Stevens Division of Water Quality June 11, 2001 DWQ# 01-0772 Dare County Larry Hodge 234 Sunview Drive Kill Devil Hills, NC, 27948 APPROVAL of 401 Water Quality Certification Dear Mr. Hodge: You have our approval, in accordance with the attached conditions, to place fill in 0.035 acre of non-vegetated wetlands in order to construct a 250 linear foot replacement bulkhead and construct a 4'x 30' dock with two mooring pilings in Clipper Inlet, adjacent to your property at the north end of Knight Court in Dare County, as described in your application received by the Division of Water Quality on May 20, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Mr. Hodge's lot, more specifically reference as Lot 50, Section V, is located outside of the gated section of the subdivision, on Knight Court, adjacent to a man- made canal and Colington Bay. The lot is located on the south side of the cul-de-sac on Knight Court, and consists of approximately 11,672 square feet. Vegetation found on the site is limited to live oak (Quercus virginiana), minosa (Mimosa strigillosa), loblolly pine (Pinus taeda), salt meadow hay (Spartina patens), catbrier (Smilax bona-nox), and dandelions (Taraxacum officinale). The average elevation of the sandy lot is approximately four feet above normal water level according to the application. No Coastal or Section 404 Wetlands are located on the property. According to the Flood Insurance Rate Map the property is in a designated Flood Zone with a Base Flood Elevation (BFE) requirement of nine feet. Located immediately north of the applicant's property is a paved road (Knight Court). To the south and east of the property is Estuarine and Public Trust Waters. Located on the adjacent lot, to the west (on a separate lot), is a dwelling belonging to the applicant. The shoreline along the applicant's property has an old concrete capped sheathing bulkhead that is in extremely poor condition. Several large sections of sheathing have deteriorated causing severe erosion behind the bulkhead. The deepest erode pockets along the bulkhead measure 18' from NWL waterward to the existing bulkhead alignment. Water depths along the existing bulkhead vary from 2.2' to 3'-0" below NWL. Located within the breaches are piles of wood and concrete debris, and remnant carpet that have been dumped on the property through the years. The applicant proposes to remove the debris prior to installing the proposed bulkhead. The water bottom adjacent to the bulkhead is sandy and gently slopes away from the shoreline into the sound. While submerged aquatic vegetation is present near the property, there is no evidence of vegetation within the project area itself. Colington Bay is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Currituck Sound is SC (fish propagation). Additional review indicates that there are no known geological formations associated with the applicant's property. There are six identified archeological sites within the Colington Harbour Subdivision (DR13-16, DR43 and DR57). PROJECT DESCRIPTION The applicant proposes the following activities: 1) According to the application, Mr. Hodge proposes to construct a 250' wooden replacement bulkhead, a maximum of 20', and an average of 10.4' from normal water level. However, staff measurements indicate that the bulkhead will be 240' in length, from property line to property line. The difference in staff and applicant measurement resulted in only slight differences in calculations. Approximately 1,390 square feet of shallow water habitat and Estuarine Water Larry Hodge Field Report Page 3 will be filled in association with the stabilization project, while approximately 3,111 square feet of high ground will be filled and graded. It is estimated that approximately 70 cubic yards of fill will be placed below NWL and 180 cubic yards of fill will be placed over and above NWL. Staff estimates the total area of fill associated with the project to be 4,507, while the application places estimates at approximately 5,000 square feet. 2) The applicant proposes to construct a 4' x 30' dock and two mooring pilings paralleling the shoreline in Clipper Inlet. The proposed dock will result in the shading of 120 square feet of shallow water bottom. The dock and mooring pilings will extend a maximum of 16' into the man-made canal, which is approximately 81' wide, measured from bulkhead to bulkhead. The proposed dock and pilings will be approximately 40' east of the adjacent riparian line. ANTICIPATED IMPACT • The loss of 1,390 square feet of Shallow Water Habitat and Estuarine Water. • The shading of 120 square feet of shallow water habitat. • Temporary localized turbidity will occur during construction of the bulkhead, pier and mooring pilings. • Approximately 3, 111 square feet of high ground will be filled in association with the shoreline stabilization. • Stabilization of the breached in the owner's bulkhead will reduce the amount of sediment runoff into the Currituck Sound. • The new bulkhead alignment and dock will enhance the development potential of the property. A secondary impact of the development will be the future residential development, the increased impervious surfaces that come with development, and a possible increase in surface runoff. • Another secondary impact will be the increased use of the adjacent waters and the resulting non-point source pollution that results from such uses. V Colington Harbour) The proposed project will consist of four portions. The following is an outline of the project and a brief narrative of the work to be performed. 1. Prior to starting the installation of the dock, mooring poles and bulkhead, removal of the existing failed concrete bulkhead and existing concrete rip rap will have to take place. These materials will be removed from the site and disposed at the proper land fill site. After removal of the existing concrete debris, construction of the proposed wooden bulkhead can start. The proposed bulkhead is 250' in length and will have tie backs installed landward 15' as shown in the application. Installation of the tie backs will require landward disturbance as noted on the submitted site plan. Once all tie backs are installed, backfilliug of the bulkhead can start. The compatible backfill material will be sand brought from an upland source. Approximately 250 cubic feet of fill will be required for the project. Approximately 24 inches of fill will be placed below the normal water line on the landward side of the proposed bulkhead and from 24 to 30 inches placed above the proposed the normal water line. At the completion of this phase of the project, the total area of land disturbance will be approximately 5000 square feet (250' x 20'). At the time of application no submerged vegetation was noted and no coastal wetland vegetation is on noted on site. 3. Upon completing construction of the bulkhead, the dock and mooring poles can be installed. The dock will be attached to the bulkhead on one side and supported on 6x6 t.w. pilings on the waterward side. The mooring poles will be placed as shown on the site plan and will be eight (8) inch diameter round poles. 4. Once all constriction and site cleaning is complete, stabilization can start. Stabilizing will consist of seeding with fescue or rye grass and covering with straw to aid in growth of the seed.
