Dear Mr. Bachanan:
You have our approval, in accordance with the attached conditions, to place fill material in 0.028
acres of wetlands and 20 feet of streams for the purpose of constructing a sewer line for Town of
Andrews-along Valley River and Tathan Creek, as you described in your application dated May 22, 2001,
1999. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3288. This Certification allows you to use Nationwide Permit Number 12 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification. This approval shall expire when
the corresponding Nationwide Permit expires or as otherwise provided in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter, To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Please find enclosed one (1) original and one (1) copy of a Pre-Construction
Notification Application for two (2) sewer line creek crossings that will be necessary to
construct the above referenced project. Also enclosed are ten (10) 8 1/2" x 11" sheets
showing the project location, plan and profile of the proposed creek crossings, and
miscellaneous details. By copy of this letter with enclosures, I am also informing Mr. Mark
Davis of the North Carolina Wildlife Resources Commission and Mr. John Dorney of the
Division of Water Quality of the application for this project.
Please note that a creek crossing permit was previously issued on November 17, 2000
(Permit Numbers 200031366 thru 200031368) for five (5) creek crossings that will also be a
part of this project. The additional two (2) creek crossings that are included with this
application are due to a relocation of a proposed 12-inch sewer line to the opposite side of
Tatham Creek.

Overall project includes the replacement of approximately 21,500 lineal feet of existing clay
sewer pipe with new 8" through 18" ductile iron and PVC sewer line and related appurtenances.
Crossings will involve approx. 60' of 12" ductile iron pipe to be installed under the creek bed.

condition with new ductile iron and PVC sewer lines.

EROSION CONTROL NOTES
GENERAL: ALL EROSION CONTROL MEASURES ARE TO BE PERFORMED IN STRICT ACCORDANCE WITH REQUIREMENTS OF THE
NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES, DIVISION OF LAND RESOURCES, LAND
QUALITY SECTION. THE FOLLOWING CONSTRUCTION SEQUENCE SHALL BE COMPLIED WITH FOR ALL WORK.
1. - OBTAIN GRADING PERMIT
2. - INSTALL ALL EROSION CONTROL MEASURES AS REQUIRED BY THE NORTH CAROLINA DEPARTMENT OF ENVIRONMENT
AND NATURAL RESOURCES, DIVISION OF LAND RESOURCES, LAND QUALITY SECTION.
3. - OBTAIN CERTIFICATE OF COMPLIANCE THROUGH ON-SITE INSPECTION BY A REPRESENTATIVE OF THE NORTH
CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES, DIVISION OF AND RESOURCES,
LAND QUALITY SECTION.
4. - PROCEED WITH GRADING, CLEARING AND GRUBBING.
