In this case the issue in question is the marina that was issued under a major modification. The original express permit was to develop the uplands and has not been included as part of the attachments due to the file size of the oversized workplans, though the express application is provided above. If you require the express workplans to complete your review please let me know. The marina was destroyed during Hurricane Florence and an emergency permit to rebuild was not secured. Due to this determination, the active permit cannot be renewed under CRC rule, but the rule does allow for circulation of the request to resource agencies to provide comment to any changes in circumstances or site conditions, or changes in your agency's rules or development standards that warrant a new application and CAMA major permit review. Therefore, DCM is requesting that your agency review the above materials to determine if site conditions or circumstances, or agency rules would prohibit DCM from issuing a renewal of the CAMA permit. Please provide comment within 21 days of receipt of this email to any changes in site conditions or rules that would prohibit DCM from issuing a permit renewal. CRC Major Development Permit No. 106-06 was issued for upland development associated with redevelopment of the landward portion of the project site, to include construction of a new harbor master building, bulkhead replacement, etc. on July 27, 2006. The permit was modified and reissued on February 29, 2008 to include repairs to existing marina structures and construction of new docking facilities and reissued on December 1, 2017 for construction on expansion of the marina docks to the south. Bridge Pointe Bridge Pointe Redevelopment, LLC Craven County Express Permit Review Program Page Two Project description The applicant proposes to redevelop the ±16.42 acre tract by removing the existing hotel complex and build three separate multi -story condominium buildings with a total of ±307 units. Building one will be constructed on the peninsula and building two will be constructed immediately south of the first building. The third and final condominium will be constructed on the site of the current hotel and will have a multi -level parking garage in the center of the structure. A new marina office is also proposed as well as a new swimming pool located on the waterward side of the third building. Paved parking is proposed around all three buildings. A new hotel and pool will be constructed at the southern most end of the site and will have associated paved parking lots. The existing ±556, retaining wall will be replaced in the same alignment and the height will be raised in some areas. As proposed, the ±258, of wooden bulkhead will be replaced 2' waterward of the existing bulkhead in the same alignment and will connect into the retaining wall. A ±6' wide concrete sidewalk is proposed along the waterfront adjacent the landward side of the bulkhead and/or retaining walla The proposed sidewalk at the waterward end of the peninsula will be ±25' wide. A new retaining wall is proposed at the landward side of the sidewalk on the peninsula at building number one as well as in front of building number three to retain the additional fill needed to raise the ground elevation of the building site to 10' above the NWL. A t110' section of the proposed sidewalk will be constructed over the 404 wetlands and the applicant proposes to install a slatted walk in this area and elevate it a minimum of 3' over the wetland substrate. Two of the three existing marina access wooden walkways will be replaced and repositioned slightly. The new access wooden walkways will be elevated a minimum of 3' over the wetland substrate. As proposed, the new pool will be constructed immediately landward of the retaining wall at building number three. A round pool is proposed with a concrete apron. The apron around the pool will tie into the proposed sidewalk resulting in two cantilevered areas over the 404 wetlands. These concrete cantilevered areas are ±300 ft2 of shaded impact and will be constructed >3' above the wetland substrate. The total amount.of impervious surface existing within the 75' Estuarine Shoreline has been calculated at ±102,937.5 ft2 or ±71 %. ';3Kt D6E eolmTe Date NARRATIVE PROJECT DESCRIPTION This project involves the re -development of a 16.42-acre parcel of land located along the James City waterfront at the confluence of the Trent and Neuse Rivers, opposite from downtown New Bern. The existing site contains the Bridge Pointe Hotel, and is approximately 95% impervious overall. Work associated with the project includes preparation of the site for construction of 3 residential condominium buildings, a new marina office, the destruction of the existing hotel and construction of a new hotel. Modification of the existing stormwater management system, construction of an additional stormwater management system, parking and roads will also be performed. The disturbed area created by the proposed work includes most of the existing 16.42 acres. SITE DESCRIPTION The project site is located along the James City waterfront at the confluence of the Trent and Neuse Rivers, opposite from downtown New Bern. The Division of Coastal Management Area of Environmental Concern (AEC) at this location measures 75 feet landward from the normal water line of the Trent River, and contains approximately 3.07 acres of the project site. The project site has approximately 1,830 feet of shoreline and 1,865 feet of existing bulkhead/retaining wall. The existing configuration includes approximately 1,050 feet of concrete capped, concrete sheet -pile bulkhead, 258 feet of tongue and groove wooden bulkhead and 557 feet of tongue and groove wooden retaining wall. (Where there is land on. one side and water on the other of the wall, we refer to it as a bulkhead, and where there is land on both sides of the wall, we refer to it as a retaining wall.) In its existing configuration, the project -site is approximately 90-95% impervious, primarily due to a compacted gravel surface that is present throughout most of the site. The site also contains the existing Bridge Pointe Hotel, a marina office building, and parking areas. PHASED CONSTRUCTION Construction of this project is proposed to be divided into three phases. Understanding the phases requires knowledge of the assumed building numbering that is as follows; building one is located on the peninsula, building two is located south of building one, and building three is located where the existing hotel is currently. The location of these three buildings is within the waterfront portion of the project site (north of Outback Steakhouse) . The proposed hotel will be located on the landward portion of the project site (south of Outback Steakhouse). During phase one, the existing stormwater basin will be modified to the proposed dimensions, a new outlet structure constructed, the proposed forebay wall constructed, and the stormwater pipe network for buildings one and two installed. Construction of buildings one and two will follow, with appropriate site preparation NARRATIVE (cont'd) and manipulation. Both proposed driveways and connecting road portions will also be constructed during this phase to the extent that access to the existing hotel, the new buildings, and Outback Steakhouse will be established or improved. Phase two will probably begin with demolition of the existing hotel and associated improvements, and conclude with the construction of building three. Replacement of the existing wooden bulkhead/retaining wall will occur during this phase. Replacement of the existing wooden bulkhead will be performed by installing a new bulkhead in an alignment no more than two feet waterward of the existing bulkhead's alignment. Replacement of the existing wooden retaining wall will be performed by removing the existing and installing a new bulkhead in the same alignment. In some places, the height of the existing retaining wall structure will be increased. Replacement or new construction of sidewalks immediately behind the bulkhead (similar to those already present), new connections to the existing marina, and other provisions required to provide public access along the bulkhead will be installed. The stormwater pipe network intended to serve building three will be installed toward the beginning of this phase. Construction of the proposed new stormwater basin and associated pipe network will initiate phase three. Construction of the proposed hotel, attendant parking and drives will follow. It is unclear which phase will involve the demolition of the existing dock master's/marina office or during which phase construction of the proposed dock master/marina office will occur. It is anticipated that construction of the new office will precede demolition of the existing office, with construction probably occurring as a final portion of phase one. Accordingly, demolition of the existing office will likely occur during the demolition portion of phase two. Depending upon information that arises during construction, phases two and three as described above may be reversed. It is also likely that there will be some overlap of activities within the phases herein described. Phases one and two construction is primarily located within drainage area one, and improvement or modification of the existing stormwater system will be correspond with the proposed construction. Phase three construction is contained entirely within drainage area two. Construction of the stormwater system proposed for this drainage area will occur prior to construction of any impervious surfaces other than roads. Upon completion of the proposed construction, approximately 54% of the AEC will be impervious. Narrative Description: The Bridge Pointe Marina is located at 1004 Howell Road in New Bern, Craven County. The project site is found by traveling west on Hwy. 70 towards New Bern, taking the Downtown New Bern exit, the marina is located on the left hand side of the road, at the bottom of the ramp, at the confluence of the Trent and Neuse River. The subject property is three parcels totaling 16.42 acres bordering the Trent River and averages 3' in elevation above NWL. The water front rights are owned by Riverfront Investors, LLC. There is currently a hotel, dock masters house, and associated marina parking on the upland parcels owned by Bridge Pointe Development, LLC. There is a 138 slip marina originating from the property. The elevation of the tract is approximately 3' above NWL. The high ground consists of yard grass and ornamental landscaping. The Army Corps of Engineers has claimed a Section 404 Wetlands fringe waterward of the existing upland retaining wall. This Section 404 Wetland is labeled as "wetland area" on the associated workplats. At the Normal Water Level are 2 colonies of Black Needle Rush (Juncus roemerianus). Both areas are approximately 20' x 20'. The waterbody at the subject property is 1200' across at the narrowist point and 1600' across at the widest point. The property has a combined shoreline of approximately 1800' and the substrate in the Trent River at this location consist of sand and silt. The property west of the site is owned by NC Railroad and the property east of the site is owned by NC DOT. Directly across the Trent River from the Bridge Pointe Hotel and Marina is the Sheraton Hotel and Marina. Water depths at the facility vary from 0' below NWL at the head of the inland basin to approximately 14' below NWL at the end of the existing marina. There is a channel in the vicinity of the marina that is located approximately 65' from the end of the existing docks at the closest point. After a site visit and the review of aerial photography, it appears that no SAV exists in the area. The Division of Water Quality classifies this area as SB-NSW waters. This area is not a Primary Nursery Area. This Trent River is closed to the taking of shellfish and no visible shellfish were observed. The Craven County Land Use Plan dated 1996 classifies this area Community on the highground and Conservation within the AFC's. The substrate composition at the project site within the Trent River is silty sand. 10. Project Description: The applicant is proposing to expand an existing 138-slip marina by 24.6% to a 172-slip marina. The existing docks will remain in place and in the same configuration. The current western most dock will be extended landward and accommodate 6 new slips as well as replace an existing slip. The dimensions of this dock will be .100' x 6' with 4 associated finger piers measuring 30' x 3.5' . An additional dock will be constructed in the westernmost basin to accommodate 14 new slips. The dimensions of this dock will be 235' x 8' with 7 associated finger piers measuring 40' x 4.5' . These two new docking facilities will account for 20 of the 34 slips proposed for expansion. The remaining 14 slips are proposed as side to docking along the existing bulkhead at the waterward end of the existing peninsula as well as a 70' slip Bridge Pointe Development, LLC Page 03 at the head of the western most basin. There will be 46 mooring pilings installed along the bulkhead and between the new finger piers as part of the boat slips. Additionally, new gangway and platform are proposed ,at the head of the eastern most basin. This platform will be constructed at the Normal Water Level and will measure 58' x 11' and will be accessed by a gangway originating from the bulkhead. The purpose of the platform is loading and unloading of pedestrians at the water level to access the amenities on the highground. The two new docking facilities will extend no farther into the waterbody than the existing piers and will conform to the 1/4 width rule. The new docks are commercial and therefore are not subject to the 4 square foot rule. The applicant is proposing to maintenance dredge two areas totaling 600 cubic yards of silty - sand material. The material will be dredged using a barge -mounted excavator. The first area is approximately 7500 square feet and water depths at this -locationcrange-from —0' at NWL to —3 at NWL. The dredging will make a final project depth at this location of —4 NWL and will total 360 cubic yards of material. The second area to be dredged is located at the landward edge of the new 100' x 6' dock. This area is approximately 6000 square feet and water depths at this location range from —2.5' at NWL to — 5' at NWL. The dredging will increase the controlling depths to —5 NWL and will total 240 cubic yards. The spoil material will be disposed of off -site at an upland location outside of the AEC. CAMA Major Permit #106-06 was issued for the upland development on this site. CAMA Permit # 106-06 was issued for the demolition of the old harbormaster building and the construction of a new harbor master building, replacement of the existing wooden bulkhead and replacement of the existing retaining walls. This permit was processed through the Express Permitting Program. 11. Anticipated Impacts: A total of 13,500ft2 would be excavated which would result in the removal of 600 yd3 of silty sand material. The spoils would be disposed at an off -site upland location. Signature of Permittee V, /erfront Investors, LLC Permit # 106-06 Page 2 of 3 ADDITIONAL CONDITIONS 3) Prior to occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed, operable, easily accessible, and maintained for the life of the marina. 4) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 5) Handrails shall be installed along the entire length of the bulkhead and openings in the railing shall only be provided for the authorized slips. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10) This permit authorizes an additional 34 boat slips for a maximum of 172 formalized boat slips. NOTE: Any proposal to add additional boat slips to the authorized slip facility may require a review under the N.C. Environmental Policy Act (NCEPA). Easement 11) Prior to construction of any new boat slips under this permit, the permittee must apply for and receive an Easement from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e). A copy of this easement shall also be provided to the Division prior to initiation of construction of any new boat slips. Riverfront Investors, LLC ADDITIONAL CONDITIONS General Permit # 106-06 Page 3 of 3 12) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 13) No open water areas or vegetated wetlands shall be excavated or filled, even temporarily. 14) The marina facility shall have appropriate waste disposal facilities and display a sign showing the waste disposal information. 15) This modification shall be attached to the original Permit No. 106-06, which was issued on 7/27/06, and copies of both documents shall be readily available on site when Division personnel inspect the project for compliance.
