Dear Dr. Thorpe: This letter is in regards to the Individual 401 Water Quality Certifications issued for the following projects authorizing stream and wetland impacts: NCDW Project No. Date Issued TIP Project No. Condition No. 20060331 June 8, 2009 R-2606B 18 20090104 Aril 23, 2009 R-2814A and B 12 20090367 May 12, 2009 B-1037 1 20090379 May 20, 2009 R-2100B 1 The condition numbers referenced in the table above should be replaced with the following condition: The permittee shall use /Design Standards in Sensitive Watersheds/[15A NCAC 413.0124(a)-(e)] in areas draining to Waters classified as WS-I, WS-Il, ORW, HQW, or Tr (only trout waters identified by NC Wildlife Resources Commission as wild or naturally reproducing trout waters). However, due to the size of the project, NC DOT shall not be required to meet 15A NCAC 4B.0124(a) regarding the maximum amount of uncovered acres. Temporary cover (wheat, millet, or similar annual grain) or permanent herbaceous cover shall be planted on all bare soil within 15 business days of ground disturbing activities to provide erosion control. Coir fiber matting shall be used in conjunction with appropriate seeding on disturbed soils involving steep slopes in riparian areas, and should be secured in place with staples and wherever possible include installation of live stakes of native trees. Straw mulch and tall fescue shall not be used in the establishment of temporary or permanent groundcover within riparian zones. Coir fiber matting shall be used in conjunction with appropriate seeding for the establishment of permanent herbaceous cover on disturbed soils within the riparian area. Riparian areas are defined as a distance 25 feet landward from top of stream bank. Please attach a copy of this letter with any copies of the original Water Quality Certifications and any subsequent modifications. All other conditions written into the previous Water Quality Certifications for these projects still apply except where superceded by this correction.
