Southern Environmental Group Inc (SEGi) has been retained by Flournoy Development Company
(herein referred to as Applicant ) to submit the attached Pre Construction Notification (PCN) in order to
obtain the US Department of the Army s and the NC Division of Water Quality s approvals to utilize
Nationwide Permit 29 and General Water Quality Certifications 3821 The authorizations are necessary to
facilitate the construction of the proposed multi family complex known as Amberleigh Shores in
Wilmington North Carolina
With this request for approval permanent impacts to USACE ,jurisdictional wetlands and DWQ isolated
wetlands associated with the development is anticipated to be approximately 0 386 acre To satisfy the
Corps no net loss of wetlands policy the Applicant proposes to make payment to the NC EEP for 0 75
acre of non riparian wetland restoration credit as well as placing the remaining wetlands into strict
preservation The Applicant and SEG> believe that in conjunction with the minimization efforts (i a re
design efforts and retaining walls) the proposed mitigation is sufficient to offset the proposed wetland
impacts

adjacent to an unnamed tributary to Pages Creek, a tributary to the AIWW, a Navigable Water of the US This site
also contains a waterbody that exhibits an Ordinary High Water Mark and is a tributary to Pages Creek This
determination is based on information submitted by SEG, Inc and a site visit by Emily Hughes on March 17, 2009

Reference is made to the stream determinations for two features located at the Amberleigh Shores/Marsh
Oaks Corn-rercial ,itc in New 4anover Courty Staff from the Division of Water Quality s Wilmington
Regional Office and DWQ Central Office in Raleigh had previously conducted an on site determination
of die features in quostion In your letter to Matt Matthews datea April 19 2011 you requestea tnat we
re visit this site for another determination On June 21 2011 I conducted an on site determination to
review Features A and C (as labeled on the attached map) located on the subject property for applicability
to the Water Quality Certification Rules (15A NCAC 2H 0500) Feature A on the attached map was
previously determined to be part of a wetland by the U S Army Corps of Engineers therefore the
Division of Water Quality will consider Feature A to be part of the Jurisdictional wetland and should be
labeled as such (not as a stream) in any application submitted to DWQ Your consultant Ms Dana
Lutheran with Southern Environmental Group Inc informed us that Feature A was excavated within the
wetland area at some time in the past approximately during the 1970 s At the wetland boundary this
feature continues east slightly uphill until it is intersected by Feature C from the north The portion of
Feature A outside of the wetland area will be considered a ditch excavated through uplands For clanty
during the application process please be sure to identify and describe feature A in any future applications
associated with this property Feature C is also a ditch in uplands and should be identified as such in anv
applications
This letter only addresses the Jurisdictional status of the two referenced features and does not approve any
activity within Waters of the United States or Waters of the State If you have any additional questions or
require additional information please call me at [phone] This determination is subject to review
as provided in Articles 3 & 4 of G S 150B

Dear Ms Lutheran
This is a follow up to the letter sent to you dated December 19 2011 in which we recommended an
archaeological survey on the property at 7910 Market Street in New Hanover County Nathan Henry Assistant
State Archaeologist visited the site on December 19 2011 and reported that the area of concern appeared to be
heavily disturbed by previous drainage control and sand mining activity Therefore the likelihood that
significant archaeological sites still exist there is low We therefore do not recommend further archaeological
assessments in connection with the development of this property
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation s Regulations for Compliance with Section 106 codified at 36 CFR
