TROGDON, III GovERNoR SECRETARY February 20, 2020 Ms. Jeanette Powell, MS4 Program Coordinator DEQ-DEMLR Stormwater Program 1612 Mail Service Center Raleigh, North Carolina 27699-1612 Jeanette.Powell gncdenr. gov Subject: Response to Notice of Compliance (NOC-2020-PC-0206) for: North Carolina Department of Transportation NPDES TS4 Permit No. NCS000250 Statewide Dear Ms. Powell: As required by the Notice of Compliance (NOC-2020-PC-0206), the North Carolina Department of Transportation (NCDOT) hereby provides our response acknowledging the results of the audit completed on September 23-25, 2019 and the requirements stated within with our intent to comply with the following actions: (1) NCDOT is submitting a Statewide NPDES MS4 Permit Renewal Application for NPDES MS4 Permit No. NCS000250, see enclosure. Both electronic and hard copies of this letter and application will be provided. (2) NCDOT shall meet with NCDEQ MS4 Program staff within forty-five (45) days of submitting the permit renewal application to jointly review and evaluate current and proposed new permit conditions. (3) DEQ will provide NCDOT with a Draft NCDOT NPDES MS4 Permit following the meeting(s) in Item 2 above. Within one hundred twenty (120) days of receipt of the Draft NCDOT NPDES TS4 Permit, NCDOT will submit a Draft NCDOT Stormwater Management Plan (S WMP) which details specific actions, measurable goals, implementation timelines and annual reporting metrics that demonstrate compliance with the permit requirements. NCDOT refers to this document as a TS4MP to distinguish it from other regulatory documents used for stormwater management. The Draft NCDOT TS4MP will correlate in structure and format to the provided Draft NCDOT NPDES TS4 Permit. (4) Within thirty (30) days of receiving NCDEQ and public comments on the Draft NCDOT TS4MP, NCDOT will address each comment and submit a final NCDOT TS4MP for concurrent DEQ approval and final permit issuance. The final DEQ - approved NCDOT TS4MP will become an enforceable component of the issued NCDOT NPDES TS4 Permit. (5) The current NPDES TS4 conditions shall remain in effect until such time as a new permit is issued. NCDOT also would like to take this opportunity to advise the MS4 Program Coordinator that the permit owner going forward will be the new Secretary of NCDOT, Eric Boyette, effective as of March 1, 2020. Considering this change, NCDOT is filing a Permit Owner Affiliation Designation Form, designating Mr. Boyette as the new owner affiliation, see enclosure.
