Mashburn, Jr. 4000 WestChase Blvd., Ste. 500 Raleigh, NC 27607 RE: Sanitary Sewer, Town of Cary, Lochmere and Wynston Ridge, Cary, Wake County, NC Dear Sirs, On May 22, 2001,1 met with you to discuss the proposed sanitary sewer line easement located in Lochmere and Wynston Ridge Subdivisions. The attached "Alternative One" initialed by me on 6/14/01 and provided by you during our meeting indicates the clearing limits required for the proposed sanitary sewer expansion as stated by you during our 5/22/01 meeting. The attached plan indicates that these clearing limits would impact 2,103 square feet and 71.7 parallel linear feet of Zone 1 of the protected riparian buffers and possible direct parallel impacts to the stream channel. This proposed non-perpendicular alignment will require a "No Practical Alternatives Analysis" performed by this office, written authorization from this office and mitigation for the non-perpendicular impacts per 15A NCAC 2B .0233. The attached "Alternative Two" initialed by me on 6/14/01 and provided by you during our meeting indicates an alternative route from that indicated on "Alternative One". The attached plan indicates a perpendicular crossing of the stream with less impacts to Zone 1 of the protected buffers. This proposed alignment would be considered an "exempt" activity from the buffer rules if it is perpendicular, has clearing limits less than 40 linear feet wide and no greater than a 10 foot maintenance corridor and can follow all of the other conditions stated within 15A NCAC 2B .0233. "Exempt" activities do not require written authorization from the Division of Water Quality (DWQ). Per 15A NCAC 2B .0233(8), the DWQ is required to ensure that certain activities minimize impacts to the protected buffers. Of these two alternatives it appears to me that "Alternative Two" has the least amount of impact to Zone 1 of the protected buffers. A formal "No Practical Alternatives Analysis" will be preformed once and if a formal request is submitted for the proposed impacts. This letter only summarizes our 5/22/01 meeting and does not authorize any impact to the protected riparian buffer.
