Attached is an individual permit application for the Marketplace at Tramway project located in
the southeast quadrant of the intersection of Jefferson Davis Highway ( US 1 15 501) and
Tramway Road INC Highway 78) southwest of Sanford, Lee County North Carolina An
Individual Permit application is attached
The proposed project is a retail shopping/service center planned to serve the residents of Sanford
as well as through traffic on US Highway 1115 501 It consists of nine out parcels that front
either US Highway 1/15 501 or Tramway Road a building center, access roads stormwater
management infrastructure a sanitary sewer lift station and sufficient parking to support the
commercial space proposed The building center consists of a 105 000 square foot (SF) building
for a proposed retail anchor store, a 36 000 SF building for a proposed grocery store and several
retail shops Construction of an access road internal roadway for the project and parking areas
would impact 2 17 acres of the 2 23 acres of jurisdictional wetlands present on the site

Mr Matthews verified the boundaries of the jurisdictional areas on the site that were delineated
by Wetland Solutions LLC on July 19 2011 There are no stream channels present on the site
and the project does not involve any impacts to stream channels

The approximately 43 89 acre project site is located in the southeast quadrant of the
intersection of Jefferson Davis Highway ( US 1 15 501) and Tramway Road (NC Highway 78)
southwest of Sanford Lee County North Carolina Jefferson Davis Highway and Tramway Road
bound the site to the northwest and north respectively Figure 1 shows the project site on the
Sanford North Carolina USGS topographical quadrangle A 2010 aerial photograph of the
project area is provided as Figure 2 Soil mapping units present on the project site are shown
on the Lee County Soil Survey Map provided as Figure 3 The tracts listed above are shown on
the Properties Map provided as Figure 4

18 Nature of Activity Attachment
The proposed project is a retail shopping /service center planned to serve the residents of
Sanford as well as through traffic on US Highway 1/15 501 It consists of nine out parcels that
front either US Highway 1/15 501 or Tramway Road a building center access roads
stormwater management infrastructure a sanitary ewer lift station and sufficient parking to
support the commercial space proposed The building center consists of a 105 000 square foot
(SF) building for a proposed retail anchor store a 36 000 SF building for a proposed grocery
store and several retail shops Construction of an access road internal roadway for the project
and parking areas necessitate the proposed impacts The attached Jurisdictional Waters Impact
Map and a detail of the impact area prepared by J Thomas Engineering Inc depict the overall
project and provide details of the proposed impacts to Jurisdictional areas (Figures 5 and 6)
This permit application covers the entire project that will be constructed in two phases as
shown on the attached Jurisdictional Waters Impact Map (Figure 5)
Prior Project History and Existing Conditions
Jurisdictional areas on the majority of the site were delineated by Wetland Solutions LLC on
July 19 2011 after the property owner inadvertently graded across two wetland areas on the
property without Section 404/401 permits Mr Monte Matthews of the US Army Corps of
Engineers verified the boundary identified by Wetland Solutions LLC (AID # 201101375) Mr
Matthews and Mr Martin Richmond of NC Division of Water Quality (NCDWQ) assisted the
property owner with plans to restore the wetlands The property owner then re established
the pre construction contours within the wetland areas installed silt fencing for protection and
replanted them with woody plant species The proJE ct site has been cleared of young pine
forest and mixed pine /hardwood forest several structures located on the site have been
removed the re planted wetland areas are surrounded by silt fence and grading of upland
areas has begun
On December 2 2011 Mr Monte Matthews and M► Craig Brown with the USACE met with
Jennifer Burdette of BLC (environmental consultant) and Mr Mark Lyczkowski of ML Consulting
for a pre application meeting in preparation of submitting a request for an Individual Permit
Mr Matthews reviewed the avoidance and minimization and alternative analysis requirements
for the proposed project and noted that the delineation completed previously did not include
the southernmost portion of the project site Ms Jennifer Burdette conducted a field
evaluation of these additional parcels and found no additional Jurisdictional waters or wetlands

Future Project Plans
There may be some opportunity to expand the project to south in the future This area is
upland that does not contain Jurisdictional waters or wetlands Therefore future Section 404
permit requests are not anticipated for the project
Stormwater (required by DWQ)
The project will be developed in two phases with one wet detention pond to serve the entire
development as shown on the attached Jurisdictional Waters Impact Map Jeremy Thomas PE
of J Thomas Engineering Inc prepared the attached Impervious Area Summary and
Stormwater Management Plan (SMP) Narrative Detailed SMP plans and calculations will be
provided to NCDWQ under separate cover
Sewage Disposal (required by DWQ)
Wastewater generated from the proposed project will be disposed of through the City of
Sanford sanitary sewer system The applic,int proposed to build a sanitary sewer lift station to
pump wastewater to the currently limit of the City of Sanford s sanitary sewer located in the
northeast quadrant of the intersection of US Highway 1/15 501 and Tramway Road
Cumulative Impacts (required by DWQ)
The proposed infrastructure serves only the proposed retail development Future expansion of
the retail development may occur along Pegg Street which is currently development into
residential lots and does not contain Jurisdictional waters or wetlands Therefore the project is
not anticipated to result in additional cumulative impacts
Endangered Species
BLC does not anticipate that project would impact Federally protected Threatened or
Endangered Species habitat based on the lack of protected species identified within a 2 mile
radius of the site by the NC Natural Heritage Program

Historic or Prehistoric Cultural Resources
The applicant retained Archaeological Consultants of the Carolinas Inc to conduct an
Archaeological Evaluation on the majority of the project site No recorded cultural resources
were found recorded either within or in the vicinity of the Tramway tract and a field
investigation did not identify any archaeological deposits The evaluation concluded that
development of the tract would not impact any significant cultural resources This report was
forwarded to the NC Department of Cultural Resources State Historic Preservation Office (NC
SHPO) The SHPO office acknowledged receipt of the report in the attached letter dated
November 22 2011

23 Description of Avoidance Minimization and Compensation Attachment
The subject property is a unique commercial property located along US Highway 1/15 501
(Jefferson Davis Highway) at NC Highway 78 (Tramway Road) in Sanford North Carolina An
overview of the alternative sites reviewed by the applicant given the constraints dictated by
sanitary sewer service and highway access described below is shown on the attached Off site
Alternatives Map (Figure 7)
The subject property is over 45 acres in size and located at a mayor intersection with high traffic
counts Jefferson Davis Highway is a limited access Federal highway into which permits for
direct driveway access may not be issued This limited access stretches from Raleigh to Just
one half mile north of this site and extends from the south to approximately three miles south
of the site There is only three to four miles of direct driveway access to Jefferson Davis
Highway for over a 60 mile stretch of highway from Raleigh to Southern Pines
This property currently has direct access and may hive additional direct access to Jefferson
Davis Highway if improvements to Jefferson Davis Highway and Tramway Road are completed
as required by the NC Department of Transportation ( NCDOT) There is no other property along
this section of Jefferson Davis Highway with a traffic count sufficient to directly access Jefferson
Davis Highway
Another very important component to this property is its location to sanitary sewer This
property is located on one of the highest points in Sanford /Lee County which is at the limit of
the gravity sewer lines that are currently available A sanitary sewer lift station and force main
are required to provide sanitary sewer service to this site Because NCDOT does not permit
sanitary sewer force mains to be located within the highway right of way properties located
farther south than the subject property are not suitable for commercial development of the
size proposed by the subject project due to lack of sanitary sewer service
The owner also attempted to assemble a similar tract of land directly across the street that is
made up of six to eight different property owners Several owners were willing to sell but
some owners would not agree to sell their property Furthermore the price for this
assemblage of properties would have been double the price of properties assembled for this
project
A review of the Off site Alternatives Map (Figure 7) hows that Alternative Sites A and F do not
have direct access to Jefferson Davis Highway Alternative Sites B C and G lack direct access
and a property configuration suitable for the type and size of retail /service center proposed
Alternative Site D has access to sanitary sewer servo a and Jefferson Davis Highway but lacks
visibility from Jefferson Davis Highway and two thirds of the site contains intermittent
(approximately 600 linear feet) /perennial (approximately 700 linear feet)stream channels with
adjacent headwater forest wetland Alternative Site E has direct access to Jefferson Davis

23 Description of Avoidance Minimization and Compensation Attachment
Highway but lacks a property configuration suitable for the type and size of retail /service
center proposed and current access to sanitary sewer service Based on conversations with the
City of Sanford representatives local real estate professionals and local residents the subject
property is the best commercial site available for the economic growth of Sanford Please see
the attached letter stating the subject project s importance to the economy of Sanford from
Mr Robert Bridwell of Sanford /Lee County Planning and Development
The applicant was unable to avoid impacts to two areas of jurisdictional wetlands present on
the site According to NCDOT the access road connection to Tramway Road cannot be moved
closer to the intersection of Tramway Road and Jefferson Davis Highway to prevent safety
issues with traffic stacking at the intersection Moving the access road farther away from the
intersection would not avoid impacting the wetland and would not line up with a proposed
access across Tramway Road Additionally a retail /service center of the size proposed requires
a large contiguous area with a high degree of road visibility Approximately 30 percent of the
project s proposed commercial space would be lost in order to avoid the two relatively linear
shaped wetland areas
Because the proposed jurisdictional wetland impact of 2 17 acre exceeds the USACE s 0 10 acre
threshold for mitigation and NCDWQ s 1 acre threshold for mitigation BLC believes that
nonriparian wetland mitigation is required for the proposed impacts The applicant proposes to
mitigate permanent nonriparian wetland impacts at a 2 1 ratio of mitigation to impacts based
on the good quality of the headwater forest wetlands that would be impacted The total
amount of nonriparian wetland mitigation required for the project is 4 34 acre No private
mitigation banks are located within the project s Cataloging Unit The NC Ecosystem
Enhancement Program ( NCEEP) has indicated their ability to accept payment for compensatory
mitigation required for the project NCEEP s acceptance letter for 2 17 acres of nonriparian
wetland impact is attached

Narrative - Stormwater Management Plan

The proposed Marketplace at Tramway is a planned commercial project situated on approximately
45 acres located at the intersection of US HWY 1 and NC 78 in Lee County North Carolina The
project as proposed will include big box type stores and nine (9) outparcels along the existing
highway frontage The outparcels will be marketed to restaurants banks convenience centers
pharmacies etc The 45 acre site is located at the top of the watershed basin and drains mainly
toward the east Approximately 2 23 acres of jurisdictional wetlands exist on the property For the
project to be viable approximately 2 17 acres of these jurisdictional waters are proposed to be
impacted
The project is proposed to be completed in two phases Phase 1 will include installation of the
internal collector roadways driveways and utilities to service seven (7) of the outparcels This initial
Phase 1 construction will not entail any impacts to the jurisdictional wetlands on the property Phase
2 will include the remaining two (2) outparcels and big box type stores During this final second
phase the proposed impacts to jurisdictional waters will take place
Neither the City of Sanford nor Lee County has requirements for post development stormwater
controls to treat runoff from new development To comply with the 401 Water Quality Certification
the property owner is proposing to install a permanent stormwater management BMP to treat runoff
from the proposed development (Phases 1 and 2) The property owner proposes to construct one
(1) wet detention pond designed for 90 %TSS removal prior to any wetlands being impacted (Phase 2
construction) Once the pond is constructed runoff from the project development will be directed to
this BMP for treatment The pond will be maintained by the property owner(s) through a recorded
agreement

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program ( NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved You must also comply with all other state, federal or local government permits regulations or authorizations associated
with the proposed activity including SL 2009 337 An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S L 2011 343
This acceptance is valid for six months from the date of this letter and is not transferable If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire It is the applicant s
responsibility to send copies of the permits to NCEEP Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work The amount of the In

Introduction
The Tramway protect tract is located on the southeast corner of the intersection of Highways
1 and 78 in the community of Tramway North Carolina (Figure 1) The tract is comprised of four
parcels of land totaling 25 93 acres An unnamed drainage runs along the eastern border of the tract,
much of which has been delineated as wetland Due to expected impacts to this wetland area
specialized permitting will be necessary for development of the tract Archaeological Consultants of
the Carolinas Inc (ACC) conducted an archaeological evaluation of the project tract on behalf of
BA Branch Property LLC in anticipation of permitting requirements
Project Tract
The Tramway tract is set in an area of on going development The three other corners of the
intersection at which it is located are a Hardees a Walgreens and a Cmtgo Until very recently the
eastern portion of the tract had been wooded and several structures stood in the northwest corner
The structures have been demolished and the majority of the associated debris has been removed
(Figure 2) The trees have also been removed and the tract has been partially graded Large piles of
partially burned logging debris and soil are present (Figure 3) The wetland area in the tract is
currently delineated by silt fencing
Background Research
Background Research began with a review of records on file at the North Carolina Office of
State Archaeology (OSA) in Raleigh This review served to identify previously recorded resources
in the project tract and /or its vicinity Records on file at the Department of Historic Resources
Survey and Planning Branch also in Raleigh were reviewed to identify previously recorded
architectural resources in the project vicinity Historic maps of Lee County and the project vicinity
also were examined Finally the Lee County Soil Survey was consulted to determine the soil type(s)
within the project tract and environmental characteristics of the surrounding area
No recorded cultural resources are present either within or in the vicinity of the Tramway
tract The nearest such resource is over 1 0 mile north

Field Evaluation
Due to the excellent surface visibility field evaluation was comprised ofa complete walk over
of the project tract with shovel tests excavated in judgementally determined locations Linear
pedestrian transects were conducted at 30 meter intervals All exposed ground surface was
comprehensively examined
A total of five shovel tests were excavated across the project tract These tests exposed dark
grayish brown sandy loam grading to yellowish brown clayey sand at an approximate depth of 20 cm
This soil profile is consistent with Dothan loamy sand which is the defined on site soil type Dothan
soils form on broad uplands are slowly permeable, and are characterized by brown sandy loam
overlying yellowish brown sandy clay loam
Although sporadic architectural debris (e g concrete block fragments brick fragments, etc )
was noted across much of the tract this material was determined to have been associated with the
destruction of the structures in the northern portion of the tract and was not considered to have
cultural value No artifacts were recovered either from the ground surface or from shovel tests
Conclusion and Recommendations
In anticipation of future permitting requirements ACC conducted an archaeological
evaluation ofthe Tramway tract The tract had previously been cleared of all vegetation and standing
structures had been removed No archaeological or architectural resources have been recorded in the
project vicinity and the field investigation failed to identify any archaeological deposits Development
of this tract will not impact any significant cultural resources and further investigation is not
considered to be necessary
