PURPOSE AND NEED FOR ACTION Trees need to be cut on a 6.5-acre site off the west end of the runway, adjacent to the Neuse River, to allow for flight safety (Attachment 1). Many trees have reached a height where they are encroaching into the SJAFB Approach -Departure Clearance Surface as described in Unified Facilities Criteria (UFC) 3-260-01, Airfield and Heliport Planning and Design (Attachment 2). SJAFB possesses easements for the subject property that declare, "The United States of America shall have the right to top, cut to ground level, and to remove trees, shrubs, brush, or other forms of obstruction which the Commanding Officer of Seymour Johnson Air Force Base determines might interfere with the operation of aircraft, including emergency landings" (Attachment 3). DESCRIPTION OF PROPOSED ACTION AND ALTERNATIVE Trees and brush will be cut and remain on site. Stumps and ground cover will remain in place with no grubbing. In order to reduce the frequency of this required maintenance work, the proposed action would cut "violator trees" to just above ground level. Vegetation will be allowed regrow until it reaches a height that requires repeated removal. Trees within 50-foot riparian buffer will be cut with chainsaws, while areas outside the buffer zone will be cut with forestry mowing equipment such as tractor -mounted brush cutters. This activity on this property has been previously reviewed and approved by the NC Division of Water Quality (Attachment 4). SJAFB will obtain a new 5-year authorization from the Division of Water Quality prior to initiating tree removal. Fixed Obstacles include man-made or natural features such as buildings, trees, rocks and terrain irregularities and any other features constituting possible hazards to moving aircraft. 3-12.3.3 Type III Clear Zone. Obiects in this zone will not penetrate the approach -departure clearance surface. Trees, shrubs, bushes, or any other natural growth will be topped 3 m (70 ft) below the approach -departure clearance surface or to a lesser height if necessary to ensure the visibility of airfield lighting. 3 -16.3 Trees. All trees within the runway, taxiway and apron lateral clearance distances and within the graded area of the clear zone need to be removed. Trees that project into the ima_ ig nary surfaces must be removed or lowered to a distance below the imaginary surface, as specified in Table 3-8. Trees are permitted near an airfield provided that they do not cause Bird Aircraft Strike Hazards (BASH), penetrate the imaginary surfaces, the taxiway clearance distance, the apron clearance distance, or instrument procedure obstacle identification surfaces. The right to regulate or prohibit light emissions, either direct or indirect (reflective), which might interfere with pilot vision. 4. The right to prohibit electrical emissions which would inter- fere with aircraft and Air Force communications systems or aircraft navigational equipment. 5. There is presently located on the land in question a sewage treatment facility which may or may not be enlarged by the City of C•o1ds- boro. Except for the right to maintain said present sewage treatment facilities and to construct additional sewage facilities as the City of Goldsboro may find necessary, subject, however, to existing easement restrictions, the United States of America shall have the right to pro- hibit or remove any buildings or other nonfrangible structures. 5. The United States of America shall have the right to top, cut to ground level, and to remove trees, shrubs, brush, or other forms of obstruction which the Commanding officer of Sevmour Johnson Air Force Base determines might interfere with the operation of aircraft, including emergency landings. 7. The United States of America shall have the right of ingress and egress upon, over, and across said land for the purpose of exer- cising the rights set forth herein. 8. The United States of America shall have the right to post signs on said land indicating the nature and extent of the United States' control over said land. 9. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre -Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non -erosive velocities through the protected stream buffers and will not re -concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). 6. Protective Fencing The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A NCAC 2B .0233. . / Seymour Johnson AFB Page 3 of 3 February 6, 2007 7. Certificate of Completion Upon completion of all work approved within this authorization, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 8. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Authorization Certificate. A sample deed notification can be downloaded from the 401/Wetlands Unit web site at: http://h2o.e nr.state. nc. us/ncwetlands. The text of the sample deed notification may be modified as appropriate to suit to this project. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The original approval was for 3.17 acres along the Neuse River. Since that request two additional areas have been identified as blue line streams. These areas include a small pond that leads into a longer drainage canal and are identified in Attachment 2. The tree removal is necessary to ensure flight safety_ Over time, the trees have grown into the Approach -Departure Clearance Surface. The plan is still to cut the trees and shrubs leaving all stumps in the ground. No grubbing will occur. Future plans are to allow for natural regrowth, until the vegetation reaches a height requiring repeated removal. This easement is dated 28 February 1979, and therefore represents an existing use of the area. The US Air Force proposes to cut the trees and shrubs, but leave all stumps in the ground. -No grubbing would occur.
