will continue to be
maintained, along with the new 20 -foot wide ROW, for a permanent maintained width of
30 feet through wetland areas. Affected portions of the old ROW and TWS are proposed
to be restored and allowed to naturally regenerate.
The project as proposed will not result in a loss of waters of the U.S., but will convert
0.990 acre of forested wetlands to herbaceous wetlands. The project will also result in
0.572 acre of temporary wetland impact and 919 linear feet (If) of temporary impact to
stream channels or non - stream tributaries (drainage ditches that exhibit an ordinary high

water mark or extend the reach of an adjacent wetland). There are no impacts to
Stonyton Creek or Briery Run planned, as the pipeline will be installed beneath these
waterways via bore or horizontal directional drill (HDD), collectively referred to as
"trenchless crossings."
EXISTING ENVIRONMENT
The proposed pipeline is located in the Coastal Plain physiographic province in the Neuse
River Basin, and crosses Stonyton Creek and Briery Run. Land use in the vicinity of the
project corridor consists primarily of a mix of farm fields, forest, roadside and scattered
residential areas.
In general, observed species occurring within the existing, maintained utility ROW
included dogfennel (Eupatorium capillifolium), broomsedge (Andropogon virginicus),
goldenrod (Solidago sp.), blackberry (Rubus sp.), winged sumac (Rhus copallina), poison
ivy (Toxicodendron radicans), dandelion (Taraxacum officinale), Queen Anne's lace
(Daucus carota), sericea lespedeza (Lespedeza cuneata), ebony spleenwort (Asplenium
platyneuron), big bluestem (A. gerardii), muscadine grape (Vitis rotundifolia) and
various grasses (Festuca spp.). Woody saplings included sweetgum (Liquidambar
styraciflua), black cherry (Prunus serotina), tulip tree (Liriodendron tulipifera), red
maple (Acer rubrum) and water oak (Quercus nigra).
The canopy of mixed pine and hardwood forests along the project corridor generally
consisted primarily of loblolly pine (Pinus taeda), water oak, white oak (Q. alba),
American beech (Fagus grandifolia), red maple and tulip tree. Subcanopy species in
these areas included sourwood (Oxydendrum arboreum), flowering dogwood (Corpus
florida), sassafras (Sassafras albidum) and American holly (Ilex opaca). Horse sugar
(Symplocos tinctoria), Chinese privet (Ligustrum sinense), greenbrier (Smilax
rotundifolia), trumpet creeper (Campsis radicans), Virginia creeper (Parthenocissus
quinquefolia), poison ivy, Japanese honeysuckle (Lonicera japonica), and groundsel bush
(Baccharis halimifolia) comprise the understory of these areas.
Species observed within typical wetland areas included red maple, Chinese privet, tulip
tree, red bay (Persea borbonia), sweet bay (Magnolia virginica), giant cane (Arundinaria
gigantean), jewelweed (Impatiens capensis), lizard's tail (Saururus cernuus), soft rush
(Juncus effuses), cinnamon fern (Osmunda cinnamomea) and netted chain fern
(Woodwardia areolata), poison ivy and false nettle (Boehmeria cylindrica).
Species located in open agricultural land or at the periphery of cultivated areas included
dog fennel, crabgrass (Digitaria sanguinalis), American pokeberry (Phytolacca
americana), partridge pea (Chamaecrista fasciculata), golden rod (Solidago sp.),
broomsedge (A. virginicus.), morning glory (Ipomoea purpurea), ragweed (Ambrosia
artemesiifolia) and various grasses.
Other land use areas were observed along the project corridor, but occupy an insignificant
portion relative to the habitat types identified above. Such portions of the project
corridor include landscaped or maintained lawns, roadway ROWs or lightly - developed
areas.

DESCRIPTION OF THE PROPOSED WORK
Construction of the new pipeline will first involve identification of the clearing limits,
followed by aboveground removal of woody vegetation from the proposed ROW by
mechanical means or hand - clearing, as appropriate. In wetland areas, efforts will be
made to remove surface vegetation in a manner that minimizes disturbance of the forest
floor and prevents exposure of soil. If necessary, a temporary equipment crossing will be
installed along one side of the ROW to facilitate equipment passage and prevent
excessive rutting and ground disturbance in the wetlands. Appropriate sediment and
erosion control measures are proposed to be installed to prevent sedimentation of
jurisdictional features as a result of construction. Streambank vegetation within the
corridor will be hand cleared, and introduction of logging debris into the creek are
proposed to be avoided to the extent practicable.
Because the pipe will be installed via HDD through the wetland areas along Stonyton
Creek and Briery Run, no grubbing or belowground vegetation removal will be required
in these areas. Where the pipe will be installed conventionally, grubbing will be limited
to the trenchline. Select portions of the ROW may require rough grading to facilitate safe
passage of equipment, and to prepare a suitably -level work surface. Appropriate
sediment and erosion control measures will be installed following initial soil disturbance
as the project progresses. Within wetland areas where rutting may occur, timber mats are
planned for use to provide work and travel space for equipment.
During construction, the pipe will be strung and placed on skids (wooden pedestals)
along the ROW. Specialized machines will be used to bend individual segments of pipe
to fit the contours of the trench where necessary. The pipe segments will be welded
together and inspected for structural integrity, and then lowered into the trench. In areas
where segregation of the subsoil and topsoil is required (the segment of wetlands where
the pipe will be installed conventionally), the topsoil is proposed to be replaced last.
Affected areas are proposed to be "cleaned up" by rough - grading and application of
temporary seeding (if necessary), followed by final grading, permanent seeding and
mulching to restore the ROW as closely as possible to pre- disturbance contours and
conditions. Areas within wetlands that are disturbed are scheduled to be seeded with a
customized wetland seed mix.
JURISDICTIONAL AREAS
In March 2012, S &ME conducted a pedestrian review of the proposed project corridor to
delineate jurisdictional surface waters located therein. S &ME followed the procedures
set forth in the 1987 US Army Corps of Engineers Wetlands Delineation Manual and the
Atlantic and Gulf Coastal Plain Region Supplemental Guidance. Field conditions were
documented using USACE Routine Wetland Determination Data Forms, as appropriate.
The field review also included identification of tributaries (streams or ditches) within the
project corridor. Drainage features identified during the field review were assessed to
determine the jurisdictional status of the tributary. Drainage features were classified as
either non - jurisdictional or jurisdictional. S &ME used the NCDWQ Stream

Classification Form to document characteristics of identified drainage features on the day
of the assessment.
Field review identified multiple regulated surface waters, including Stoneyton Creek and
Briery Run, eight other natural stream channels, nine wetland areas and five non - stream
tributaries. Limits of the jurisdictional features were delineated by S &ME and
subsequently identified with a Trimble global- positioning system (GPS) unit capable of
sub -meter accuracy. Results of S &ME's assessment were included in a Request for
Jurisdictional Determination package and submitted to the USACE on April 10, 2012.
The delineated boundaries were surveyed by a registered land surveyor and mapped on
Jurisdictional Boundaries drawings (Sheets 1 -14) in Appendix III.
PROPOSED PROJECT IMPACTS
Wetland and stream impacts resulting from the proposed project are identified in the
respective tables located in Appendix IV. Project -wide, 0.572 acre of wetlands are
proposed to be temporarily- impacted during construction, and 0.990 acre of forested
wetlands are proposed to be converted to herbaceous wetlands. Approximately 9191f of
tributaries are planned to be temporarily- impacted by construction of the pipeline. These
proposed impacts consist of 3361f of natural stream channels and 5831f of jurisdictional
drainage ditches.
A majority of wetland impacts associated with the proposed project will result from
aboveground vegetation removal within the construction corridor, excavation of the
trench and temporary placement of the excavated material. Mechanized equipment will
need to access the corridor to remove felled timber, place timber mat where needed,
excavate the trench, install the pipe and restore the affected area. The project is proposed
to result in conversion of forested wetlands to herbaceous wetlands, but not result in a
loss of waters of the U.S.
Typical wetland crossing details are depicted on Sheet 14 of 14 in Appendix III.
Following construction, disturbed wetlands within the ROW will be restored to their
original grade and contour and seeded with a native wetland seed mix. Similarly,
temporarily affected stream channels will be returned to their pre- construction grade and
contour, seeded and stabilized with coir matting and woody vegetation.
PROTECTED SPECIES
To comply with applicable sections of the Endangered Species Act (ESA) of 1973 (16
USC 1531- 1543), S &ME submitted scoping letters to the North Carolina Natural
Heritage Program (NCNHP) and the U.S. Fish and Wildlife Service (USFWS) on March
22, 2012. The scoping packages included USGS topographic maps and aerial
photographs of the project route, and requested that each agency review records they may
have relating to rare, endangered, or threatened species, or high quality natural
communities within the vicinity of the project corridor, and provide comment.

The NCNHP responded with an April 2, 2012 letter stating that they had no records of
rare species, significant natural communities or significant natural heritage areas or
conservation /managed areas within one mile of the project route.
The USFWS responded with a May 4, 2012 letter in which they stated that the proposed
project was unlikely to affect federally - protected species, and that they believed the
requirements of Section 7(a) (2) of the ESA had been satisfied. The USFWS also stated
that they were concerned about potential impacts the project may have on aquatic species.
Accordingly, the USFWS recommended that directional boring be used at stream
crossings, and that stringent measures to control sediment and erosion should be
implemented.
Copies of the April 2, 2012 NCNHP and the May 4, 2012 USFWS correspondence letters
are included in Appendix V.
S &ME consulted the USFWS list of federally - protected species with documented
occurrences in Washington and Martin Counties, as summarized in Table 1 below:

Following project scoping and literature review, S &ME conducted field assessments for
the presence of federally- protected terrestrial species listed in Table 1. Descriptions of
the species and a summary of field review are provided below.
Sensitive Joint -vetch — Federally Threatened
Biological Conclusion: No Effect
This species is listed as a historic occurrence within Lenoir County, meaning it was last
sighted in the county over 50 years ago. Sensitive joint -vetch is a robust, bushy- branched
annual legume, usually between 20 -39 inches tall, but can grow to be taller. It is sensitive
to light and usually to touch. Stems are single and branch near the top. Leaves are
compound, divided pinnately into 30 -56 leaflets that are usually no longer than 0.4 inch
long, and 0.08 -0.12 inch wide, with toothed edges. Flowers grow in a long cluster with
each flower on its own short lateral stem.
Sensitive joint -vetch grows in the intertidal zone where plants are flooded twice daily.
The species prefers the marsh edge at an elevation near the upper limit of tidal
fluctuation. In North Carolina, sensitive joint -vetch appears to be a species that remains
at a particular site for a relatively short period of time, and maintains itself by colonizing
new, recently disturbed habitats where it may compete successfully among other early -
successional species. It is frequently found in the estuarine meander zone of tidal rivers
where sediments transported from upriver settle out and extensive marshes are formed.
The substrate may be sandy, muddy, gravelly, or peaty.

Habitat for sensitive joint -vetch was not observed within the project corridor during the
March 2012 field assessment. Accordingly, it is not likely that this species will be
affected as a result of the project.
Red - cockaded Woodpecker — Federally Listed Endangered
Biological Conclusion: No Effect
This species is listed as a historic occurrence within Lenoir County. Red - cockaded
woodpecker measures approximately seven inches long and has black and white
horizontal stripes on its back. The cheeks and underparts are white and the sides are
streaked in black. The cap and stripe on the throat and neck of the bird are black. Male
individuals of the species have a small red spot on each side of the black cap and display
a red crown patch after the first post - fledgling molt. The woodpecker's diet consists
primarily of insects.
Red - cockaded woodpecker's range is closely linked to the distribution of mature stands
of southern pines. Longleaf and loblolly pines that are 60 years old or greater are most
commonly selected for nesting and roosting trees. The woodpecker excavates nest and
roost cavities in trees that are stressed, and often are infected with red -heart rot fungus.
Preferred nesting sites generally include relatively open, park -like, mature pine stands
with a suppressed mid -story layer. Suppression of the mid -story by fire or mechanical
means in mature pine stands promotes colonization by the red - cockaded woodpecker.
Foraging habitat is frequently limited to pine or pine - hardwood stands that are 30 years
old or greater with a preference for pine trees with a diameter of 10 inches or larger.
Dense hardwood mid -story hampers foraging by red - cockaded woodpecker and increases
the occurrence of cavity competitors. The USFWS indicates that the maximum foraging
radius from a colony site for red - cockaded woodpecker's is typically one -half mile or
less.
The project corridor was visually assessed for the presence of potential red - cockaded
woodpecker foraging and nesting habitat during the March 2012 field review. Because
the project corridor is located in areas that are highly agricultural, no stands of pine were
observed that were mature enough to contain suitable nesting or foraging habitat for the
red - cockaded woodpecker. Therefore, it is not likely that the red - cockaded woodpecker
or potential habitat will be disturbed as a result of this project.
Bald Eagle — Bald and Golden Eagle Protection Act
Biological Conclusion: No Effect
The bald eagle is a large raptor with a wingspan of approximately seven feet (2.1 meters).
Adult individuals of this species have a mainly dark brown plumage with a solid white
head and tail. Bald eagles develop adult plumage in the fifth or sixth year. Juveniles of
the species exhibit a chocolate brown to blackish plumage with occasional occurrences of
white mottling on the tail, belly, and under - wings. Bald eagle's primary diet consists of
fish. However, it will feed on birds, mammals, and turtles when fish are not available.
Bald eagles are associated with coasts, rivers, and lakes, usually nesting near large bodies
of water where it feeds. Nesting habitat in the Carolinas usually occurs in large pine trees
along the edge of large bodies of water. Bald eagle is listed as a current record for Lenior

County. The project corridor is not located proximate to large bodies of water.
Additionally, no bald eagle nests were observed within visible proximity of the project
corridor by S &ME personnel during the March 2012 site visit. Accordingly, it is unlikely
that bald eagle will be adversely affected by this project.
HISTORIC AND ARCHAEOLOGICAL RESOURCES
In response to a scoping letter and project location maps submitted by S &ME on March
22, 2012, the North Carolina State Historic Preservation Office (SHPO) responded with
an April 13, 2012 letter stating that they had conducted a review of the proposed project
area and were aware of no historic resources that would be affected as a result.
Accordingly, the SHPO had no further comment on the project. A copy of the April 13,
2012 SHPO letter is included in Appendix V.
AVOIDANCE AND MINIMIZATION
To minimize impacts to waters of the U.S. and limit habitat fragmentation, PNG has
proposed to install the new gas pipeline parallel to the existing, maintained ROW.
Impacts to Stonyton Creek and Briery Run are proposed to be avoided by installing the
pipe via trenchless methods. Wetland impact minimization during construction is
proposed through the use of equipment mats and trench plugs to prevent alterations to
wetland hydrology.
Additionally, construction equipment operating within wetlands are planned to be limited
to that necessary for clearing, excavation, pipe installation and restoration activities.
Wetland vegetation outside of the trench line is proposed to be cut at ground level,
leaving existing root systems in place to promote re- growth. To the extent practicable,
wetland topsoil is proposed to be segregated from the underlying subsoil in areas
disturbed by trenching, except in areas with standing water or saturated soils, or where no
topsoil is evident. Within wetlands, yearly vegetation maintenance is planned to be
limited to a 30 -foot permanent maintenance corridor.
ADDITIONAL REGULATORY CONSIDERATIONS
Neuse River Riparian Buffer Rules
The project is subject to the Neuse River riparian buffer rules. The proposed project is
proposed to impact 12,114 sf of Zone 1 buffer and 8,161 sf of Zone 2 buffer. Although a
majority of the impacts are temporary, 2,648 sf of currently wooded buffer will be
permanently- maintained as grassed ROW.
To determine the project's applicability to the buffer rules, S &ME reviewed the project
corridor with NCDWQ (Anthony Scarborough) on April 12, 2012. NCDWQ provided an
April 13, 2012 letter confirming the features within the project corridor that were subject
to the buffer rules. NCDWQ also stated that the proposed pipeline crossing is considered
"allowable" with written authorization from NCDWQ, and compliance with applicable
best management practices (BMPs). A copy of NCDWQ's letter is included in
Appendix V.

Sediment and Erosion Control
Appropriate sediment and erosion control practices outlined in the most recent version of
the "North Carolina Sediment and Erosion Control Planning and Design Manual" and
approved by the local governing authority shall be in compliance with specifications
governing the proper design, installation, operation and maintenance of such BMPs to
comply with the appropriate turbidity water quality standard.
MITIGATION
The project is proposed to result in conversion of 0.990 acre of forested wetlands to
herbaceous wetlands. Approximately 0.27 acre of the conversion impacts are to non -
riparian wetlands, while the remaining 0.72 acre will be to riparian wetlands. PNG
proposes to satisfy its mitigation requirement by purchasing the necessary credit within
the Neuse River Basin (HUC 03020202) from a combination of available private banks
and the North Carolina Ecosystem Enhancement Program (NCEEP). Accordingly, 0.27
acre of non - riparian wetland credit are planned for purchase from EBX Neuse-I, LLC,
and 0.75 acre of riparian wetland credit from the NCEEP. With respect to riparian buffer
mitigation, PNG is required to purchase 2,286 credits (see Riparian Buffer Impact Table
in Appendix IV). They propose to purchase the necessary credit from Flat Swamp
Mitigation Bank.
Letters from the respective providers are included in Appendix VI.
Mitigation for wetland impacts that do not exceed one acre is not required by NCDWQ,
and because the project as proposed will not result in permanent stream impacts, thus
stream mitigation is not required.
Mitigation has also been provided by avoidance and minimization procedures
implemented during the design phase of the proposed project. Impacts will be minimized
by: 1) paralleling an existing, maintained ROW where possible; 2) use of trenchless pipe
installation; and 3) reducing the width of the permanent maintenance corridor to 30 feet.
As proposed, the project will comply with applicable conditions of NWP No. 12 and
WQC No. 3884. The width of the permanently- maintained ROW will not exceed 30 feet
in wetlands and at stream crossings. The proposed alignment also makes use of existing,
maintained areas to the extent practicable. Following construction, affected jurisdictional
areas are scheduled to be restored to its original grade and contour. As proposed, the
project will not result in permanent changes in pre- construction elevation contours or
affect dimension, pattern or profile of affected streams. Cleared areas are proposed to be
restored in accordance with the attached Restoration Plan (Appendix VI) following
completion of the work.
SECONDARY AND CUMULATIVE IMPACTS
The primary purpose of the project is to replace an aging segment of natural gas pipeline.
Accordingly, the project is not considered growth- inducing and is not intended to serve as
an impetus for expansion of development, and should not result in secondary impacts, or
contribute to cumulative impacts.

Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
Land use in the vicinity of the project corridor consists primarily of a mix of agricultural and residential areas, forest,
roadside, open or other disturbed and /or maintained areas. The proposed right -of -way (ROW) passes through several
forested wetland areas and multiple stream channels. The proposed ROW will abut an existing gasline easement.

The purpose of the proposed project is to replace an aging segment of existing natural gas transmission line with a new
pipeline that is compatible with current safety and inspection requirements. The existing pipeline was constructed in the
1950s, and since that time, better construction materials and technology to facilitate inspection and assessment of
pipeline safety and integrity have become available.

Describe the overall project in detail, including the type of equipment to be used:
Replacement of existing gas line will involve abandonment of the old 4 -inch line and replacement with a new 6 -inch line.
In upland areas, the old pipe will be excavated, and the new pipeline placed parallel to the existing natural gas pipeline
right -of -way (ROW) within a new 20 -foot wide ROW. Based on conditions, an additional 10 -to -20 feet of temporary work
space (TWS) will be necessary through wetland area to install the pipe. The total disturbance width will not exceed 40
feet at wetland and stream crossings, and the TWS will be sited within the existing ROW. The pipe will be installed
beneath Stonyton Creek and Briery Run and their adjacent wetlands via trenchless methods. To further minimize
disturbance to jurisdictional areas, PNG plans to leave the abandoned pipeline in place through wetland areas. Following
construction, 10 feet of the existing ROW will continue to be maintained through wetland areas, along with the new 20-
foot wide ROW, for a permanent maintained width of 30 feet. Affected portions of the old ROW and TWS located in
wetlands shall be restored and allowed to naturally regenerate.

In March 2012, S &ME conducted a pedestrian review of the proposed project corridor to delineate jurisdictional surface
waters located therein. S &ME followed the procedures set forth in the 1987 US Army Corps of Engineers Wetlands
Delineation Manual and the Atlantic and Gulf Coastal Plain Region Supplemental Guidance. Field conditions were
documented using USACE Routine Wetland Determination Data Forms, as appropriate. The field review also included
identification of tributaries (streams or ditches ) within the project corridor. Drainage features identified during the field
review were assessed to determine the jurisdictional status of the tributary. Drainage features were classified as either
non - jurisdictional or jurisdictional. S &ME used the NCDWO Stream Classification Form to document characteristics of
identified drainage features on the day of the assessment.
Field review identified multiple regulated surface waters, including Stoneyton Creek and Briery Run, eight other natural
stream channels, nine wetland areas and five non - stream tributaries. Limits of the jurisdictional features were delineated
by S &ME and subsequently identified with a Trimble global - positioning system (GPS) unit capable of sub -meter accuracy.
Results of S &ME's assessment were included in a Request for Jurisdictional Determination package and submitted to the
USACE on April 10, 2012. The delineated boundaries were surveyed by a registered land surveyor and mapped on
Jurisdictional Boundaries drawings (Sheets 1 -14) in Appendix III.

Instllation of the new pipe adajcent to an existing ROW will reduce habitat fragmentation. Impacts to Stonyton Creek and
Briery Run, along with their adjacent wetlands, will be avoided by installing the pipe via HDD methods.

The width of the permanently- maintained ROW will be reduced to 30 feet within wetlands and at stream crossings.
Construction equipment operating within wetlands will be limited to that necessary for clearing, excavation, pipe installation
and restoration activities. Wetland vegetation outside of the trench line will be cut at ground level, leaving existing root
systems in place to promote re- growth. To the extent practicable, wetland topsoil will be segregated from the underlying
subsoil in areas disturbed by trenching, except in areas with standing water or saturated soils, or where no topsoil is evident.

To comply with applicable sections of the Endangered Species Act (ESA) of 1973 (16 USC 1531 - 1543), S &ME submitted
scoping letters to the North Carolina Natural Heritage Program ( NCNHP) and the U.S. Fish and Wildlife Service ( USFWS)
on March 22, 2012. The scoping packages included USGS topographic maps and aerial photographs of the project
route, and requested that each agency review records they may have relating to rare, endangered, or threatened species,
or high quality natural communities within the vicinity of the project corridor, and provide comment.
The NCNHP responded with an April 2, 2012 letter stating that they had no records of rare species, significant natural
communities or significant natural heritage areas or conservation /managed areas within one mile of the project route.
The USFWS responded with a May 4, 2012 letter in which they stated that the proposed project was unlikely to affect
federally - protected species, and that they believed the requirements of Section 7(a) (2) of the ESA had been satisfied.
The USFWS also stated that they were concerned about potential impacts the project may have on aquatic species.
Accordingly, the USFWS recommended that directional boring be used at stream crossings, and that stringent measures
to control sediment and erosion should be implemented.
Copies of the April 2, 2012 NCNHP and the May 4, 2012 USFWS correspondence letters are included in Appendix V.

Accordingly, the SHPO had no further comment on the project. A copy of the April 13, 2012 SHPO letter is included in
Appendix V.

This letter is to inform you that a list of all federally - protected endangered and threatened species
with known occurrences in North Carolina is now available on the U.S. Fish and Wildlife
Service's (Service) web page at http: / /www.fws.gov /raleigh. Therefore, if you have projects that
occur, within the Raleigh Field Office's area of responsibility (see attached county list), you no
longer deed to contact the Raleigh Field Office for a list of federally- protected species.
Our web page contains a complete and frequently updated list of all endangered and threatened
species protected by the provisions of the Endangered Species Act of 1973, as amended (16
U.S.C. 1531 et seq.)(Act), and a list of federal species of concern' that are lalown to occur in
each county in North Carolina.
Section 7 of the Act requires that all federal agencies (or their designated non - federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally- listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in detennining whether additional consultation with the
Service is necessary. In addition to the federally- protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or
evaluation and can be found on our web page at http: / /www.fws.gov /raleigh. Please check the
web site often for updated information or changes.
1 The term "federal species of concern" refers to those species which the Service believes might be in need of
concentrated conservation actions. Federal species of concern receive no legal protection and their designation does
not necessarily imply that the species will eventually be proposed for listing as a federally endangered or-threatened
species. However, we recommend that all practicable measures be taken to avoid or minimize adverse impacts to
federal species of concern.
If your project contains suitable habitat for any of the federally- listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally - protected species, you should notify this office with your
detennination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
With regard to the above - referenced project, we offer the following remarks. Our comments are
submitted pursuant to, and in accordance with, provisions of the Endangered Species Act.
Based on the information provided and other information available, it appears that the proposed
action is not likely to adversely affect any federally- listed endangered or threatened species, their
formally designated critical habitat, or species currently proposed for listing under the Act at
these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for
your project. Please remember that obligations under section 7 consultation must be
reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered; (2) this action is
subsequently modified in a manner that was not considered in this review; or, (3) a new species
is listed or critical habitat deternnined that may be affected by the identified action.
However, the Service is concerned about the potential impacts the proposed action might have
on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we
recommend that all practicable measures be taken to avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and sedimentation control plan should be submitted to and approved by
the North Carolina Division of Land Resources, Land Quality Section prior to constriction.
Erosion and sedimentation controls should be installed and maintained between the construction
site and any nearby down - gradient surface waters. In addition, we recommend maintaining
natural, vegetated buffers on all streams and creeks adjacent to the project site.
The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a
copy can be found on our website at (http: / /www.fws.gov /raleigh) to address and mitigate
secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality.
We recommend that you consider this document in the development of your projects and in
completing an initiation package for consultation (if necessary).

Dear Mr. Vena:
On April 12, 2012, at your request Anthony Scarbraugh conducted an on -site determinations to
review features known as Briery Run, Stonyton Creek and unnamed tributaries (UTs) to Jericho
Run, Briery Run and Stonyton Creek located on the subject property for applicability to the
Neuse Buffer Rules (15A NCAC 2B .0233). The features are labeled as "12 -0304 A through J" on
the attached maps initialed by Mr. Scarbraugh on April 13, 2012. The project is located
approximately 0.50 miles northwest of the intersection of NC Highway 11 and SR 1745
(Cunningham Road) in Lenoir County, NC.
At your request, Mr. Scarbraugh conducted on -site determinations as stated above. During his
review, he evaluated the streams using the DWQ Stream Classification Form. He evaluated the
stream reaches 12 -0304 A at N 35.29429, W 77.55534, 12 -0304 B at N 35.29525 N, W 77.55431,
12 -0304 F at N 35.30910 N, W 77.53719, 12 -0304 G at N 35.31055 N, W 77.53525 and 12 -0304 l
at N 35.31511 N, W 77.53151 and calculated the respective scores to be 32.25, 195, 38.5, 13.5
37.75 points. The form states that if the score is "greater than or equal to 19 points the stream
is at least intermittent ". He evaluated the stream reaches 12 -0304 C at N 35.29867 N, W
77.55009 , 12 -0304 D at N 35.30150, W 77.54630, 12 -0304 E at N 35.30378, W 77.54462, 12-
0304 H at N 35.31272, W 77.53201 and 12 -0304) at N 35.31511, W 77.53151 and found
evidence that this is a man -made feature not constructed for the purposes of navigational

Kinston Line 25A Transmission Gas Line
Lenoir County, North Carolina
The proposed project has been designed to avoid and minimize jurisdictional impacts
where practicable. As part of mitigation for unavoidable impacts, the following plan is
proposed for implementation to restore temporarily- affected wetlands and streams. This
plan entails restoration of temporarily- disturbed areas to their original contours and
conditions to the degree practicable upon project completion. Further, it specifies that
disturbed wetland areas and streambanks will be permanently stabilized with a native
vegetative cover, and affected streambanks planted with woody species. The measures
outlined below will be specified in the contract documents prepared for construction of
the proposed project.
Proposed restoration activities include removal of temporarily - placed fill material and
restoration of original pre- disturbance contours. Excavated material shall be returned to
the trench to the extent possible, and remaining material relocated and retained on an
upland site. Excavated topsoil shall be stockpiled separately and then replaced uniformly
over the area of excavation from which it was removed. The native seed mix identified in
Table 1 below shall be utilized within temporarily- disturbed portions of the corridor
comprised of wetlands.

Additionally, affected banks of stream crossings shall be stabilized with coir matting and
revegetated using native woody species. In the event that restoration of the temporarily -
impacted streams occurs during the dormant season, woody plantings will likely consist of a
combination of live stake and bare root species (Table 3). In the event that restoration takes
place during the growing season, supplemental plantings should likely consist of
containerized species (Table 4).

Please be advised that the Flat Swamp Bank, LLC (Banker) has reserved 2, 286 square feet of
Neuse riparian buffer (NRB) credits for a period of no longer than ninety (90) days from the date
of this correspondence for your project referenced above.
Prior to entering into a contract to purchase the above referenced NRB credits, the banker will
require written correspondence from Mr. Stephen W. Miller, Water Resources Manger with the
City of Kinston and the U. S. Army Corps of Engineers Project Manager, assigned to process your
permit application, confirming the exact amount of NRB credits your project will require.
Upon receipt of the conformation letters, the Banker will provide your client a Purchase
Agreement of the amount of NRB credits required. Upon the execution of the Purchase
Agreement by your client and the Banker and payment in full has been received, the Banker shall
make a written request to Ms. Katie Merritt with the NCDWQ, Raleigh Office, to withdraw the
required amount of NRB credits from the Banks Ledger and copy all parties concerned of the
withdraw request. Upon receipt of the withdraw request approval by the NCDWQ, the Banker
shall forward copies of the withdraw approval to all parties concerned.

AGREEMENT
1. Authorization to Sell Credits: Seller is the Bank Sponsor of the Neu -Con Wetland and Stream
Umbrella Mitigation Bank (the "Bank "). As the Bank Sponsor, Seller is authorized by the North
Carolina Interagency Review Team ("NC IRT ") to sell non - riparian wetland mitigation credits to
purchasers who are required, as a condition to obtaining approvals granted by the US Army Corps
of Engineers ( "US ACOE "), to mitigate the environmental impact of projects that they undertake.
Purchase and Sale of Credits. Purchaser hereby agrees to purchase 0.27 Non - Riparian Wetland
Mitigation Credits ( "Credits ") from Seller, and Seller hereby agrees to sell the Credits to
Purchaser.
3. Purchase Price. The purchase price of the Credits is $22,500.00 per Credit for a total price of
$6,075.00.
Closing on the Sale of Credits. The purchase price of the Credits shall be paid by Purchaser to
Seller at closing, by certified check or wire transfer, against delivery by Seller to NC IRT of an
Affidavit of Credit Purchase in a form acceptable to the NC IRT. Closing of the sale of the
Credits shall occur within thirty days of the Purchase Date or Seller's obligation to sell the
Credits to the Purchaser shall automatically terminate (provided, however, such thirty day period
may be extended by the mutual written agreement of the Purchaser and Seller).
5. Purchaser's Right to Terminate. Purchaser may terminate this Agreement at any time within thirty
days of the Purchase Date by written notice to Seller if US ACOE or any other relevant
government agency does not require the purchase of any Credits as a condition to issuing any of
the permits or approvals necessary for the Project. Purchaser agrees to notify Seller promptly if
Purchaser becomes aware that Purchaser will not be required to purchase the Credits under this
Agreement so that Seller can offer the Credits to other parties.
6. Miscellaneous.
(a) Attorneys' Fees, etc. In the event of any litigation between Seller and Purchaser
arising out of this Agreement, the prevailing party shall be entitled to an award of its reasonable costs and
expenses incurred in such litigation, including court costs and reasonable attorneys' fees.
(b) Notices. All notices under this Agreement must be in writing and must be
personally delivered or sent by commercial or overnight courier or by mail to the notice address set forth
below (or such other address notice of which has been given in accordance with this subsection).
(c) Entire Agreement, Modifications. There are no other agreements or
understandings, written or oral, between the parties regarding the subject matter of this Agreement. This
Agreement may not be modified or amended except by a written document executed by both parties.
(d) Assignment. Either party may assign this Agreement or any of its rights
hereunder, but no assignment shall relieve the assigning party of its obligations hereunder unless the other
party expressly agrees thereto in writing.
(e) Governing Law. The validity, interpretation and performance The validity, interpretation and performance of this Agreement
shall be governed by and construed in accordance with the laws of the State of North Carolina, without
regard to its conflict of laws principles.
(f) Counterparts. This Agreement may be executed in counterparts. A counterpart
signature page transmitted by fax or other electronic means shall be effective as an original.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comply with all other state federal or local government permits, regulations or authorizations associated
with the proposed activity including SL 2009 -337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L. 2011 -343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required for this impact is determined by permitting agencies.
Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. The mitigation will be performed in
accordance with the N.C. Department of Environment and Natural Resources' Ecosystem Enhancement Program In -Lieu Fee
Instrument dated July 28, 2010.
