Box 10803 Raleigh, NC, 27605 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Barnes: You have our approval, in accordance with the attached conditions, to place fill in 0.02 acre of vegetated wetlands in order to re-locate and construct a driveway access for your residence in New Hanover County, as described in your application received by the Division of Water Quality on June 19, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274 which can be downloaded from our web site at http://h2o.enr. state. nc. us/ncwetlancls . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre; compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The project site is located at the end of Masouboro Harbour Drive, adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW), in New Hanover County. The applicant's lot is 70 feet Wine and approxirnaWy 400 feet in depth from Myrtle Grove Sound. Along the property's shoreline, thorn is an adjacent marsh border approximately 120 feet wide, predominately smooth Cordgmsa W . An existing private pier extends into Myrtle Grove Sound. This lot previously su(Spwtim pported a single-family residence, however, all that remains from the original development is a portion chhe old house foundation, the existing driveway, and a private weU. Except for the old homesite, the lot is wooded and relatively flat, with an average elevation of 6 - 8 feet above mean sea level (MSL), no subject property has been recombined into the adjacent Ma.sonboro Harbour Subdivision, and access to Lot 3 is through the subdivision's common area (Lot A). This area is the project site. There is an existing ditch between Lot 3 and Lot 29R which turns and bisects the common area lot. Currently, there is an existing culvert which allows stormwater to pass under the existing driveway. The ditch is tidal below the culvert, closor to Myrtle CYrove Sound, and includes an area of "404 type" jusidictional watlands above the existing crossiig. As part of the agreement with the Masonboro Harbor Rome Owners .Association, the applicant must relocate his driveway access to the south side of the common area, thus nessecitating this application. Ira the project area, the waters of the are classified as ,SA-ORW, by the NC Division of Water Quality, and they are OPEN to the harvest of she]1fsh, These waters are designated as Prinaazy Nursery Area (PN'A), by the NC Division of Marine Fisheries. 'ie applicant proposes to relocate side of the his driveway access to the newly recorded easement, along the south common area lot, The applicant would abandon a section of the existing driveway, approximately 360 feet long and 12 feet wide, removing the existing culvert and gravel surface, The PropeSed driveway would also be 360 feet long and 12 feet wide. The new culvert would be 20 feet long and 30 inches ipa diameter. The new driveway would cross three small areas of delineated wetlands, (17 ft. X 9 ft_, 16 ft, X 13 ft., and 21 ft. X 20 ft.), totaling 781 square feet. 10. The proposal would cause the loss of a 781 square feet of "404 type" wetlands.
