V. SUPPLEMENT AND O&M FORMS The applicable state stormwater management permit supplement and operation and maintenance (O&M) forms must be submitted for each BMP specified for this project. SUBMITTAL REQUIREMENTS Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and Land Resources (DEMLR). A complete package includes all of the items listed below. A detailed application instruction sheet and BMP checklists are available from http://portal.ncdeiir.org/web/wq/ws/5u/s�it-itesw/`forms does. The complete application package should be submitted to the appropriate DEMLR Office. (The appropriate office may be found by locating project on the interactive online map at htip://12ortal.ncdeilr.org/web/`wqZwsIsuZmai2s.) Please indicate that the following required information have been„provided by initialing in the space provided for each item. All original documents MUST be signed and initialed in blue ink. Sealed, signed and dated calculations (one copy). 8. Two sets of plans folded to 8.5" x 14" (sealed, signed, & dated), including: a. Development/Project name. b. Engineer and firm. c. Location map with named streets and NCSR numbers. d. Legend. e. North arrow. f. Scale. g. Revision number and dates. h. Identify all surface waters on the plans by delineating the normal pool elevation of impounded structures, the banks of streams and rivers, the MHW or NHW line of tidal waters, and any coastal wetlands landward of the MHW or NHW lines. • Delineate the vegetated buffer landward from the normal pool elevation of impounded structures, the banks of streams or rivers, and the MHW (or NHW) of tidal waters. i. Dimensioned property/project boundary with bearings & distances. j. Site Layout with all BUA identified and dimensioned. k. Existing contours, proposed contours, spot elevations, finished floor elevations. 1. Details of roads, drainage features, collection systems, and stormwater control measures. in. Wetlands delineated, or a note on the plans that none exist. (Must be delineated by a qualified person. Provide documentation of qualifications and identify the person who made the determination on the plans. n. Existing drainage (including off -site), drainage easements, pipe sizes, runoff calculations. o. Drainage areas delineated (included in the main set of plans, not as a separate document). Copy of any applicable soils report with the associated SHWT elevations (Please identify elevations in addition to depths) as well as a map of the boring locations with the existing elevations and boring logs. Include an 8.5"x11" copy of the NRCS County Soils map with the project area clearly delineated. For projects with infiltration BMPs, the report should also include the soil type, expected infiltration rate, and the method of determining the infiltration rate. DEED RESTRICTIONS AND PROTECTIVE COVENANTS For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and protective covenants forms can be downloaded from httl2://portal.ncdenr.org/web/Ir/stite-stQ water - forms does. Download the latest versions for each submittal. In the instances where the applicant is different than the property owner, it is the responsibility of the property owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring that the deed restrictions are recorded. By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and protective covenants for this project, if required, shall include all the items required in the permit and listed on the forms available on the website, that the covenants will be binding on all parties and persons claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted without concurrence from the NC DEMLR, and that they will be recorded prior to the sale of any lot. General Information a. Project Name: DPS—North Carolina National Guard Morganton Regional Readiness Center, Phase 11: New Construction b. Address: 5155 Western Avenue, Morganton, NC c. Total Site Area: 536.44 Acres (Parcel Area), 35 acres (Site Area) d. Disturbed Area: 34.33 Acres e. Wetland Area: 0 Acres (there are no wetlands onsite). f. Jurisdictional Streams and Stream Buffers: There is one jurisdictional stream on the property to the north of the site. There will be no impacts to the stream or stream buffer due to this project. g. Ownership: North Carolina National Guard h. Proposed Development: The North Carolina National Guard plans to construct a Regional Readiness Center (RRC) on the site of the former Dept of Corrections Western Youth Correctional Institution. The proposed project includes demolition of the existing buildings and construction of the RRC to be occupied by four National Guard units. i. Phasing: • This project includes two complete and separate "phases" which are publicly bid and constructed separately. • Phase I of the project included the relocation of existing Department of Corrections buildings to the CRV Correctional facility just south of the site of which Land Disturbance Permit BURKE 2019-012 was issued on March 14, 2019 (see attached). Construction of Phase I is underway and will be complete in February 2020 prior to beginning this project / Phase 11). • This project / Phase II will be bid in February 2020 after complete close out of Phase I project; Construction for Phase II is planned to begin February 2020 and end August 2021). j. Phase 1 has been approved for Bidding by the NCSCO and will be advertised this Sunday November 11, 2018 and Phase 2 is the DID review process at the NCSCO. I also attached the document from February of 1969 where 97 acres of this site were allocated from the State Hospital for use by the Department of Corrections. At your direction, this investigation was limited in scope to the proposed stormwater BMP locations on the site, as illustrated on the attached drawing. The investigation was completed on January 14, 2017. Depth to SHWT was determined using accepted soil science practices. A hand auger was used to advance vertically into the native soil until redoximorphic features (often mistakenly called "mottles ") with a chroma of 2 or less were observed. True mottles that meet this color criterion that are the result of parent material coloration are ignored, as these are not indicative of the seasonal high water table. Four hand auger borings were advanced in the locations proposed for the stormwater BMPs per the drawing referenced above. In borings 1 and 3, chroma 2 redoximorphic features indicative of the SHWT were not observed in the borings to a depth of 168 inches below the soil surface. In boring 2, auger refusal was experienced at 118 inches below the soil surface. In boring 4, auger refusal was experienced at 72 inches below the soil surface, The table below lists the observed SHWT depths below the existing soil surface. Clearly, the use of this property has been allocated from DHHS to the North Carolina Department of Public Safety (NCDPS, 1969) and then from (NCDPS) to the North Carolina National Guard (NCNG, 2018) for use as a Regional Readiness Center. This correspondence will serve as the original owner's consent form. On line 9 of the Financial Responsibility Form (FRO) required for the erosion and sediment control plan submittal, I recommend leaving the State Hospital listed as the owner of the property as it now appears on the form. In review of the parcel at 5161 Western Avenue, Morganton, via Google Earth, DPS has two (2) facilities in operation on the parcel in question. The reallocation between DHHS and DPS occurred in February 1969, see plat and deed PDF, and the issue seems to be a listing error at the Burke County Register of Deeds GIS that lists the State Hospital. DHHS is of the mind, that the reallocation occurred in 1969 and that DPS is the steward of the property since full execution which would lead the DHHS no role in the upcoming construction project or required documentation. Phase 1 has been approved for Bidding by the NCSCO and will be advertised this Sunday November 11, 2018 and Phase 2 is the DID review process at the NCSCO. Phase 2 will begin after Phase 1 is close out. I also attached the document from February of 1969 where 97 acres of this site were allocated from the State Hospital for use by the Department of Corrections. In April of 2018, 85.6 acres were transferred intra-agency by mutual consent between the Adult Corrections and Juvenile Justice (ACJJ) and the North Carolina National Guard (NCNG). Hope that helps. Important maintenance procedures: Immediately after the wet detention basin is established, the plants on the vegetated shelf and perimeter of the basin should be watered twice weekly if needed, until the plants become established (commonly six weeks).
