APPROVAL of 401 Water Quality Certification
Dear Mr. Frost:
You have our approval, in accordance with the attached conditions, to impact 0.11 acre of open water in order to
install 22 mooring pilings adjacent to your existing dock to define 10 slips for the offloading of fish to your existing fish house
in Carteret County, as described in your application received by the Division of Water Quality on June 11, 2001. After
reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274
which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your
CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA
Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us andkyou may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

9. NARRATIVE DESCRIPTION:
The project site is located on the northeast side of the US 70 drawbridge to Beaufort, on US 70
and Cedar Street, adjacent to Town Creek, in Carteret County. This site is approximately 1.3
acres in sizes, and currently is occupied by Homer Smith Seafood. The tract is largely
impervious, having compacted sand and gravel for parking on most of the vacant area. There are
offloading docks existing, along with a building for processing, packaging, and offices. The
facility is serviced by municipal water and sewer services. Along the far western shoreline of the
property Spartina alterniflora marsh has colonized on a sandy point east of the bridge. CAMA
Permit #55-95 was issued on May 10, 1995 for an offloading dock extending into Town Creek
along the west side of the boat basin. This structure was constructed, and the permit expired on
December 31, 1998.
Town Creek is classified SC by the Division of Water Quality. The waters are closed to the
taking of shellfish for consumption by the Division of Health Services, and the area is not
designated PNA by the Division of Marine Fisheries. The Town of Beaufort Land Use Plan
classifies this area of Beaufort as Developed, with all AEC's classified Conservation. The water
body of Town Creek is in excess of 1000' across at the project site.
The proposal is an enhancement to the existing use. Currently, offloading commercial vessels lay
alongside of the dock to the south and the dock to the west. The applicant proposes to formalize
the slip space on the western dock to prevent the haphazard docking occurring presently. Also
problematic with the current system is the blocking of emptied vessels by vessels ready to offload
bridled to them.
Specifically, the proposal is to install 22 mooring piles adjacent to the western dock. These
pilings would be placed ±9' and ± 30' waterward of the dock, extending further into the basin
rather than further into Town Creek. Ten slips would be created along this existing dock by the
pilings, within waters approximately 12' deep at nlw. The development would terminate > 300'
from each riparian corridor.
10. ANTICIPATED IMPACTS:
The project as proposed would incorporate approximately 4800 sf of Public Trust Area within an
area presently used for the same purpose. Water depths are sufficient for the use. The current
use would not be expanded by the proposal, but operated more efficiently. Turbidity increases
can be expected during pile driving.
