Dear Mr. Aaron,
You have our approval, in accordance with the conditions listed below, to impact ± 162 ft2 of Zone 2 of the protected riparian
buffers for the purpose of constructing the proposed deck and porch as described within variance request form dated April 17, 2001 and
received by this office on June 13, 2001. This letter shall act as your approval for the use of the "General" Major Variance; From the
Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal
Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality
Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other
required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control
and CAMA permits.
This approval is only valid for the purpose and design that you described in your variance request dated 4/17/01 and received b?
this office on 6/13/01 except as modified below. If you change your project, you must notify us and you may be required to send us a
new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for
complying with all conditions. For this approval to be valid, you must follow all of the conditions identified within the attached
"General" variance and the conditions listed below.
1. Additional woody vegetation (native shrubs and trees) shall be planted in all retained areas of the protected riparian
buffer on the property to the greatest extent practicable.
2. No impacts are permitted within Zone 1 of the buffers.
3. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identifiec
within 15A NCAC 213 .0259(5). Drainage from the deck and porch shall be directed to vegetated areas at non-erosive
velocities prior to entering the protected riparian buffers. Any additional stormwater located on the remainder of the
property shall be directed as diffuse flow at non-erosive velocities prior to entering the protected riparian buffers. No
new ditching or piping of stormwater through the protected buffers is allowed.
If you do not accept any of the conditions of this certification, you may ask for and adjudicatory hearing. You must act within
60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, PO Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection Rules [ 15A

Subject: Minor Variance for Residential Construction
Neuse Riparian Buffer Rules

Please find attached a request form for a Variance for Residential Construction. The
proposed construction is to extend an existing deck ten feet into a Zone 2 buffer area. I
visited the site on 17 May, 2001. Photos taken on 17 May, 2001 are attached.
The applicant proposes to add 10 feet to an existing open deck and covered screen porch.
The original deck was built in 1992 without regard to placement and proximity to the
canal on the northeast side of the structure, and extends into the Zone 2 buffer area. The
proposed extension of the deck will encroach the Zone 2 area by 12 feet at the deepest
point of a small triangular area. The entire buffer zone is planted in well- established
grass and garden, and provides good diffusion of any direct flow towards the canal.
The WaRO recommends issuance of a_Maior "General " Variance for this construction. If

Just letting you know I had a call from a Harold Aaron who, while not
getting mad at anyone specifically, sounded quite furious that there's \
no record on my database of any project in his name. Apparently he sent x
in a Buffer Variance to Deborah months ago and he's frustrated that he
can't get a hold of either of you and says next thing he'll do is
contact "mr. dorney's supervisors". I tried to explain that often
variances aren't in the database till final action is taken on them and
that it's likely it's being reviewed right now. Not sure that pacified
him or not.
If you do see this file or know of it, please double check the recieved
date to make sure it's not overdue. If you want to talk to him, he left
