(S &ME) is submitting this application for impacts to waters of the U.S. in accordance with Nationwide Permit (NWP) No. 12 and the corresponding North Carolina Water Quality Certification (WQC) No. 3884. Our services were performed for PNG in accordance with our Master Services Agreement (1357- 18259 -07) dated October 1, 2008. PNG, the project sponsor, will be considered the applicant. Written concurrence from the North Carolina Division of Water Quality (NCDWQ) is also required because the proposed project will require permanently- maintained rights - of -way (ROW) that exceed 15 feet in width through some jurisdictional wetlands. To meet their operational requirements, PNG is requesting an additional 25 feet in these areas for a total maintained width of 40 feet. This width required to support: 1) leakage surveys from ground mobile units or aerial technology; 2) aerial patrolling for possible encroachment activity near the pipeline; 3) aid in identification of possible repairs and maintenance; 4) promotion of damage prevention in that the ROW can be more easily identified by the public; 5) minimization of potential canopy encroachment, which creates visibility concerns, and; 6) minimum turn - around requirements for mechanized mowing and side - trimming equipment. The general WQC includes an exemption for natural gas pipelines, provided that mitigation is offered for wetlands fills associated with the additional maintained width. Please note, however, that the additional ROW required by PNG will not involve permanent placement of fill material, and as such, mitigation is not required by NCDWQ. A copy of the completed PCN and Agent Authorization Form is included in Appendix I. GENERAL PROJECT INFORMATION PNG is planning to construct approximately 1.5 miles of 4 -inch transmission line and approximately 2.5 miles of 6 -inch distribution line in Windsor, Bertie County, North Carolina. The proposed transmission pipeline will originate near the junction of U.S. Highway 17 Bypass and U.S. Highway 13 Bypass (35.986205, - 76.958558), and extend northeast to Elm Street, where a meter station will be constructed. The proposed distribution line will originate at the meter station and extend northeast along N.C. Highway 308, then parallel Cooper Hill Road to the southeast and terminate at the Bertie County Prison (35.971905, - 76.908925). The purpose of the work is to supply natural gas to the correctional facility. The pipeline will be installed within a new ROW that parallels existing roadways for a majority of its length. Portions of the pipeline will also pass through farm field and forested areas, and will be installed beneath Broad Creek (S 1) and the Cashie River via horizontal directional drill (HDD). Although portions of the forested area consist of jurisdictional wetlands, there are no tidally- influenced wetlands within the proposed route. In portions of the proposed transmission line that are located in wetlands, the width of the disturbed area will range from 40 feet to 10 feet. The project will not result in a loss of waters of the U.S., but 1.24 acres of wetlands will be temporarily disturbed, and 0.71 acre of forested wetlands will be converted to herbaceous wetlands. EXISTING ENVIRONMENT Land use in the vicinity of the project corridor consists primarily of a mix of forest, roadside, agricultural land and scattered commercial and residential areas and open or otherwise disturbed and /or maintained areas. The proposed pipeline is located in the Coastal Plain physiographic province in the Roanoke River Basin (HUC 03010107), and crosses Broad Creek (C, Sw) and the Cashie River (C, Sw). 2 Pre - Construction Notification S &ME Project No. 1357 -11 -028 PNG Bertie Prison E2 -4 Line April 30, 2012 With respect to vegetation, commonly observed species within the wooded portions of the project corridor included red maple (Acer rubrum), water oak (Quercus nigra), white oak (Q. alba), American beech (Fagus grandifolia), sweetgum (Liquidambar styraciflua) and loblolly pine (Pinus taeda) in the canopy. Subcanopy species included Chinese privet (Ligustrum sinense), wax myrtle (Myrica cerifera), red bay (Persea borbnia) and ironwood (Carpinus caroliniana). Vegetation observed in the wetland areas adjacent to Cashie River included swamp blackgum (Nyssa sylvatica v. biflora), bald cypress (Taxodium distichum), red bay, willow oak (Q. phellos), giant cane (Arundinaria gigantia), and soft rush (Juncus effusus). Photos of the project corridor are included in Appendix II. DESCRIPTION OF THE PROPOSED WORK Construction of the new pipeline will first involve identification of the clearing limits, followed by aboveground removal of woody vegetation from the proposed ROW by mechanical means or hand - clearing, as appropriate. Efforts will be made to remove surface vegetation in a manner that minimizes disturbance of the forest floor, and prevents exposure of soil. Temporary equipment crossings may be installed along one side of the ROW to facilitate equipment passage and prevent excessive rutting and ground disturbance in the wetlands. Appropriate sediment and erosion control measures will be installed to prevent sedimentation of jurisdictional features as a result of construction. Streambank vegetation within the corridor will be hand cleared, and introduction of logging debris into the creek will be avoided to the extent practicable. Equipment crossings of Broad Creek and Cashie River are not required, as the pipe will be installed beneath the waterbodies via HDD. Workspace for the HDD setups will be sited in high ground, and the pipe will be installed beneath the bed of the subject waterbodies. Conventional pipe installation (trenching) will be required at the jurisdictional drainage ditches and remaining wetland areas. Where the pipe will be installed conventionally, grubbing will be limited to the trenchline. Select portions of the ROW may require rough grading to facilitate safe passage of equipment, and to prepare a suitably -level work surface. Appropriate sediment and erosion control measures will be installed following initial soil disturbance as the project progresses. Within the wetland area, timber mats will be employed in areas where significant rutting or soil mixing is likely to occur. During construction, the pipe will be strung and placed on skids (wooden pedestals) along the ROW. Specialized machines will be used to bend individual segments of pipe to fit the contours of the trench where necessary. The pipe segments will be welded together, inspected for structural integrity, and then lowered into the trench. In areas where segregation of the subsoil and topsoil is required (wetlands where the pipe will be installed conventionally), the topsoil will be replaced last. Affected areas will then be "cleaned up" by rough - grading and application of temporary seeding (if necessary), followed by final grading, permanent seeding and mulching to restore the ROW as 3 Pre - Construction Notification S &ME Project No. 1357 -11 -028 PNG Bertie Prison E2 -4 Line April 30, 2012 closely as possible to pre- disturbance contours and conditions. Areas within wetlands that are disturbed will be seeded with a customized wetland seed mix. JURISDICTIONAL AREAS In December, 2011 S &ME conducted a pedestrian review of the proposed project corridor to delineate jurisdictional surface waters located therein. S &ME followed the procedures set forth in the 1987 US Army Corps of Engineers Wetlands Delineation Manual and the Atlantic and Gulf Coastal Plain Region Supplemental Guidance. Field conditions were documented using USACE Routine Wetland Determination Data Forms, as appropriate. The field review also included identification of tributaries (streams) within the project corridor. Drainage features identified during the field review were assessed to determine the jurisdictional status of the tributary. Drainage features were classified as either non - jurisdictional or jurisdictional. S &ME used the NCDWQ Stream Classification Form to document characteristics of identified drainage features on the day of the assessment. Field review identified multiple jurisdictional surface waters, including the Cashie River, Broad Creek (S 1), five wetland areas, four non - stream tributaries (jurisdictional drainage ditches) that exhibited an ordinary high water mark or otherwise extended the reach of the regulated water to which they flow, and one open -water pond. Limits of the jurisdictional features were delineated by S &ME and subsequently identified with a Trimble global - positioning system (GPS) unit capable of sub -meter accuracy. Results of S &ME's assessment were included in a Request for Jurisdictional Determination package and submitted to the USACE on February 1, 2012. Following an alignment shift, S &ME personnel returned to the site on March 7, 2012 to delineate features located within the route, and subsequently provided the USACE with an updated Request for JD package on March 16, 2012. The USACE (Josh Pelletier) visited the site on March 21, 2012, and confirmed the delineated boundaries. The delineated boundaries were surveyed by a registered land surveyor and mapped on Jurisdictional Boundaries drawings (Sheets 1 -10) in Appendix 111. PROPOSED PROJECT IMPACTS Wetland and stream impacts resulting from the proposed project are identified in the respective tables located in Appendix IV. Project -wide, construction of the pipeline will temporarily impact 1.24 acres of wetlands, and 0.71 acre of forested wetlands will be converted to herbaceous wetlands. There will be no loss of waters of the U.S. A majority of wetland impacts associated with the proposed project will result from aboveground vegetation removal within a 40 -foot wide permanent maintenance corridor, excavation of the trench and temporary placement of the excavated material. Mechanized equipment will need to access the corridor to remove felled timber, place timber mats where needed, excavate the trench, install the pipe, and restore the affected area. 4 Pre - Construction Notification S &ME Project No. 1357 -11 -028 PNG Bertie Prison E2 -4 Line April 30, 2012 Typical wetland crossing details are depicted on Sheet 10 of 10 in Appendix 111. Following construction, disturbed wetlands within the ROW will be restored to their original grade and contour and seeded with a native wetland seed mix. PROTECTED SPECIES To comply with applicable sections of the Endangered Species Act (ESA) of 1973 (16 USC 1531- 1543), S &ME submitted scoping letters to the North Carolina Natural Heritage Program ( NCNHP) and the U.S. Fish and Wildlife Service ( USFWS) on October 19, 2011. The scoping packages included USGS topographic maps and aerial photographs of the project route, and requested that each agency review records they may have relating to rare, endangered, or threatened species, or high quality natural communities within the vicinity of the project corridor, and provide comment. The NCNHP responded with a November 16, 2011 letter that identified a nearby natural area (the Bertie County Game Land) managed by the North Carolina Wildlife Resources Commission ( NCWRC). The NCNHP also identified a Dedicated State Nature Preserve, the Cashie River floodplain, as part of the same game land. Although the project is not routed through either area, the NCNHP recommended that the NCWRC be contacted for comment. Accordingly, S &ME contacted Mr. Dale Davis of the NCWRC's Edenton Depot on November 21, 2011 and informed him of the proposed project. Mr. Davis asked that we provide him maps of the proposed route for his review and he would provide comment if necessary. S &ME provided Mr. Davis with the project scoping information and maps on November 22, 2011. To date, the NCWRC has not provided comment on the project. The USFWS responded with a February 16, 2012 letter in which they stated that the proposed project was unlikely to affect federally - protected species, and that they believed the requirements of Section 7(a) (2) of the ESA had been satisfied. The USFWS also stated that they were concerned about potential impacts the project may have on aquatic species. Accordingly, the USFWS recommended that directional boring be used at stream crossings, and that stringent measures to control sediment and erosion should be implemented. Copies of the November 16, 2011 NCNHP and the February 16, 2012 USFWS correspondence letters are included in Appendix V. S &ME did not conduct sampling for aquatic species (shortnose sturgeon) during field review. Descriptions of the species occurring in Bertie County and a summary of field review for the species are provided below. Shortnose Sturgeon Biological Conclusion: No Effect Shortnose sturgeon is a large fish that is generally around three feet in length at maturity with five rows of spines extending its length from head to tail. Coloring is dark on the back and spines, and lighter on the belly. The shortnose sturgeon has a short, pointed snout and a downward - facing mouth. Shortnose sturgeon is generally found in the ocean and brackish waters along the Atlantic Coast and upstream into the lower ends of larger rivers where water moves slowly, sometimes moving into faster moving freshwaters upstream to spawn. Construction of dams and pollution are the main threats, along with dredging or disposal of dredge material into habitat. The proposed pipeline will cross the Cashie River, which may provide marginally - suitable habitat for shortnose sturgeon. However, impacts to the river or its adjacent floodplain will not occur as a result of trench excavation or pipe placement. The pipeline will cross beneath the river by HDD, with entry and exit points established in high ground areas outside of adjacent wetlands. Accordingly, adverse effects to shortnose sturgeon or its habitat are not anticipated. Bald Eagle — Bald and Golden Eagle Protection Act Biological Conclusion: No Effect Bald eagle is a large raptor with a wingspan of approximately seven feet (2.1 meters). Adult individuals of this species have a mainly dark brown plumage with a solid white head and tail. Bald eagles develop adult plumage in the fifth or sixth year. Juveniles of the species exhibit a chocolate brown to blackish plumage with occasional occurrences of white mottling on the tail, belly, and under - wings. Bald eagle's primary diet consists of fish. However, it will feed on birds, mammals, and turtles when fish are not available. Bald eagle is associated with coasts, rivers, and lakes, usually nesting near large bodies of water where it feeds. Nesting habitat in the Carolinas usually occurs in large pine trees along the edge of large bodies of water. Bald eagle is listed as a current record for Bertie County. The project corridor was assessed for the presence of bald eagle nests and other similar avian nests. While large trees are present along both sides of the Cashie River, no bald eagle nests were identified within visible proximity of the project corridor. Further, the proposed project is not expected to impact large bodies of water. Accordingly, it is unlikely that bald eagle will be adversely affected by this project. M Pre - Construction Notification S &ME Project No. 1357 -11 -028 PNG Bertie Prison E2 -4 Line April 30, 2012 Red - cockaded Woodpecker — Federally Listed Endangered Biological Conclusion: No Effect Red - cockaded woodpecker measures approximately seven inches long and has black and white horizontal stripes on its back. The cheeks and under -parts are white and the sides are streaked in black. The cap and stripe on the throat and neck of the bird are black. Male individuals of the species have a small red spot on each side of the black cap and display a red crown patch after the first post - fledgling molt. The woodpecker's diet consists primarily of insects. Red - cockaded woodpecker's range is closely linked to the distribution of mature stands of southern pines. Longleaf and loblolly pines that are 60 years old or greater are most commonly selected for nesting and roosting trees. The woodpecker excavates nest and roost cavities in trees that are stressed, and often are infected with red -heart rot fungus. Preferred nesting sites generally include relatively open, park -like, mature pine stands with a suppressed mid -story layer. Suppression of the mid -story by fire or mechanical means in mature pine stands promotes colonization by the red - cockaded woodpecker. Foraging habitat is frequently limited to pine or pine - hardwood stands that are 30 years old or greater with a preference for pine trees with a diameter of 10 inches or larger. Dense hardwood mid -story hampers foraging by red - cockaded woodpecker and increases the occurrence of cavity competitors. The USFWS indicates that the maximum foraging radius from a colony site of the red - cockaded woodpecker is typically one -half mile or less. The project corridor was visually assessed for the presence of potential red - cockaded woodpecker foraging and nesting habitat during field review. No pine stands of size or maturity sufficient to provide suitable nesting or foraging habitat for the red - cockaded woodpecker were identified. Therefore, it is not likely that the red - cockaded woodpecker or potential habitat will be disturbed as a result of this project. HISTORIC AND ARCHAEOLOGICAL RESOURCES In response to a scoping letter and project location maps submitted by S &ME on October 19, 2011, the North Carolina State Historic Preservation Office (SHPO) responded with a November 10, 2011 letter stating that they had conducted a review of the proposed project area and were aware of no historic resources that would be affected as a result. Accordingly, the SHPO had no further comment on the project. A copy of the November 10, 2011 SHPO letter is included in Appendix V. AVOIDANCE AND MINIMIZATION To minimize impacts to waters of the U.S. and limit habitat fragmentation, PNG has proposed to install the new gas pipeline paralleling existing, maintained roadway where possible. Impacts to the Cashie River and Broad Creek will be avoided by installing the pipe via trenchless methods. Wetland impacts will also be minimized during construction through the use of equipment mats and trench plugs to prevent alterations to wetland hydrology. 7 Pre - Construction Notification S &ME Project No. 1357 -11 -028 PNG Bertie Prison E2 -4 Line April 30, 2012 Additionally, construction equipment operating within wetlands will be limited to that necessary for clearing, excavation, pipe installation and restoration activities. Wetland vegetation outside of the trench line will be cut at ground level, leaving existing root systems in place to promote re- growth. To the extent practicable, wetland topsoil will be segregated from the underlying subsoil in areas disturbed by trenching, except in areas with standing water or saturated soils, or where no topsoil is evident. Within wetlands, yearly vegetation maintenance will be conducted within a 40 -foot corridor. ADDITIONAL REGULATORY CONSIDERATIONS Coastal Area Management Act The project will not affect coastal wetlands, but will cross beneath a tidally- influenced waterway (Cashie River). As such, the project will require authorization under the Coastal Area Management Act (LAMA). The NCDCM reviewed the proposed project site on March 5, 2012 and determined that a CAMA General Permit will be required. S &ME has begun the CAMA permitting process, and understands that the project cannot commence until it has been granted. Section 10 Permit Because the pipeline will be installed beneath a navigable waterway (Cashie River), the project will also require authorization from the USACE under Section 10 of the Rivers and Harbors Act. The proposed project will not affect the Cashie River, as the pipe will be installed beneath the waterway via HDD (see HDD Crossing Plan and profile Drawings in Appendix 111). Sediment and Erosion Control Appropriate sediment and erosion control practices outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" and approved by the local governing authority shall be in compliance with specifications governing the proper design, installation, operation and maintenance of such BMPs to comply with the appropriate turbidity water quality standard. MITIGATION The project will not result in a loss of waters of the U.S. However, the USACE requires mitigation to compensate for conversion of forested wetlands to herbaceous wetlands. PNG plans to satisfy its mitigation requirement by purchasing 0.75 acre of riparian wetland credit from the North Carolina Ecosystem Enhancement Program ( NCEEP) from within Roanoke River Basin (HUC 03010107). An Acceptance Letter from NCEEP is included in Appendix VI. Mitigation for wetland impacts that do not exceed one acre is not required by NCDWQ, and because the project will not result in permanent stream impacts, stream mitigation is not required. Mitigation has also been provided by avoidance and minimization procedures implemented during the design phase of the proposed project. Impacts will be minimized Pre - Construction Notification S &ME Project No. 1357 -11 -028 PNG Bertie Prison E2 -4 Line April 30, 2012 by: 1) use of an existing, maintained ROW where possible; 2) using trenchless pipe installation; and 3) eliminating temporary work space and conducting the proposed work within what will be the permanent maintenance corridor, and; 4) reducing the width of the permanent maintenance corridor to that necessary to adequately construct and maintain the project. The project will comply with applicable conditions of NWP No. 12 and WQC No. 3884, with the exception of those noted previously. The width of the permanently- maintained ROW will not exceed 40 feet in wetlands and at stream crossings. The proposed alignment also parallels existing roadside ROW to the extent practicable. Following construction, affected stream and wetland areas will be restored to its original grade and contour. The proposed project will not result in permanent changes in pre- construction elevation contours or affect dimension, pattern or profile subject crossings. Cleared areas will be restored in accordance with the attached Restoration Plan (Appendix VI) following completion of the work. SECONDARY AND CUMULATIVE IMPACTS The primary purpose of the project is to provide a supply of natural gas to an existing facility. Accordingly, the project is not considered growth- inducing and is not intended to serve as an impetus for expansion of development, and should not result in secondary impacts, or contribute to cumulative impacts. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Land use in the vicinity of the project corridor consists primarily of a mix of roadside, residential and commercial areas, forest, open or other disturbed and /or maintained areas. The proposed right -of -way (ROW) passes through several wetland areas and terminates at the Bertie Prison. 3b. List the total estimated acreage of all existing wetlands on the property: -3 3c. Explain the purpose of the proposed project: The purpose of the work is to provide a supply of natural gas to the Bertie County Prison. 3e. Describe the overall project in detail, including the type of equipment to be used: Construction of the new pipeline will first involve identification of the clearing limits, followed by aboveground removal of woody vegetation from the proposed ROW in wooded areas by mechanical means or hand - clearing, as appropriate. In high ground, the work will occur within an easement varying from 50 to 10 feet wide. Disturbance of a corridor greater than 40 feet will not be required in wetland areas. In wetland areas where the pipe will be installed conventionally, efforts will be made to remove surface vegetation in a manner that minimizes disturbance of the forest floor, and prevents exposure of soil. If necessary, a temporary equipment crossing will be installed along one side of the ROW to facilitate equipment passage and prevent excessive rutting and ground disturbance in wetlands. Appropriate sediment and erosion control measures will be installed to prevent sedimentation of jurisdictional features as a result of construction. Streambank vegetation within the corridor will be hand cleared, and introduction of logging debris into the creek will be avoided to the extent practicable. An equipment crossing of Broad Creek or the Cashie River is not required. The HDD of Cashie River will begin in high ground on the west side of creek, pass beneath the waterway and its adjacent wetlands, and emerge in high ground on the east side of the creek. In this area, conventional pipe installation (trenching) will only be required within a 10 foot wide disturance area where the pipe turns north and runs along the west side of Elm Street Extension. The HDD of Broad Creek will be conducted entirely from high - ground to high - ground. Because the pipe will be installed via HDD through a majority of the forested wetland areas, no grubbing or belowground vegetation removal will be required. Where the pipe will be installed conventionally, grubbing will be limited to the trenchline. Select portions of the ROW may require rough grading to facilitate safe passage of equipment, and to prepare a suitably -level work surface. Appropriate sediment and erosion control measures will be installed following initial soil disturbance as the project progresses. Within wetland areas where rutting may occur, timber mats will be employed to provide work and travel space for equipment. During construction, the pipe will be strung and placed on skids (wooden pedestals) along the ROW. Specialized machines will be used to bend individual segments of pipe to fit the contours of the trench where necessary. The pipe segments will be welded together and inspected for structural integrity, and then lowered into the trench. The trench will themn be refilled and the affected areas restored. 4. To minimize impacts and limit habitat fragmentation within the wetlands, PNG has proposed to install a majority of the new gas pipeline parallel to an existing roadside. To comply with applicable sections of the Endangered Species Act (ESA) of 1973 (16 USC 1531 - 1543), S &ME submitted scoping letters to the North Carolina Natural Heritage Program ( NCNHP) and the U.S. Fish and Wildlife Service on October 19, 2011. The scoping packages included USGS topographic maps and aerial photographs of the project route, and requested that each agency review records they may have relating to rare, endangered, or threatened species, or high quality natural communities within the vicinity of the project corridor, and provide comment. The NCNHP responded with a November 16, 2011 letter that identified a nearby natural area (the Bertie County Game Land) managed by the North Carolina Wildlife Resources Commission ( NCWRC). The NCNHP also identified a Dedicated State Nature Preserve, the Cashie River floodplain, as part of the same game land. Although the project is not routed through either area, the NCNHP recommended that the NCWRC be contacted for comment. Accordingly, S &ME contacted Mr. Dale Davis of the NCWRC's Edenton Depot on November 21, 2011 and informed him of the proposed project. Mr. Davis asked that we provide him maps of the proposed route for his review and he would provide comment if necessary. S &ME provided Mr. Davis with the project scoping information and maps on November 22, 2011. To date, the NCWRC has not provided comment on the project. The USFWS responded with a February 16, 2012 letter in which they stated that the proposed project was unlikely to affect federally - protected species, and that they believed the requirements of Section 7(a) (2) of the ESA had been satisfied. The USFWS also stated that they were concerned about potential impacts the project may have on aquatic species. Accordingly, the USFWS recommended that directional boring be used at stream crossings, and that stringent measures to control sediment and erosion should be implemented. As part of mitigation for unavoidable impacts, the following plan shall be implemented to restore temporarily- affected wetlands and streams. This plan entails restoration of temporarily- disturbed areas to their original contours and conditions to the degree practicable upon project completion. Further, disturbed wetland areas and streambanks will be permanently stabilized with a native vegetative cover. Affected streambanks will also be planted with woody species. The measures outlined below will be specified in the contract documents prepared for construction of the proposed project. Proposed restoration activities will include removal of temporarily- placed fill material and restoration of original pre- disturbance contours. Excavated material shall be returned to the trench to the extent possible, and remaining material relocated and retained on an upland site. Excavated topsoil will be stockpiled separately and then replaced uniformly over the area of excavation from which it was removed. The native seed mix identified in Table 1 below will be utilized within temporarily- disturbed portions of the corridor comprised of wetlands.
